TOWN OF STERLING ZONING BOARD OF APPEALS MEETING TOWN OF STERLING ZONING BOARD OF APPEALS MEETING December 21, 2015 December 21, 2015 A meeting of the Town of Sterling Zoning Board of Appeals was held on Monday December 21, 2015 at the Sterling Town Hall at 7:00 pm with the following members present: Laurence Lemon ~ Chairman Richard Palmieri ~ Member Charles Itzin ~ Member Excused: Members Darrell Uetz and Brad Dates. Also present: Virginia Fichera and Delores Welsh. The meeting was called to order at 7:02 PM by Chairman Larry Lemon. BUSINESS Chairman Lemon explained to the audience that the purpose of the ZBA meeting was for the Board members to discuss the current litigation regarding the Ferlito mining project. A motion was made by Member Itzin to go into Executive Session at 7:07 PM, the motion was seconded by Member Palmieri, all were in favor and the motion carried. A motion was made by Member Itzin to come out of Executive Session at 7:18 PM, the motion was seconded by Member Palmieri, all were in favor and the motion carried. A motion was made by Member Itzin to authorize Town Attorney, Kevin Cox, to represent the Zoning Board of Appeals in all litigation, including currently filed Article 78 Proceeding, in regards to the Ferlito mining project and application. The motion was seconded by Chairman Lemon, all were in favor without further discussion and the motion carried. MINUTES Motion to approve meeting minutes for September 24, 2015 was moved by Member Palmieri and seconded by Member Itzin, all were in favor without further discussion and the motion carried.
