1 Village of Fair Haven Public Hearing and Budget Hearing Board of Trustees Organizational Meeting April 10, 2017 The first hearing began at 6:30 p.m. followed by the Pledge of Allegiance. Board members present Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Judith Dunaway, Trustee Holley Webster- Goolden and Trustee Pete Hanford. Also, present Village Clerk-Treasurer Terri DiGregorio, Deputy Clerk Johanne Van Der Linden. 12 guests present. Public Hearing Local Law No. 2 of the year 2017 A local law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c Section 1. Legislative Intent It is the intent of this local law to allow the Village of Fair Haven to adopt a budget for the fiscal year commencing June 1, 2017 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3. Tax Levy Limit Override The Board of Trustees of the Village of Fair Haven, County of Cayuga, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2017 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4. Severability If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective date This local law shall take effect immediately upon filing with the Secretary of State. Public Hearing on 2017-2018 Budget The 2017-2018 Village of Fair Haven budget is prepared and ready for adoption. The tax rate will be $3.676266 per 1000 to raise $368,075.00. Last year’s tax rate was $3.676264. The Village assessment is $100,122,068.00, up by $7,927,939.00 from last year. Total budget is $1,288,590.00, an increase of $59,725.00 from last year. Village Accountant Kevin Clark of Clark CPA, PC has reviewed tentative budget. Organizational Meeting: COMMUNICATIONS: • The next Cayuga County Association of Villages (CCAV) meeting is scheduled for April 25th 7pm, Sunset Restaurant, hosted by Moravia (RSVP 4/18). The February 28th CCAV minutes were reviewed. • The Village of Fair Haven will host the June CCAV meeting on June 20th at the Fair Haven Beach State Park. A speaker is currently being sought and the Corner Stone will cater the event. This is also the employee picnic and the volunteer boards are also invited. • NYS Archives Regional Advisory Officer Maria McCashion will be inspecting the records storage area on April 19th 10:00am regarding a grant for storage of records. • Quotes have been sought from shredding companies regarding destruction of inactive records. • The 2016 Annual Quality Water Report has been prepared and will be distributed to water customers. • The Village newsletter has been updated and will be reviewed by the Board of Trustees for distribution to village residents. ---PAGE BREAK--- 2 PUBLIC FORUM: • Chris Drogi inquired about the time frame of the installation of his 1 ½” water line to be installed at the laundromat. Mayor Basile responded this task will be added to the DPW activity list. He also asked the Board of Trustees to check into changing the speed limit on Main St. (State Route 104A) regarding the 40mph section. The Board will check with the NYSDOT as most speed limits entering villages go from 55mph to 30mph. • Charlie Gerberich, representing the community development committee, inquired about the process of revising the zoning relative to halting the establishment of box stores and working with the Planning Board. They will be attending the Planning Board meeting on April 20th. David added consideration for a minimum house size should be added to the Village zoning. • Susan Gately stated she had looked at the location for the community garden and submitted a drawing of the proposed garden. She stated the group was making preparations to get started. John Pupparo inquired about composting around the garden. • Frank Perkins thanked the Board of Trustees for supporting the Sterling Silver Seniors bus trips and submitted the schedule of trips. MINUTES: • The March 9th, 13th and 22nd meeting minutes were accepted on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. ABSTRACT #11 VOUCHERS: The following were approved for payment on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. • General Fund: $23,712.90 • Water Fund: $2,284.54 • Trust & Agency: $3,469.64 • March Payroll: $51,584.54 Budget Modifications: The following budget modifications were approved on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. Transfer $3,737.05 from Refunds of Prior Years Expenditures to Parks Personal Services Transfer $300.55 from Medical Insurance to Records Management Contractual COMMITTEE REPORTS: • March DPW report submitted by Roger Granatiero. Checked Pump House daily; Took water samples to Lab in Auburn; Meter Replacements; Washed trucks and equipment weekly; Worked on plow damage; Cleaned drains; Painted plows and snow blower; Installed driveway culvert on Cayuga St. for Wildwood Campgrounds; Chipped remaining brush piles on West Barrier Bar. Mayor Basile added the DPW will begin keeping an activity list of projects. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. • Treasurer’s report submitted by Terri DiGregorio for period ending 3/31/2017. General fund balance $427,154.99 which includes WBB $4,233.42, Water fund $116,414.12, Trust & Agency $891.67, New York Main Street and Community Development Block Grant $1.00. The report was accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden. All aye, motion carried. • March Ambulance report submitted by Stan The ambulance service answered 37 calls; 7 BLS, 22 ALS, 6 no transport; 2 cancelled calls. Total calls to date 102. Of these 37 calls, 9 in the Village, 17 in the Town of Sterling, 2 in Martville, 9 mutual aid to Lakeshore Ambulance; 1 mutual aid to CIMVAC. Vehicles responding to calls: 3 for Ambulance 28 for Ambulance 6 for Medic Car, 5 for both the medic car and ambulance together. The response time was 3.41 minutes. