BURN PERMIT/OPEN BURNING REGULATIONS CITY OF CODY Section 4-4-9: UNLAWFUL TO BURN RUBBISH: It shall be unlawful for any person to burn rubbish, garbage, refuse or any waste, combustible substances or materials within the city limits. It shall be unlawful for any person to burn papers, leaves, brush, grass or any untreated wood products without a burn permit. (Ord. 2009-21, 9-15-2009, eff. 10-1-2009) Open burning shall comply with the International Fire Code (IFC): 307.2 Permit required. A permit shall be obtained from the fire code official in accordance with Section 105.6 prior to kindling a fire… Burn Permit Applications can be obtained at the following locations: City Hall – 1338 Rumsey Ave City of Cody website www.cityofcody-wy.gov Park County Fire District Offices – 1131 11th Street Park County Sheriff’s Dispatch –1402 River View Drive 307.3 Extinguishment authority. The fire code official is authorized to order the extinguishment of open burning that creates or adds to a hazardous or objectionable situation. 307.4 Location. The location for open burning shall not be less than 50 feet from any structure, and provisions shall be made to prevent the fire from spreading to within 50 feet of any structure. Exception: 1. Fires in approved containers that are not less than 15 feet from a structure. Approved containers are those specifically designed for this purpose or those approved by the Fire Marshal. 307.5 Attendance. Open burning shall be constantly attended until the fire is extinguished. A minimum of one portable fire extinguisher complying with Section 906 with a minimum 4-A rating or other approved on-site fire- extinguishing equipment, such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization. Notification: The permit holder shall deliver this completed permit to the Park County Sheriff’s Dispatch at 1402 River View Drive and shall notify dispatch at the start of burning and upon completion of burning by calling 527-8700. All fires shall be extinguished before dark, and no burning will be conducted when: • The National Weather Service in Riverton has issued a Red Flag Warning for the area • Strong winds could cause the fire to escape control • When the Park County Commissioners have instituted fire restrictions Information on weather conditions and burning can be found at: www.weather.gov/riv/fire www.weather.gov/riv/agburning Failure to comply with these regulations may result in a fine of up to $750 in accordance with Section 1-4-1 of the Code of the City of Cody. Signature of Property Owner/Person Conducting Burn Date ---PAGE BREAK--- Recreational fires meeting the following definition shall be exempt from this permit process: RECREATIONAL FIRE: An outdoor fire burning materials other than rubbish with a total fire area of 3 feet or less in diameter and 2 feet or less in height for pleasure, religious, ceremonial, cooking, warmth or similar purposes. Recreational fires shall not be conducted within 25 feet of a structure or combustible material. Conditions which could cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition. Exception: Fires in approved containers that are not less than 15 feet from a structure. Approved containers are those specifically designed for this purpose or those approved by the Fire Marshal. Recreational fires shall be constantly attended until the fire is extinguished. A minimum of one portable fire extinguisher with a minimum 4-A rating or other approved on-site fire-extinguishing equipment, such as dirt, sand, water barrel, or garden hose shall be available for immediate utilization. Please also notify your neighbors when you plan to have a recreational fire to prevent unwarranted calls to the fire department.
