This catering permit authorizes the sale of both alcoholic and malt beverages for sales at meetings, conventions, private parties, dinners, and other similar gatherings within the City of Cody (W.S. 12-4-502a). No person OR organization shall receive more than a total of 24 catering permits for sales at the same premises in any one year. No licensee holding a catering permit shall sell or permit consumption of any alcoholic or malt beverages off the premises described in this permit. By filling out this application, I agree to operate in the City of Cody under the requirements of City Ordinances and W.S. 12-4-502 and all other applicable Wyoming laws and rules, and to file required sales tax reporting documents and remit sales taxes. Further, I acknowledge under penalty of perjury that all of the information provided in this application is true and correct. Club licenses are not considered Retail Licenses. If someone requesting a permit for an event in Cody holds a retail liquor license out of the area, we must obtain authorization from that jurisdiction. Purpose: Authorizes the sale of alcoholic and malt beverages for at meetings, conventions, private parties and dinners or at other similar gathering not held at the licensee’s licensed premises. Duration: Each permit is good for one 24-hour day. The day begins and ends at 12:00 am. Fee: $100 per day Limit: No person or organization shall receive more than a total of 24 catering permits at the same premises in any one year. Approval: No public notice or hearing is required. The Governing Body has authorized the Administrative Services Director or designee to issue the permit. No Council action is required unless the event is on city property. (Cody Auditorium is exempt) Process: 1. Applicant fills out a Catering Permit Application. 2. Enter the new permit on the existing license holder’s account. 3. Calculate the billing on the permit 4. Post the payment to the permit 5. Print the permit stamp, sign & make a copy of the permit give the original to the applicant 6. File the application and copy of the permit in central files ---PAGE BREAK--- Wyoming State Statutes 12-4-502.Twenty-four hour malt beverage permit and catering permit; restrictions; application procedure; fees. (b)A catering permit authorizing the sale of alcoholic and malt beverages may be issued by the appropriate licensing authority to any person holding a retail or resort retail liquor license authorizing the off-premises sale of both alcoholic and malt beverages, for sales at meetings, conventions, private parties and dinners or at other similar gatherings not capable of being held within the licensee's licensed premises. No licensee holding a catering permit shall sell or permit consumption of any alcoholic or malt beverage off the premises described in the permit. Notwithstanding any other provision of this subsection, closed-container items sold at auction for the benefit of a nonprofit organization may be taken off-premises. (c)The permits authorized by this section shall be issued for one twenty-four (24) hour period, subject to the schedule of operating hours provided by W.S. 12-5-101. No person or organization shall receive more than a total of twelve (12) malt beverage and twenty-four (24) catering permits for sales at the same premises in any one year, except that this limitation shall not be applicable to malt beverage permits issued for sales at any fair, rodeo, pari-mutuel event or other similar public event conducted by a public entity upon public premises. (d)The malt beverage permit and the catering permit shall be issued on application to the appropriate licensing authority without public notice or hearing. An application for a malt beverage permit or catering permit under this section shall be accompanied by a designation of the event for which the application is sought specifying the type of event and the name of the sponsor. Any applicant applying for a permit authorized by this section and having licensed premises located within a jurisdiction other than that jurisdiction to which application is made, shall secure the written approval of the licensing authority of that jurisdiction in which the licensed premises are located prior to filing an application for a permit. (e)The fee for the malt beverage permit and the catering permit shall be not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) per twenty-four (24) hour period, payable to the appropriate licensing authority.
