2017 CORTLAND COUNTY HIGHWAY DEPARTMENT SPECIFICATION AND BID FORM UNLEADED GASOLINE – REGULAR / ETHANOL (87 OCTANE) The bid shall be in conformance with the terms and conditions specified in the Advertisement for Bids, and shall also be in conformance with the following specifications. Bids must have all items denoted in the “Checklist of documents to be returned with contract” attached. These items can be found in the Standard Clauses for NY State Contracts document and shall be considered a required submission for this bid. SPECIFICATIONS: This bid shall be for supplying Unleaded Gasoline – Regular / Ethanol (87 Octane). The gasoline shall be a standard product of a recognized producer of motor fuel. The product shall be specifically designed for use in gasoline engines. The County Highway Department has storage capacity for 20,000 gallons of unleaded gasoline and estimates usage in the coming year at approximately 125,000 gallons. Due to the nature of the department's operation, the bidder must be capable of making weekend and/or holiday deliveries. All orders will be for full trailer loads of approximately 8,500 gallons unless the supplier chooses to deliver smaller amounts. Definitions: Item 1. Rack Price is defined as the Syracuse Oil Price Daily (Syracuse OPD) Reseller Tank Car Low Price (hereinafter referred to as the “Rack Price”) in effect at the time the product is loaded onto the delivery vehicle. The Rack Price is subject to periodic escalations (increase) and de-escalations (decrease). For the purpose of bid comparisons, a date is listed for this price and the bidder shall enter the price that was in effect on the listed date on the bid form for Item 1. Item 2. Required Fees are defined as the fixed taxes and fees per gallon required to be charged based on Federal and State government statutes or regulations. For all purchases of fuel under this bid, the County of Cortland is exempted from paying the following taxes and fees and they shall not be included in the price bid for fuel: State and Local sales tax, Petroleum Business tax, Federal Gasoline Excise tax, NYS Motor Fuel tax ---PAGE BREAK--- The Required Fees to be included for Item 2 is as follows: a. Federal LUST fee b. Federal Oil Spill Liability Trust Fund fee The price bid for Item 2 is a fixed charge per gallon that shall remain in effect for the life of the bid and shall not fluctuate (increase or decrease) with each order. Item 3. Delivery and Profit Markup is defined as the bidder’s charge per gallon for the following: loading of fuel at the Terminal ground transportation of the fuel from the Terminal to Cortland County Highway Dept. unloading of fuel into the above-ground storage tank at Cortland County Highway Dept, overhead and profit. The price bid for Item 3 is a fixed charge per gallon that shall remain in effect for the life of the bid and shall not fluctuate (increase or decrease) with each order. Item 4. Total Bid Price is defined as the sum of the prices quoted for Items 1 at the time an order is placed plus the sum of the fixed prices bid for Items 2 & 3, as defined in this section. End Of Definitions If a bidder lists an erroneous amount for Item 1, the County of Cortland shall correct the bidder’s price for item 1 to the correct price, and adjust the bidder’s Total Bid Price for Item 4 accordingly. Award of this bid shall be to the responsible bidder with the lowest Total Bid Price (Item 4) per gallon for the specified gasoline. The Cortland County Legislature reserves the right to accept or reject any or all bids received and to award the contract in the best interest of Cortland County. All Invoices by a vendor for fuel purchased under this bid shall clearly list the price per gallon for fuel in effect at the time of delivery (sum of Rack Price plus Delivery and Markup), and a separate line showing the LUST fee. All invoices shall include a copy of the Journal of Commerce Syracuse Reseller Tank Car Low Price that was in effect at the time the product was loaded at the terminal.
