Page4of4 ---PAGE BREAK--- ON MOTION OF KEVIN \VHITNEY RESOLUTION NO. 109-16 Local Law 7 of 2016 - Repealing Local Law #5 of 2015 -Overriding 2016 Property Tax Cap WHEREAS, the New York State Legislature enacted General Municipal Law §3-c, which establishes a limit upon real property tax levies by local governments, AND WHEREAS, pursuant to General Municipal Law §3-c a local govemment may adopt a budget in excess of the tax levy limit only if the goveming body of such local govemment first enacts a local law to override the tax levy limit for the coming fiscal year only, AND WHEREAS, the Cortland County legislature adopted the 2016 property tax cap override in Resolution 280-15 (Local Law No. 5 of 2015) on October 22, 2015, AND WHEREAS, New York State law requires the repealing of said override if the County is under the property tax cap-to assure that county residents receive a Property Tax Cap refund check, AND WHEREAS, the proposed Local Law has sat on Legislator's desks for seven days, and a public hearing was held on February 25, 2016, NOW THEREFORE BE IT ENACTED by the Cortland County Legislature that this Local Law 7 of 2016 shall repeal Local Law #5 of 2015 (registered as Local Law #1 of 2016), which provided for the 2016 property tax 'W'f" cap override STATE OF NEW YORK) SS: COUNTY OF CORTLAND ) This is to certify that I, the undersigned, Clerk of the Cortland Counfy Legislature, have compared the foregoing copy . with the original now on file in this office, and that the above actions were passed by the Cortland Counfy Legislature on the 25th day of February, 2016 and that the same is a correct and true transcript of such actions taken. • IN WITNESS WHEREOF I have hereunto set my hand and the official seal of the CORTLAND COUNTY • ' , ' .
