Fireworks and pyrotechnics that are permitted by Wyoming State Statutes to be used or sold within the state, can be offered for sale and sold within the Saturday commencing the Memorial Day weekend through Labor Day in the City in open business/light industrial “D-3” districts. 2. The building or structure used for such purposes shall be permanent in nature and fixed to a foundation that is part of the real property and shall not contain any goods or merchandise other than fireworks and pyrotechnics. 3. Each firework and pyrotechnic business shall obtain a license and pay an annual fee of $25.00. This fee does not apply to public display permits. 4. The City council has the authority to grant permits within the City limits for supervised public displays of fireworks by individuals, the City, amusement parks and other organizations. 5. No license or permit shall be transferable or assignable. 6. Full disclosure of the City laws governing fireworks and pyrotechnic licenses and permits appears in City Ordinance 5-5-1 through 5-5-3. NEW LICENSES: Step 1: Complete a Fireworks License/Permit application and turn it in to the Administrative Services office at City Hall. Step 2: Upon receipt of a completed application the City will schedule a hearing at the next available regularly scheduled Council meeting. Step 3: The applicant should appear at the hearing to answer any questions or provide additional information as needed by the Council in deciding whether or not to issue the license. Step 4: If the Council approves the application, the applicant must pay all fees prior to the issuance of the license. Once all fees are paid, the City will issue the license certificate. City of Cody Fireworks License/Permit Instructions ---PAGE BREAK--- RENEWAL OF LICENSES: In December of each year, the Administrative Services division will mail out renewal applications for the following license year to all active licensees. Fireworks licenses expire December 31st of each year and the renewal must be complete by that date for license holders to continue to operate. If the renewal process is not completed, the license will expire and may be subject to revocation by the Council. When you receive your renewal application, review the information for accuracy, make any changes necessary, and submit the renewal application and the following required attachments and fees to the Administrative Services Division at City Hall: payment of the $25.00 annual license fee Upon receipt of the renewal application, required attachments, and fees the City will issue the renewal license certificate. If you do not intend to renew your license, sign the non-renewal statement at the bottom of the renewal application and return it to Administrative Services. The license will be inactivated at that time. If you do not renew your license and at a later date decide to operate as a fireworks/pyrotechnic business again you must go through the New License process to obtain another license. ---PAGE BREAK--- Fireworks Permit Who: Anyone Purpose: Authorizes the sale of fireworks and pyrotechnics from Memorial Day weekend through Labor Day in open business/light industrial D-3 districts. Allows for the display of fireworks. Duration: Permit is from Memorial Day Weekend to Labor Day. The permit must be renewed each year. Fee: $25 per year. Once approved, set up the person or business in the Business Licensing module of Caselle if they do not already have an account. 4. Enter the new permit 5. Calculate the billing on the permit 6. Post the payment to the permit 7. Print the permit stamp, sign & make a copy of the permit give the original to the applicant 8. File the application and copy of the permit in central files ---PAGE BREAK--- Chapter 5 FIREWORKS1 5-5-1: SALES, LICENSE AND USE: 5-5-2: PERMIT FOR PUBLIC DISPLAY: 5-5-3: CERTAIN EXCEPTIONS TO CHAPTER: 5-5-1: SALES, LICENSE AND USE: A. Fireworks and pyrotechnics that are permitted by the Wyoming Statutes to be used or sold within the state, can be offered for sale, exposed for sale and sold from the Saturday commencing the Memorial Day weekend through Labor Day in the city in open business/light industrial D-3 districts. The building or structure used for such purposes shall be permanent in nature and fixed to a foundation that is part of the real property and the same shall not contain any goods or merchandise other than fireworks and pyrotechnics. B. Each firework and pyrotechnic business shall obtain a business license as provided for in title 3, chapter 1 of this code, and the annual license fee shall be twenty five dollars ($25.00). C. It shall be unlawful for any person to use, discharge, shoot, fire, light or detonate any firecrackers or other fireworks, or pyrotechnics of any kind whatsoever, excepting caps and cap guns, within the city. Ord. 82-10; Ord. 82-12; Ord. 96-5) 5-5-2: PERMIT FOR PUBLIC DISPLAY: The city council shall have the power to grant permits within the city limits for supervised public displays of fireworks by individuals, the city, amusement parks and other organizations and groups, and to adopt reasonable rules and regulations for the granting of such permits. Every such display shall be handled by a competent operator and shall be of a character and so located, discharged and fired as not to be hazardous to property or to endanger any person. No permit shall be transferable or assignable. (Ord. 79-18) 5-5-3: CERTAIN EXCEPTIONS TO CHAPTER: This chapter shall not be construed to prohibit: A. Any person from offering for sale, exposing for sale, selling or delivering fireworks to the city, any individuals, amusement parks and other organizations and groups holding a permit issued for a public display as herein provided; B. Any person from using or exploding fireworks in accordance with the provisions of any permit issued as herein provided, or as part of a supervised public display; C. Any person from offering for sale, exposing for sale or selling any fireworks which are to be and are shipped directly out of the state; or D. Any person from offering for sale, exposing for sale, selling, using or exploding blank cartridges for theatrical, ceremonial or historical purposes, or in organized athletic or sporting events.
