1 DALLAS COUNTY, IOWA CHAPTER 25 TITLE III - PUBLIC ORDER AND SAFETY CHAPTER 25 COUNTY CONSERVATION GENERAL POLICIES AND REGULATIONS 25.01 Purpose 25.03 Unlawful Acts 25.02 Definition 25.04 Infractions 25.01 PURPOSE. It is the policy of County Conservation to provide safe and healthful recreation opportunities while protecting and enhancing the county area resources. The purpose of this chapter is to facilitate the enjoyment of county conservation facilities and parks by the general public by establishing rules and regulations governing the use of park and other county operated recreational facilities, natural resource areas, and historical sites. 25.02 DEFINITION. For use in this chapter, the term Director means the Dallas County Conservation Director. 25.03 UNLAWFUL ACTS. It is unlawful for a person to commit any of the following acts. 1. Discriminate against a person or persons because of sex, race, creed, color, or national origin in the conduct of operations under a lease, license or concession contract with the County Conservation Board. 2. Park a vehicle so as to block traffic flow. 3. Park in violation of posted restrictions or so as to endanger any person, area, property or environmental feature. 4. Park in spaces posted as reserved for persons who are physically disabled. 5. Park and/or operate a vehicle off the designated road-way or through, around or beyond a restrictive barricade, fence or traffic control barrier. 6. Operate a vehicle so as to exceed the posted speed limit or in violation of other posted regulations. ---PAGE BREAK--- 2 CHAPTER 25 DALLAS COUNTY, IOWA 7. Operate a vehicle in a careless, negligent or reckless manner so as to endanger any person, project or property or environmental feature. 8. Use a vehicle for other than ingress and egress at a developed area. 9. Operate a vehicle without an effective muffler. 10. Operate an aircraft on park lands other than at a designated landing area. 11. Operate any aircraft while on or above park lands or waters in a careless or reckless manner as to endanger any person or property. 12. Deliver a person or thing by parachute, helicopter, or other means of air delivery without having obtained written permission from the Director except in an extreme emergency threatening human life or serious property loss. 13. Swim, dive, snorkel or scuba dive at launching sites, designated mooring points and other prohibited areas. 14. Picnic in a prohibited area. 15. Camp in a prohibited area. 16. Camp at any one park for a period longer than 14 days during any 30 consecutive day period. 17. Reserve a campsite without written permission. Permission may be obtained from the Director by applying to the County Conservation Department. 18. Dig or level the ground or construct any structure without written permission from the Director. 19. Hunt, fish or trap in a prohibited area. 20. Improperly dispose of garbage, trash, rubbish, litter or any other waste. CHAPTER 25 DALLAS COUNTY, IOWA ---PAGE BREAK--- 3 21. Bring any material into a park for the purpose of disposal without written permission from the Director. 22. Spill, pump or discharge contaminants, pollutants or other wastes on park lands. 23. Fail to maintain a clean campsite or picnic area or to remove personal equipment, trash or litter upon departure. 24. Discharge or place sewage, galley waste, garbage, refuse or pollutants into park waters from any vessel or watercraft. 25. Store gasoline or other fuels, except that which is contained in the storage tank of a vehicle, vessel, camping equipment or hand portable container, without having obtained written permission from the Director. 26. Kindle a fire at a location other than a designated area. 27. Fail to confine a fire in a fireplace, grill or other facility designed for this purpose. 28. Leave a fire unattended or fail to completely extinguish a fire prior to departure. 29. Burn materials that produce toxic fumes. 30. Improperly dispose of lighted smoking materials, matches or other burning material before they are extinguished. 31. Bring a dog, cat or other pet into a developed recreation area unless penned, caged or on a leash under 6 feet in length or otherwise under physical restraint at all times or have any animal or pet in a swimming beach area or sanitary facility. 32. Allow an animal to impede or restrict the use of lands or waters by the public. 33. Fail to properly remove and dispose of any wastes produced by pets in designated public use areas. 34. Bring or allow horses, cattle or other livestock in camping, picnic, swimming or other undesignated recreational areas. ---PAGE BREAK--- 4 CHAPTER 25 DALLAS COUNTY, IOWA 35. Allow livestock to graze or encroach on park lands or fail to remove same when requested. 