VILLAGE BOARD MEETING FEBRUARY 8, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Code Enforcement Officer Fred Delaney, and Cayuga County Legislator Terry Baxter were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. Legislator Terry Baxter addressed the Board with information he received pertaining to a grant that the Village of Moravia may be interested in. He stated that the application was for $5,000 for adopting a resolution for solar permits and electric vehicle charging supply equipment. Mayor Mulvaney stated that the Village of Moravia Board of Trustees had approved this last year (2015), however the Board had rescinded the motion due to a disclosure form that was not included in the application until after the Board had approved. He continued by stating that the Cayuga County Planning Department could not answer the Village’s questions pertaining to the disclosure so the Board rescinded their approval. Village Clerk Anne Riddell stated that she would give a copy of the disclosure to Legislator Baxter. Legislator Baxter gave a copy of the grant application to Mayor Mulvaney and after some discussion, the Board thanked him for coming. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the January 25, 2016 Village Board Meeting, as amended. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #306 due to conflict of interest.) · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Treasurers Report for the month of January. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Public Works Report for the month of January. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of January. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of January. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of January. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Dog Control Report for the month of January. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Police Report for the month of January. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of January. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of January. Each of the Trustees also received a copy of an email and a diagram from Tim Buhl pertaining to the settling of the floor on the east and west side of the Justice Center Building. Tim Buhl suggested a solution as to how to cosmetically repair the floor. After some discussion, this item was tabled until the next regularly scheduled Board meeting. It was noted that there was no Justice Report for the month of January. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above) and that the meters listed had replaced meters that were broken and one for a new home. · VILLAGE ORDINANCES Each of the Trustees received a copy of the draft law pertaining to “Noise.” Each Trustee also received a copy of a sample law pertaining to exhausts and mufflers as a suggestion to replace #8 of the “Noise” drafted law. After some discussion, the Board agreed to replace #8 of the “Noise” drafted law and replace with the sample law pertaining to exhausts and mufflers. Village Clerk Anne Riddell will make the change and request the Village Attorney to review. This item was tabled until the next regularly scheduled Board meeting. · WATER LEAK DETECTION UPDATE Mayor Mulvaney stated there was no news on the Water Leak Detection. · CABLE AGREEMENT Mayor Mulvaney stated that Village Attorney Charles Marangola was working on the Cable Agreement and that the agreement should be ready for the Board to review at the next regularly scheduled Village Board meeting. · LOCAL LAW #2 OF 2015 DRAFT (ZONING AMENDMENTS) Mayor Mulvaney stated that there was no update from the Planning Board on the Zoning Amendments. · SOLAR (STP) Mayor Mulvaney reported that there was no news on the Solar Grant for the Village’s Sewer Treatment Plant. · OAK HILL GRAVEL PIT ---PAGE BREAK--- Mayor Mulvaney stated that the 90 Decibel Limit signs had arrived, however there was no lettering on the signs. Mayor Mulvaney stated that the sign company is shipping out new ones. · 2016-2017 VILLAGE TAX ROLL A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to adopt the Village Tax Roll for 2016/2017 with a total taxable assessment of $ 49,864,860. · SUBORDINATION AGREEMENT (GIBSON) Each of the Trustees received a copy of a new/revised Subordination Agreement for Daniel and Tracy Gibson. (It was noted that the Village of Moravia would still remain in second place and received approval from Village Attorney Charles Marangola.) A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve and authorize Mayor Mulvaney to sign the Subordination Agreement for Daniel and Tracy Gibson, 15 East Cayuga Street, and to rescind the prior motion made at the Village of Moravia Board of Trustees meeting on January 25, 2016 pertaining to Gibson’s second request of a Subordination Agreement. (It was noted that the second Subordination Agreement was for a lesser secured amount for the new mortgage.) · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: - Thank you letter from the Village to Don (School Crossing Guard). - Town of Moravia Minutes (12/16/15). - Letter from Village Code Enforcement Officer Fred Delaney to a property owner (unsafe building). - Letter to Village Clerk Anne Riddell from Cayuga-Owasco Lakes Historical Society (re: Dry Creek Cemetery ownership). On the table for Board review was: - Vehicle Log Sheets for the month of January. - Wastewater Treatment Plant Inventory List. - Owasco Lake Stakeholders meeting minutes. - Notice of Foreclose/Sale of property in Village. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to adjourn at 8:22 p.m. Anne Riddell, Village Clerk
