VILLAGE BOARD MEETING FEBRUARY 23, 2015 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Gary Fickeisen, Anthony Peppe, Nancy McGuerty and Chris Fulton were in attendance. Village Clerk Anne Riddell was absent so Treasurer Susan Wade served as Acting Village Clerk. Also in attendance were Carol Wood and Mark Manzari of NYLD Nfrastructure. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. Carol Wood stated that she was there for the Local Law Public Hearing. · PUBLIC HEARING – LOCAL LAW #1 OF 2015 – PEDDLING AND SOLICITING Mayor Mulvaney opened the Public Hearing on proposed Local Law #1 of 2015 entitled Peddling and Soliciting with a motion from Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote. · MINUTES A motion was made by Trustee Fickeisen, seconded by Peppe and carried with a 4-0 vote to approve the minutes for the February 9, 2015 Village Board Meeting. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills. · TRANSFER A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the transfer of $ 14,000.00 from F9901.9 to F8310.4 to pay for Engineering. · DEPARTMENT REPORT A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Police Report for the month of January 2015. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for January 2015. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no update on the Glenside Water/Sewer District Agreements. · PLANNING BOARD AND ZONING BOARD MEMBERS Mayor Mulvaney stated that more members were still needed for the Planning Board and the Zoning Board. · NEW METER REPLACEMENT ---PAGE BREAK--- Mayor Mulvaney informed the Board of two recent water meter replacements that were questioned at the last meeting. · VILLAGE ORDINANCES Since the public hearing on Peddling and Soliciting was being held at this meeting, the Mayor wanted to wait for the return of Clerk Riddell before continuing with updating ordinances to local laws. · NORTH MAIN STREET WATER MAIN PROJECT Mayor Mulvaney introduced Mark Manzari of NYLD Nfrastructure to the Board. Mark explained what his company could do for the Village of Moravia for infrastructure data collection. Mark gave a very informative presentation on locating underground water mains, leak detection and mapping. Mark will meet with Mike Perkins to gather more information about the Village water lines before giving the Village a proposal for their services, which will include leak detection, water main mapping and storm sewer location. · GARBAGE, RUBBISH AND RECYCLING REMOVAL The Board had a few changes to the Garbage, Rubbish and Recycling Removal bid specifications. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to put the Garbage, Rubbish and Recycling Removal Contract for out for Bid. The bids will be advertised and opened on Friday, March 20, 2015 at 3:00pm. · SEWER REDUCTION REQUEST (SOVOCOOL) Per Board request, Robert Sovocool supplied a letter stating that he has fixed the hot water heater leak at 11 East Cayuga Street in order to have his sewer bill reduced. A motion from Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to average the sewer bill for Mr. Sovocool. · COURT CASE (SOVOCOOL- UNREGISTERED MOTOR VEHICLE) Judge Shepardson copied the Village Board on a letter written to CEO Delaney informing him the case against Robert Sovocool would be a bench trial scheduled for March 24th. Attorney Marangola also copied the Village on a letter to Judge Shepardson asking for an adjournment of this matter as the Code Enforcement Officer will be out of town until April. There is no response to this request to date. · 2015-2016 VILLAGE TAX ROLL A motion by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to adopt the Village Tax Roll for 2015/2016 with a total taxable assessment of $ 49,594,643. · APPOINT SUBSTITUTE CODE ENFORCEMENT OFFICER A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to appoint Rick Fritz as substitute Code Enforcement Officer in the absence of Fred Delaney. · HIRE SUBSTITUTE PART-TIME SCHOOL CROSSING GUARD (MITCHELL) ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to hire Shawn Mitchell as a substitute part-time school crossing guard effective immediately. · SEWER UNIT REDUCTION REQUEST (MANNING) A letter was received from James and Jane Manning at 26 East Cayuga Street requesting a sewer unit reduction from 2 to 1 unit as it is now a single family home. A motion was made by Trustee McGuerty, and seconded by Trustee Peppe and carried with a vote of 4-0 to reduce the sewer unit charge for James Manning from 2 to 1 unit. · PERMISSION FOR MIKE AND BILLY TO ATTEND 2/27/15 WORKSHOP A motion was made by Trustee Fickeisen, and seconded by Trustee McGuerty and carried with a vote of 4-0 to allow Mike Perkins and Billy Smith to attend the 2/27/15 Winter Workshop in Cortland. · PERMISSION FOR SEAN COCHRAN TO ATTEND CLASSES A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to send Sean Cochran to the Activated Sludge Wastewater Treatment Process course in Morrisville on June 22-25, 2015 for the cost of $ 525.00. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to allow Sean Cochran to attend the April 24, 2015 Confined Space & Competent Person Training in Cortland for $100.00. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: - LETTER FROM VILLAGE TO PROPERTY OWNER (SNOW REMOVAL) - SNOW REMOVAL LETTERS FROM VILLAGE TO PROPERTY OWNERS - 2 - SUPREME COURT OF NY (CAYUGA COUNTY) VS. PERRY (ON TABLE) - CARD FROM VILLAGE RESIDENT TO VILLAGE (ON TABLE) - FISCAL STRESS REPORT · CLOSE PUBLIC HEARING A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to close the Public Hearing on Local Law #1 of 2015. · LOCAL LAW #1 OF 2015 – PEDDLING & SOLICITING RESOLUTION A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to adopt the following resolution on Local Law #1 of 2015 entitled Peddling and Soliciting. WHEREAS, a public hearing was duly held on February 23, 2015, by the Village of Moravia, New York, with regard to Local Law No.1 of the Year 2015, a Local Law pertaining to Peddling and Soliciting, NOW, THEREFORE, BE IT RESOLVED BY THE Village Board of the Village of Moravia, New York as follows: ---PAGE BREAK--- The Village Board of the Village of Moravia, New York, hereby adopts Local Law No. 1 of the Year 2015, a Local Law pertaining to Peddling and Soliciting. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Anthony Peppe voting yes Gary Fickeisen voting yes Nancy McGuerty voting yes Christopher Fulton voting yes Dated: February 23, 2015 There being no further business, a motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to adjourn the meeting at 9:00 p.m. Susan B.
