Do not include matter being eliminated and do not use italics or underlining to indicate new matter. xjCounty n C i t y n T o w n nVillage (Select one:) of Cortland STATE RECORDS CJ U Local Law No. 5 of the year 20^1 DEPARTMENT OF STATE A local law Local Law No. 5 of 2011 - A Local Law Overriding (Insert Title) The Tax Levy Limit for 2012 Be it enacted by the Legislature of the (Name of Legislative Body) xjCounty n C i t y O T o w n GVillage (Select one:) of Cortland as follows WHEREAS, according to New York State's new Property Tax Cap legislation, if a county government decides to adopt a county budget with a property tax levy that exceeds the level set by the State, the county government must pass a local law to override that cap, AND WHEREAS adopting said local law is not predictive ofthe final tax levy but will provide the Cortland County Legislature flexibility to exceed the property Tax Cap if it is deemed necessary, AND WHEREAS, a public hearing to be held before the Cortland County Legislature on November 17, 2011, to hear ail persons interested in proposed Local Law No. 5 of 2011, NOW, THEREFORE BE IT RESOLVED, on recommendation ofthe Budget, and Finance Committee, that Local Law No, 5 of 2011 - A Local Law Overriding Tax levy Limit for Fiscal Year 2012 is hereby adopted pursuant to subdivision 5 of General Municipal Law Section 3-c, which expressly authorizes the County Legislature to overhde the tax levy limit by the adoption of a local law approved by vote of sixty percent (60%) ofthe County Legislature, AND BE IT FURTHER RESOLVED that the Clerk ofthe Legislature shall publish in the official newspaper ofthe County a notice of adoption containing a synopsis of said local law and shall within twenty days file one certified copy in the Office of the County Clerk, and one copy with the Secretary of State.
