1 DALLAS COUNTY, IOWA CHAPTER 5 TITLE I - POLICY AND ADMINISTRATION CHAPTER 5 AN ORDINANCE PRESCRIBING THE MENTAL HEALTH SERVICES IN DALLAS COUNTY, IOWA 5.01 Title 5.05 Dallas County Mental Health 5.02 Intent Services Management Plan 5.03 Definitions 5.06 Application for Mental Health 5.04 Eligibility for Mental Health Services Services 5.07 Appeal 5.08 Reimbursement to County 5.01 TITLE: This ordinance shall be known as the “Mental Health Services Ordinance of Dallas County, Iowa.” 5.02 INTENT: It is the position of Dallas County that services will be provided in Dallas County for individuals with a need for Mental Health, Mental Retardation, and Developmental Disability services and supports when dollars from the Mental Health Services Fund are utilized to pay for those services or supports. It is the intent of the County that this ordinance and the Dallas County Mental Health Services Management Plan fulfill the requirements of Iowa Code Section 331.439 and the administrative rules in Human Services Chapter 25 Disabilities Services Management. 5.03 DEFINITIONS: The definitions of terms used in this ordinance are as follows: 1. "Director/CPC Administrator” means the Director/Central Point of Coordination of Dallas County Community Services who is appointed by the Dallas County Board of Supervisors. 2. “Completed Application” means the Funding Application form completed, signed and all necessary supporting documentation completed and filed with the Director/CPC Administrator. 3. “Mental Health Services” means services and supports for individuals with a diagnosed disability including mental illness, chronic mental illness, mental retardation, brain injury, and developmental disability. 4. “County Mental Health Services Management Plan” means the Dallas County's Managed Care Policies and Procedures developed pursuant to Iowa Code Supplement section 331.439, for providing an array of cost-effective individualized services ---PAGE BREAK--- 2 and supports which assist Dallas County Individuals be as independent, productive and integrated into the community as possible within the constraints of the services fund. 5. Terms used in the Dallas County Mental Health Mental Health Services Management Plan will be defined therein. 5.04 ELIGIBILITY FOR MENTAL HEALTH SERVICES: Eligibility for Mental Health Services shall be determined on the basis of need as established and verified by the Director/CPC Administrator according to the guidelines set out in the “Dallas County Mental Health Services Management Plan”. CHAPTER 5 DALLAS COUNTY, IOWA 5.05 DALLAS COUNTY MENTAL HEALTH SERVICES MANAGEMENT PLAN: 1. The rules, regulations and standards for administering Mental Health Services shall comprise the Dallas County Mental Health Services Management Plan. 2. The Mental Health Services Management Plan shall be adopted by resolution of the Dallas County Board of Supervisors. 3. Amendments to the Mental Health Services Management Plan shall be made by resolution pursuant to Section 331.302 of the Code of Iowa. 4. Copies of the Mental Health Services Management Plan shall be available to the public in the office of the Director/CPC Administrator, Dallas County Community Services. 5.06 APPLICATION FOR MENTAL HEALTH SERVICES: Application for Mental Health Services shall be made to the Director/CPC Administrator, Dallas County Community Services on forms supplied by the Director/CPC Administrator. 5.07 APPEAL: Any decision made by the Director/CPC Administrator may be appealed by following the Appeal Procedure outlined in the Dallas County Mental Health Services Management Plan. 5.08 REIMBURSEMENT TO COUNTY: Circumstances and provisions requiring application to reimburse Dallas County are defined in the Dallas County Mental Health Services Management Plan.
