Town Board Meeting January 15, 2018 BOARD MEMBERS PRESENT: ` Supervisor Tarby Councilman Paczkowski Councilman Vitale Councilwoman Banas Councilwoman Young TOWN OFFICIALS PRESENT: Dog Officer John Schillace Zoning Officer Tom Weed Town Clerk Kathy Malenick Minutes Supervisor Tarby called the meeting to order at 6:00 p.m. with the pledge of allegiance A motion to accept the minutes as written for December as accurate and true was made by Councilman Paczkowski. Councilman Vitale seconded the motion. The motion passed unanimously. The following reports were read: The Clerks Report: A motion to accept the clerks report was made by Councilman Vitale. Councilman Paczkowski seconded the motion. The motion passed unanimously Codes and Zoning Public Forum None Public Hearing Regarding Local Law #1 2018 Unsafe Buildings. After reviewing the draft proposed by Town Attorney Chirco; the Board requested a few changes be made to the wording before adopting the law as written. The changes are as follows; #9 Personal Liability; not withstanding any provision herein to the contrary, the Throop Town Board may institute a suite. Suite should be corrected to read suit. Also #11 Emergency Work B; When emergency work is to be performed und. und should be corrected to read under. Attorney Chirco stated he would revise the law written to reflect the changes recommended by the Town Board, and send the final copy once done. Supervisor Tarby requested Attorney Chirco explain in general what the law states, for the people in the audience. ---PAGE BREAK--- Attorney Chirco stated he has been working with the Town to try and find a resolution to the problem of people abandoning buildings that were no longer inhabitable, eventually making them a hazard. This law talks about what the duties of the building inspector are. If they determine the building is unsafe (definition of unsafe is defined in the law) that they (building inspector) must notify the owner of the property to make the repairs. The owner will have 30 days to comply or appeal the decision. If the determination is found to be unsafe, and they don’t fix it, the Town can make the repairs and levy the cost onto the property taxes, along with penalties. Supervisor Tarby made a motion to accept Local Law #1 2018 for unsafe building with corrections to the original to read as listed above. Councilman Vitale seconded the motion. The motion was passed unanimously. Old Business Supervisor Tarby stated he had not heard anything from the County regarding the water discussed at the last meeting. He indicated he would give it another month before reaching out again. Local Law Regarding Solar Energy Attorney Chirco stated he had a preliminary draft drawn up but wasn’t ready for a public hearing. He had some reservations about some of the items the planning board had drawn up. Councilman Paczkowski stated he had reservations about some as well, one being 50% of land can be used for solar. He feels if it alters the character of the area, it should be restricted, however in property that can’t be used for anything else, should be allowed to have more than 50%. Attorney Chirco suggested saying residential areas cannot be used as a solar farm. Lynn Cayward suggested using set back requirements, stating he knows of a person that put the solar panel so close to the neighbor’s house, it melted their siding. Supervisor Tarby suggested a moratorium for Commercial use. Association of Towns Annual Meeting and Training, Councilwoman Young and Attorney Chirco are both going. Supervisor Tarby stated he will register them and send the tax exemption. New Business Supervisor Tarby read the following letter Supervisor Tarby and Town Board Members As we enter our 26th year serving our municipal clients we are respectfully requesting to be reappointed as the Town Engineer for the upcoming 2018 calendar year. We have faithfully served the needs of the community since 2005 and have completed several projects on your behalf. In addition, we are available to provide assistance to the Town Planning Board and Town Sports staff as necessary. We have attached a copy of our 2018 standard hourly rate for general engineering services. Existing capital projects remain at the previously agreed upon rates and fees. We have also provided you with a copy of our updated employee contact list at your convenience we encourage you to look at our website which highlights the wide variety of our experiences and several of our projects completed. Upon your review should you have any questions please don’t hesitate to call. Sincerely Paul Chatfield Supervisor Tarby made a motion to accept Chatfield Engineering as the Town Engineering Firm for 2018. Councilman Vitale seconded the motion. The motion passed unanimously. Councilman Paczkowski made a motion to accept the appointments as read with the exception of Steve Young for Planning Board, Councilman Vitale seconded the motion. The motion passed unanimously. Councilman Paczkowski made a second motion to accept Steve Young to the planning board, Councilman Vitale seconded the motion, the motion passed with Councilwoman Young abstaining for personal reasons. A motion to enter executive session was made by Supervisor Tarby at 6:38 to discuss personnel issues. Councilman Vitale seconded the motion. The Board reconvened at 7:03 p.m. The following bills were reviewed for payment General Fund Vouchers #386-#401 in the amount of $14793.04 were reviewed for payment. Councilman Paczkowski made a motion to pay Vouchers #386-#401 in the amount of $14793.04 Councilman Vitale seconded the motion. The motion passed unanimously. Highway Vouchers #273-#277 in the amount of $6795.75 were reviewed for payment.
