Sealed bids will be accepted until 5:00 p.m. Wednesday December 9, 2020. A bid opening will be held at 9 a.m. on Thursday December 10, 2020, in the Council Chambers at Cody City Hall 1338 Rumsey Avenue. A complete bid packet is available on the City’s website at www.cityofcody-wy.gov or may be picked up at City Hall located at 1338 Rumsey Avenue or at the Paul Stock Aquatic and Recreation Center at 1402 Heart Mountain Street. INSTRUCTIONS: BID # 2020-08 USED EXERCISE EQUIPMENT Bids must be submitted on the City of Cody Bid Proposal Form in a sealed envelope plainly marked “City of Cody Bid 2020-08 Sealed Bid Exercise Equipment.” Original signed bids must be mailed or hand-delivered to City Hall located at 1338 Rumsey Avenue. Bids submitted by telephone, telegraph, email, or facsimile will not be accepted. The City reserves the right to reject any and/or all bids and further reserves the right to waive any informalities if deemed in the best interest of the City. Award of bid shall be made by written Notice of Award on or about December 16, 2020. Bidder warrants that Bidder has read the complete bid packet and agrees to the terms and conditions contained therein. The seller reserves the right to reject any and all bids. Sealed bids will be accepted until 5:00 p.m. Wednesday December 9, 2020. All property is offered for sale as-is, where-is. The City of Cody makes no warranty, guaranty or representation of any kind, expressed or implied, as to the condition, usability, value, merchantability, authenticity, or fitness for any purpose of the property offered for sale. Buyers should inspect and, if necessary, test all items prior to any use. Buyer is not entitled to any payment for loss of profit or any other money damages, including but not limited to special, direct, indirect, or consequential damages. Buyer agrees to assume all risk of and responsibility for injury to buyer, buyer’s employees, subcontractors, or any person, firm or corporation, directly or indirectly employed or engaged by the Buyer based on or coming from ownership, viewing, possessing, dismantling, handling, removing, or generally using of the equipment and or material(s) purchase or under consideration for purchase. Buyer agrees for and on behalf of bidder, bidder's heirs, successors and assigns that bidder shall indemnify and hold the City of Cody harmless from and against any claim, demand or cause of action arising or alleged to have arisen out of the sale or failure to sell any item of surplus property including claims for personal or bodily injury, death or contract damages. Award of bid shall be made by written Notice of Award on or about December 16, 2020. Bidder warrants that Bidder has read the complete bid packet and agrees to the terms and conditions contained therein. The winning bidders(s) must pay for and pickup items no later than December 31, 2020. All items not removed by this date shall be considered abandoned and subject to resale to the next highest bidder. No refunds shall be given once payment is made. Wyoming State sales tax will be assessed at the current tax rate in Park County to the purchase price of the auction, unless the buyer has provided a valid tax-exempt certificate to the City of Cody with their sealed bid. When sales tax is required, the buyer shall add and include the sales tax amount when making payment. The City of Cody may reject a sales tax-exempt certificate if it is not properly completed and signed.
