ORDINANCE NO. 2006-3 AN ORDINANCE AMENDING THE CLAY COUNTY LAND DEVELOPMENT ORDINANCE: ZONING & SUBDIVISION REGULATIONS RECITALS WHEREAS, the Clay County Planning and Zoning Office received a request for a text amendment of the Clay County Land Development ordinance: Zoning and Subdivision Regulations requesting the zoning provisions be amended to allow daycare as a conditional home occupation in an accessory structure in excess of the square footage currently allowed under the Ordinance; WHEREAS, the Clay County Planning Commission set a hearing relative to this issue, and following the close of that hearing made a recommendation to the County Board of Commissioners that the Ordinance be amended to allow for said use; and; WHEREAS, rural daycare is something the Board wants to encourage in order to make certain this service is available to the rural families in Clay County. NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF THE COUNTY OF CLAY, MINNESOTA HEREBY ORDAINS AS FOLLOWS: 1. Change the wording of Section 8-6-5A that currently states “Day care shall not be allowed as a conditional home occupation.” to text stating: “Day care may be allowed as a conditional home occupation.” 2. In Section 8-3-9, Home Occupations, Standards for Approval, change all occurrences of the wording “nonresidential structure(s)” to instead read “accessory structure(s)” IT IS HEREBY ORDAINED THAT the foregoing revisions be made to the Clay County Land Development Ordinance: Zoning and Subdivision Regulations.
