TOWN OF STERLING PLANNING BOARD MEETING August 2, 2018 The regular meeting of the Town of Sterling Planning Board was held on Thursday August 2, 2018 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Vernon Bishop ~ Member Paul Kelley ~ Member Scott Crawford ~ Member Excused: Member Sue Allen Also Present: Bill McIntyre, Paul & Shirley Jones, Melinda Barber, Town councilor Joan Kelley, Kimberly Duffy, Jodi Sheldon, Jim & Karen McIntyre. The meeting was called to order at 7:01 pm by Chairman Ouellette. BUSINESS Robert Barber Jr. –Preliminary Review -Minor Subdivision Melinda Barber was present to assist the Board in reviewing the map and SEQR paperwork for a minor subdivision of property on State Route 104A. The map was reviewed against the required elements checklist and was missing adjacent property information across the road; Mrs. Barber stated that she would contact their surveyor for the corrections. The short form EAF for SEQR was also reviewed with two corrections as follows: #1 should be no because this action does not involve the adoption of a law. #9 which should be no for meeting energy code because nothing is being built. The Public Hearing was scheduled for August 14th, an earlier date had been requested by the applicants to assist closing on the sale of the property, Tuesday August 14th meets notification requirements. Bill McIntyre; Paul & Shirley Jones –Preliminary Review –Minor Subdivision: Lot Line Adjustment Bill McIntyre approached the Board with a payment, completed application with SEQR and a survey map to review. The Clerk had received papers from the Town Assessor, Lezli Parsons, that reflected a split of the property into two parcels – original parcel #13.00-1-2.121 had been split where previous property lines had been described by deed into #13.00-1-2.123 and #13.00-1-2.122. The subdivision request before the Board involves a further split of parcel #13.00-1-2.123 by creating a 0.40 acre parcel to be merged with adjacent parcel owned by Mr. Jones. The Board confirmed that the remaining frontage of Mr. McIntyre’s property conforms with the minimum 200 feet of road frontage, a requirement for a legal building lot Mr. McIntyre has offered his neighbors property which would provide additional buffering to their property in exchange for the removal and release of well rights for an unused well located several hundred feet away. The map was reviewed against the required elements checklist and found to be complete; final needs to be added before the Hearing and 5 paper copies with 1 mylar of the map is necessary for the next meeting on September 6, 2018. The short form EAF for SEQR was also reviewed aloud with the following corrections: #3a changed to 3.9 acres. ---PAGE BREAK--- #9 should be no for energy code – not building anything. #11 should be yes for connecting to existing septic. #12b should be yes for archaeological from EAF Mapper. #13a should be yes for wetlands from EAF Mapper. Both wetlands and archaeological affirmatives from EAF Mapper are not significant to this application for change of property lines. Mr. McIntyre supplied a check payment of the subdivision fee to be processed by the Town Clerk and a Public Hearing was scheduled for September 6, 2018. Kimberly Duffy –Preliminary Review – Minor Subdivision Kimberly Duffy supplied a POA for property owner Richard Duffy, and property owner Jodi Sheldon was present at the meeting consenting to the proposed subdivision of property on Old State Road. The subdivision creates a 3.69 acre parcel containing the house, buildings, well and driveway to be retained by Kimberly Duffy. The subdivision map contains notation that the driveway has a 12’ easement to allow access to the remaining 23.18 acres. Discussion at the July meeting determined that the second parcel would not be eligible for a driveway cut because of the hill with reduced sight clearances and the close proximity of the intersection of Green Road. Member Kelley confirmed that the Highway Supervisor would not approve a driveway permit. The map was reviewed against the required elements checklist with the following corrections needed: -add septic location with setback dimension. -total acreage should be 26.87 not 30.81 as on map. -final added to title. The short form EAF for SEQR was reviewed aloud at the July meeting, the Board checked the answers against the EAF Mapper and corrected questions #15 and 16 to be yes because the property is located near a 100 year floodplain and has the potential to contain threatened or endangered species, neither would be affected by the change of property lines this action proposes. The Sterling Creek runs through and along large sections of this property therefore the Mapper results were not surprising to the Board. A Public Hearing was scheduled for September 6, 2018. Jim & Karen McIntyre – Sketch Plan Conference – Minor Subdivision The McIntyre’s approached the Board to begin the subdivision process for their neighbor’s property on Ontario Shores Drive. The applicants would like to merge a 100’ strip of land with their property which would be classified as a Lot Line Adjustment. An overview photo map illustrates that the property to be subdivided has no structures upon it and the new property line would conform to the 20’ side setback in regards to a building on the parent parcel. The Board explained the process and that they would need a notarized letter from the property owners allowing the subdivision. The applicants were given an application with SEQR paperwork to complete and instructed to get a survey map before returning for the preliminary review. LUR Amendment Town Councilor Joan Kelley stated that the Town Board had tabled the discussion on the storage buildings on vacant land amendment because corrective editing was needed. The Planning Board members had received copies of the long form EAF Part 1 ---PAGE BREAK--- that the EAF Mapper had generated for the entirety of Sterling. They proceeded to complete Part 1 in preparation of a submittal package to the Town Board for their processing of Parts 2 and 3. The Clerk will assemble a 239 Review submission package and corrected detail pages; and provide a cohesive package for the Town Board meeting on August 20, 2018. Comprehensive Plan Member Bishop commented on the updated version of Fair Haven’s section of the Comprehensive Plan that the Board members had received last month. He stated that a correction was needed because the Barrier Bar is located on the NW corner not the NE corner of the Village. Councilor Kelley stated that the County Planning office has been assisting with the narrative, she was hoping to have their assistance with Sterling’s update since the County has the template.
