In an attempt to provide the various manufacturers the opportunity to submit proposals, the County has established specifications that meet the requirements of current standards, as well as the needs of the County. This bid process will allow for manufacturers of all similar equipment and supplies the opportunity to submit bids. It is noted that the County intends to standardize its equipment. Given this fact, and the fact that several other Municipalities locally have also standardized, and in light of the concept of interoperability, especially at an incident that could require additional resources, the ability to interchange tools and equipment is desirable, and may be influential in the award process. WMBE bidders are encouraged to apply. With a view to obtaining the best results and the most acceptable complete units, these specifications cover minimum requirements as to the type of construction and components, as well as tests to which the equipment and supplies must conform, together with certain details as to equipment and supplies to be furnished. Minor details of construction and materials, where not otherwise specified, are left to the discretion of the contractor, who shall be solely responsible for the design and construction. If there is a method of manufacture that prohibits a bidder from meeting the intent of the specification, then the bidder may submit an exception with full written explanation as to why they cannot meet that part of the specification. Cortland County Fire Coordinator shall review the exception, and shall make a determination to the validity of the explanation, and shall render his decision. The decision of the Fire Coordinator shall be final and binding. All Bidders shall explain all exceptions in detail to any of the areas of these specifications (on an additional sheet of paper if necessary). 1.DELIVERY DATE COMPLIANCE EXCEPTION A delivery date shall be stated at the time of order. Said delivery date shall be not more than 60 calendar days from the date of order. The date of order shall be transmitted via fax or email to Cortland County on the day the order is placed. Said transmission of information will include an order number, date of order, units ordered, and must show a delivery date of no more than 60 calendar days from the date of order. Should said delivery date be exceeded, a charge of $50.00 per day (regardless of what unit or accessories are not received) shall be instituted, and any charges shall be applied to reduce the total cost of the bid to Cortland County. ---PAGE BREAK--- Cortland County Water Rescue Equipment and Supplies Bid Bids Due March 13, 2017 Page 3 of 9 2.QUANTITIES COMPLIANCE EXCEPTION The County may make an award for all or some of the items set forth in the proposal. The County reserves the right to accept the lowest, most responsible bid, a combination of bids, or to reject all bids. The County reserves the right to split the bid into multiple awards at its sole discretion. 3. EQUIVILANCEY COMPLIANCE EXCEPTIONS All parties must agree that the Cortland County Fire Coordinator’s decision on equivalency or better is final and binding on all parties. Any supporting documentation may be sent to the County to aid in determination. 4. BID PRICING COMPLIANCE Bid pricing must be valid until May 31st, 2017. It should be understood that the majority of the purchase will be made at one time, with the intent that it be made within 10 days of bid opening. No EXCEPTION 5. NON-COLLUSIVE BIDDING CERTIFICATE COMPLIANCE A Non-Collusive Bidding Certificate (attached) as specified in the New York State General Municipal Law must accompany the bid. NO EXCEPTION 6. IRAN DIVESTMENT ACT COMPLIANCE An Iran Divestment Certificate (attached) as specified in the New York State General Municipal Law must accompany the bid. NO EXCEPTION 7. SHIPPING COMPLIANCE EXCEPTIONS Bids shall be inclusive of all shipping charges to the County. This shall be valid for all items with no regard to how many items are awarded to each bidder. 8. ASSEMBLY COMPLIANCE EXCEPTIONS All components shall be delivered ready to use, and shall require no assembly or maintenance by department personnel prior to their initial operation. 9. NFPA and UL compliance COMPLIANCE EXCEPTIONS The tools supplied shall meet the current National Fire Protection Associations Standard appropriate for that item. Additionally, tools must be UL Tested and certified by Underwriters Laboratories, Inc. 10. Under the Act, the Commissioner of the Office of General Services (OGS) will be developing a list of “persons” who are engaged in “investment activities in Iran” (both are defined terms in the law) (the “Prohibited Entities List"). Pursuant to SFL § 165-a(3)(b), the initial list is expected to be issued no later than 120 days after the Act’s effective date at which time it will be posted on the OGS website. By submitting a bid in response to this solicitation or by assuming the responsibility of a Contract awarded hereunder, each Bidder/Contractor, any person signing on behalf of any Bidder/Contractor and any assignee or subcontractor and, in the case of a joint bid, each party thereto, certifies, under penalty of perjury, that to the best of its knowledge and belief, that each Bidder/Contractor and any subcontractor or assignee is not identified on the Prohibited Entities List created pursuant to SFL § 165-a(3)(b). Additionally, Bidder/Contractor is advised that any Bidder/Contractor seeking to renew or extend a Contract or assume the responsibility of a Contract awarded in response to this solicitation must certify at the time the Contract is renewed, extended or assigned that it is not included on the Prohibited Entities List. During the term of the Contract, should the County receive information that a Bidder/Contractor is in violation of the above-referenced certification, the County will offer the person or entity an opportunity to respond. If the person or entity fails to demonstrate that he/she/it has ceased engagement in the investment which is in violation of the Act within 90 days after the determination of such violation, then the County shall take such action as may be appropriate including, but not limited to, imposing sanctions, seeking compliance, recovering damages or declaring the Bidder/Contractor in default. The County reserves the right to reject any bid or request for assignment for a Bidder/Contractor that appears on the Prohibited Entities List prior to the award of a contract and to pursue a responsibility review with respect to any Bidder/Contractor that is awarded a contract and subsequently appears on the Prohibited Entities List.
