F A C T S H E E T What is the Worker Protection function of the State Labor Department? One of the main functions of the State Labor De- partment is to assure the health and well-being of workers in New York State and to enforce the laws that relate to wages, hours and working conditions. The Division of Safety and Health oversees programs that relate to: Asbestos Control; Boiler Safety; Industry Inspection, Licensing and Certification; Radiological Health; Code Rules; Safety and Health Training and Hazard Abatement; Public Employees Safety and Health; Mine Safety and OSHA regulations in the workplace. The Division of Labor Standards enforces state laws that pertain to Minimum Wage; Unpaid or Withheld Wages; Wage Supplements or Fringe Benefits; Employ- ment of Minors; Days of Rest/Meal Periods; Farm Labor; and Industrial Homework. The Bureau of Public Work addresses pay issues on construction jobs that relate to public entities. How can I get information about Worker Protection programs? The State Labor Department web site has up-to- date information about Worker Protection programs at: www.labor.state.ny.us. It also has listings of regional office contacts and locations for your specific questions. Where do I get forms and license applications? Our web site now has a document center where you can download the forms you need for licenses and certifications. Many of these are now printed by the Division of Motor Vehicles for your convenience. What are my responsibilities for Child Performers? New York State has new rules for child performers that went into effect March 29, 2004. Parents/Guard- ians must obtain permits for their child performers from the State Department of Labor and must provide evidence of the establishment of a trust account. Employers of child performers must obtain permits, as well. Part of the child performers’ earnings must be withheld for placement into a trust account. Child performers must provide evidence of satisfactory academic performance, as well.
