1 DALLAS COUNTY, IOWA CHAPTER 13 TITLE II - TRANSPORTATION CHAPTER 13 PUBLIC WAY PARKING 13.01 Purpose 13.04 Removal 13.02 Stopping on Public Highways 13.05 Infractions 13.03 Time Restrictions 13.06 Subdivision Parking 13.01 PURPOSE. The purpose of this chapter is to establish the County’s policy concerning parking upon its existing public ways. This policy and the restrictions herein are to be implemented within the resources available to the enforcing departments. The higher or more stringent standard and requirement of state law or this ordinance shall apply. 13.02 STOPPING ON PUBLIC WAYS. Upon any existing County public way, a person shall not stop, park, or leave standing a vehicle, whether attended or unattended: 1. Upon any paved highway or shoulder adjacent thereto. As used in this chapter, "paved highway" includes an asphalt surfaced roadway. 2. Upon the traveled portion, shoulder or clear zone of any local service road. As used in this chapter, "clear zone" is defined as ten feet from the edge of the traveled portion of a local service road. 3. Upon any public way between entrance/exit ramps of limited access roads or Interstate Highways. These areas are intended for the free and safe passage of vehicles and occasional needs of disabled, maintenance, and emergency vehicles. Furthermore, the clear zone has been established as a safe haven for errant vehicles and an area protected from obstructions. 13.03 TIME RESTRICTION. The following time restraints shall apply for removing disabled vehicles in violation of this chapter: 1. Disabled vehicles shall be removed from the traveled ---PAGE BREAK--- 2 portion of paved roadways or to the extreme shoulder of local service roads within two hours of becoming disabled. CHAPTER 13 DALLAS COUNTY, IOWA 2. Disabled vehicles or portions thereof shall be removed from the public way within 48 hours of becoming disabled. 13.04 REMOVAL. Vehicles stopped, parked or left standing in violation of this chapter may be removed by any peace officer or Secondary Roads Department personnel to the nearest vehicular garage, property owned by the registered owner of the vehicle, or other place of safety. 13.05 INFRACTIONS. The provisions of Chapter 2 of this Code of Ordinance shall be applicable for violations of this chapter. 13.06 SUBDIVISION PARKING. Regulations governing parking on public ways within individual subdivisions shall be determined at the time of the approval of the individual subdivision and shall be in accordance with standards adopted by the County. The regulations shall be signed accordingly within the subdivision.
