Signature Chief Assistant County Attorney Title County City Cortland Town Village Date December 20, 2016 DOS-0239-f-l (Rev.02/10) Page 4 of 4 ---PAGE BREAK--- ON MOTION OF KEVIN WHITNEY RESOLUTION NO. 488-16 Local Law 14 of 2016 - Repeal Local Law No. 11 of 2016, a Local Law Overriding Tax Levy Liinit for Fiscal Year 2017 WHEREAS, the New York State Legislature enacted General Municipal Law §3-c, which establishes a limit upon real property tax levies by local govemments, AND WHEREAS, pursuant to General Municipal Law §3-c a local govemment may adopt a budget in excess of the tax levy limit only if the goveming body of such local govemment first enacts a local law to override the tax levy limit forthe coming fiscal year only, AND WHEREAS, the Cortland County legislature adopted the 2017., property tax cap override in Resolution 415-16 (Local Law No. .11 of 2016) on November 3, 2016, AND WHEREAS, New York State law. requires the repealing of said override if the County is under the property tax cap to assure that county residents receive a Property Tax Cap refund check, AND WHEREAS, the proposed Local Law has sat on Legislator's desks for seven days, and a public hearing was held oh November 3, 2016, NOW THEREFORE • BE IT ENACTED by the Cortland County Legislature that this Local Law 14 of 2016 shall repeal said Local Law 11 of 2016, which provided for the 2017 property tax cap override.