36. Fail to observe visiting hours. 37. Enter a closed area or use an area contrary to posted restrictions. 38. Create excessive noise in a public use area between the hours of 10:00 p.m. and 6:00 a.m. which unreasonably disturbs another person. 39. Perform any act or conduct, including boisterous, rowdy or disruptive behavior which interferes with, impedes or disrupts the use of the park or impairs the safety of another person. 40. Operate or use an audio or noise producing devise, including but not limited to communications media and motorized equipment or other vehicles, in such manner as to unreasonably annoy or endanger another person. 41. Exceed reasonable noise level with motorized equipment. 42. Possess a loaded firearm, ammunition, projectile firing device, bow and arrow, cross bow or explosive of any kind except as authorized. 43. Possess or use fireworks without having obtained written permission from the Director. 44. Destroy, injure, deface, remove or alter public property, including constructed facilities, natural formations, historical and archaeological features and vegetative growth, without having obtained written permission from the Director. 45. Cut or gather trees or parts of trees and/or remove wood from park lands without approval from the Director. 46. Abandon, store or leave personal property unattended. 47. Fail to deposit found articles at the County Conservation ---PAGE BREAK--- 5 CHAPTER 25 DALLAS COUNTY, IOWA Board headquarters or with the Director. 48. Advertise by the use of a billboard, handbill, sign, marker, audio devise or any other means without having obtained written permission from the Director. 49. Engage in or solicit business without written agreement with the County Conservation Board. 50. Refuse or fail to comply with the terms or conditions of a permit issued by the County Conservation Board. 51. Construct, place, use or maintain a structure of any kind under, upon or over park lands, without having obtained written authorization or in contradiction to a written agreement with the County Conservation Board. 52. Hold a water carnival, boat regatta, music festival, dramatic presentation or other special recreational program without having obtained written permission from the Director. 53. Charge a fee to the public for an authorized water carnival, boat regatta, music festival, dramatic presentation or other special recreational program when a fee schedule has not been applied for and approved in writing by the Dallas County Conservation Board. 54. Occupy land, a building or other facility for the purpose of maintaining the same as a full or part time residence without having obtained written authorization or when not otherwise authorized by the Director or his authorized representative. 55. Use park lands or waters for agricultural purposes except when in compliance with terms and conditions authorized by lease, license or written agreement with the County Conservation Board. 56. Fail to pay recreation use fee. 57. Interfere with a County employee in the conduct of official duties. 58. Fail to comply with a lawful order directed by a County employee in the performance of official duties or to provide a ---PAGE BREAK--- 6 CHAPTER 25 DALLAS COUNTY, IOWA correct name, address or other identification upon request. 59. Operate an unauthorized vessel or other watercraft for a fee or profit. 60. Operate a vessel or other watercraft in a prohibited or restricted area. 61. Operate a vessel in a careless, negligent or reckless manner so as to endanger a person or property. 62. Use a vessel without safety equipment complying with U.S. Coast Guard boating safety requirements. 63. Use a vessel or other watercraft for overnight occupancy, when such use is not incidental to recreational boating, or as a place of habitation or residence. 64. Use water skis or similar devices in a restricted area. 65. Water ski in a careless, negligent or reckless manner so as to endanger any property or person. 66. Leave a vessel that is not in actual use unless such vessel is securely moored at an approved mooring facility. 67. Place floating or stationary mooring facilities so as to interfere with a buoy, channel marker, or other navigational aid. 68. Use any vessel not constructed or maintained in compliance with the standards and requirements of the National Safe Boating Act of 1971 or promulgated pursuant to such Act. 69. Operate a vessel or watercraft without an effective muffler. 70. It is unlawful for any person to perform any act in violation of posted rules, regulations, or signs. 25.04 INFRACTIONS. The provisions of Chapter 2 of this Code of Ordinances shall be applicable for violations of this chapter.
