1 DALLAS COUNTY, IOWA CHAPTER 12 TITLE II - TRANSPORTATION CHAPTER 12 DRIVEWAYS, ENTRANCES AND CULVERTS 12.01 Application to County Engineer 12.04 No New Entrance Allowed 12.02 Drainage Structure 12.05 Design and Construction 12.03 Surfacing Material 12.06 Responsibility for Maintenance 12.07 Infractions 12.01 APPLICATION TO COUNTY ENGINEER. Upon application to the County Engineer by any property owner desiring an entrance way or driveway the County Engineer or Road Superintendent shall view the location, and determine the feasibility and size of opening necessary for proper drainage. The exact location of the drive shall be designated by the Engineer or Superintendent on the priority basis of 1) safety, 2) drainage, and 3) convenience of the landowners, as per the permit issued by the County Engineer. 12.02 DRAINAGE STRUCTURE. Upon approval of the requested location, the owner requesting said entrance to property from the County road shall furnish a drainage structure of the size opening stated and material approved by the Engineer. 12.03 SURFACING MATERIAL. The landowner shall be responsible for the initial application of surfacing material if desired. 12.04 NO NEW ENTRANCE ALLOWED. No entrance will be allowed if the property is presently adequately served by access to a secondary road. Exceptions will be considered on a case-by-case basis for agricultural efficiencies or commercial activities. 12.05 DESIGN AND CONSTRUCTION. Design and construction of the drive will be in conformance with applicable Federal, State and local criteria. Construction of the entrance is the responsibility of the property owner. 12.06 RESPONSIBILITY FOR MAINTENANCE. 1. The owner requesting said entrance is responsible for maintenance. 2. In the event repairs are needed at any time with respect to culverts, it is the responsibility of the ---PAGE BREAK--- 2 property owner to make such repairs, and, in the event the owner fails to do so, the County shall have the right to make the repairs. If the CHAPTER 12 DALLAS COUNTY, IOWA property owner fails to reimburse the County for the cost of said repairs, the cost shall be certified to the County Treasurer and specially assessed against the property as by law provided. 3. Necessary maintenance for the benefit of the road may be performed by the County. 12.07 INFRACTIONS. The provisions of Chapter 2 of this Code of Ordinances shall be applicable for violations of this chapter.
