CLAY COUNTY, MINNESOTA ORDINANCE NO. 2072-5 AN ORDINANCE OF THE COL'NTY OF CI.AY, MINNESOTA REPEALING, READ OPTING AND RE-ESTABLISHING A FUNCIT ONAL CI-{'SSIFCATION NETWORK WITHIN THE COIJNTY COMPREHENSTVE PLAN WHEREAS, the County of Clay, Minnesota ("Counry') is a satutory County duly organized aod existing under Artide XII of the Minnesota Constitution; and WHEREAS, pursuant to Minnesota Statute Chapte r 394 zLnd specifically 5394.21,the County has the power and authority to conduct and implement planning activities; WHEREAS, the Couoty has, by ordinance, and pursuant to Minnesota Starute Chapter 394'23,adopted the Clay County Comprehensive Plan fluly, 2002); VHEREAS, the County has the ability to amend the Comprehensive PIan Pursuant to Minoesota Statute 5394'30 following completion of nodce and publication protocols as set forth within Minnesota Statute S375'51; WHEREAS, the County has undertaken a process to esablish and draft DeveloPment Code provisions related to access control and access management, consistent with authority granted uoder Minnesota Statutes 5160'08; afld to firther amend and repeal certain sections of the Development Code to eosure continuity and consistency with aforementioned access control/management provisions; and VHEREAS, the aforementioned access control afld access managemert standards specifically reference functional classification maps within the Couoty Comprehensive Plan which have been updated as part of this Process to accurately reflect the intent of the County and appropriately coordinate with the access conttol and access management standards; and \FHEREAS, the County, in cooperation with the Fatgo-Moorhead Metropolitan Council of Govemments ('Metro COG,), has conducted a public headng pet Minnesoa Satute $375.51 on the proposed Comprehensive PIao amendment on December 27,h,2lll,thereby allowing a]l interested parties an oppornrnity to teview, comment and ptovide feedback regatding the proposed amendmenu and VHEREAS, the County hereby finds aad deternines that the proposed Comprehensive Plan amendment is approptiate and necessary to the function and efficient operation of the County and to enswe the health, safety, morals, ard general welfare of the CountY. NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF THE COUNTY OF CLAY' MINNESOTA HEREBY ORDAINS AS FOLLOWS: Section 1. AdoPt the updated bxrsung t'uncuonat lctwur Countv Comprehensive plan. to be teferenced as Map 2.18. The County hereby adopts the proposed amendment, attached consistent with Mifflesota Statute $375.51' ADOPTED BYTHE CLq.Y COUNTY GRANT WEYIIND, CHAIRMAN, CIAY COUNTY BOARD OF COMMISSIONERS 2 a hereto and incorporated herein as Exhibit A' Section 2. Severability. If aoy portion of this Ordinance is found to be void or ineffective, it shall be deemed severed from this Ordinance and the remaining provisions shall remain valid aod in fi:Il fotce and effect' Section 3. Effective Date.