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried • March Code Enforcement report submitted by Stan 3 building permits issued; 13 violations issued; 1 stop work order issued for working without a permit; 3 violations corrected; 21 on-site inspections conducted; 4 general village wide inspections conducted. The report was accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. UNFINISHED BUSINESS: • The revisions to the Vehicles & Traffic Article IV Parking Prohibitions and Sewer law regarding 100 feet are still on hold pending the hiring of a new village attorney. • Community garden plans and layout have been submitted. Eastern Shore Associates approved the waiver form for garden participants. ---PAGE BREAK--- 3 • The Community Development Committee will meet with the Planning Board on April 20th regarding a moratorium in the central business district. • A meeting regarding establishment of a historic district in Fair Haven has been cancelled. Stephan House had originally approached Mayor Basile on this matter. • The Planning Board will be updating the Comprehensive Plan. • The Mayor is proposing offering comp time instead of paying hourly village employees overtime which would save the Village money. The Trustees are in the process of reviewing this option. NEW BUSINESS: • The Village of Fair Haven was awarded a $1,000.00 grant through the New York State Urban Forestry Council to plant trees. This grant will pay to replace the diseased trees on Main Street. • The new slate of elected Fair Haven Fire Department Chiefs was approved on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. • The Board of Trustees is in the process of conducting interviews to hire a new Village Attorney. • The Emergency Preparedness Plan will be reviewed by the Board of Trustees as it should be updated annually. Contact numbers and names were recently updated. • An application for new water service for a second residence at 14504 Fancher Ave. was submitted by Brandon Furber. The variance to split the property to build a second residence was denied, therefore the water application was denied. • The Village of Fair Haven has a proposed Home Rule Bill before the New York State Senate & Assembly to amend the public officers law, in relation to residency requirements for the position of Clerk-Treasurer and Deputy Clerk-Treasurer. The passage of this bill would allow the Clerk- Treasurer and/or Deputy Clerk-Treasurer to reside in a neighboring county and allow a for a diverse selection of candidates for future hire. • An application for water service by Gerber Homes for a proposed house at 14901 West Bay Rd. was approved on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. • The request to waive the late fee of $18.38 for water account #B1070 due to confusion regarding the water customer paying the bill electronically, was approved on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. A letter will be sent to the water customer explaining to allow at least 5 business days for the payment to reach the village office when using an outside electronic service to pay the water bill. • Arrangements will be made to have additional lines painted on the tennis courts for pickleball. The company who last painted the tennis court will hired to perform this. A new basketball fixture will be added to the end of the tennis court area replacing the existing basketball hoop. Deputy Mayor Krehling will spearhead this project. • Mayor Basile, Clerk-Treasurer DiGregorio and Deputy Clerk Van Der Linden will be attending NYCOM Fall School September 11th -15th. The village office will be closed that week and the board meeting will be on the following Monday September 18th. APPOINTMENTS & ANNOUNCEMENTS: • Darrell Uetz and Larry Cosser were reappointed to the Planning Board. Debra Rose and Catherine Byers were appointed as new members. These appointments were made on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried. • The Zoning Board of Appeals appointment for a new member was postponed until the next meeting to fill the vacancy created by Jimmy Kawar. • Sharon Basile was reappointed as an alternate Zoning Board of Appeals member on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. • Mayor Basile appointed Walter Krehling as Deputy Mayor on a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden. All aye, motion carried. • The village attorney will be appointed at a future meeting. The following appointments were made on a motion by Trustee Dunaway and seconded by Trustee Hanford. All aye, motion carried. • Johanne Van Der Linden was appointed Deputy Clerk. • Terri DiGregorio was appointed Registrar of Vital Statistics. • Johanne Van Der Linden was appointed Deputy Registrar of Vital Statistics. • The official newspaper is the Lakeshore News. • The official banks are Savannah & Chase Bank. • The official accountant is Clark CPA, P.C. • Board of Trustees meetings are held on the 2nd Monday of the month at 7:00 p.m. • Board of Trustees agenda meetings are held on the Thursday before the 2nd Monday of the month at 6:30 p.m. • Planning Board meetings are held quarterly at 7:00 p.m. and as needed ---PAGE BREAK--- 4 • Zoning Board of Appeals meets as needed Resolution for Advance Approval of Claims WHEREAS the board of trustees has determined to authorize payment in advance of audit of claims for public utility services, postage, freight and express charges; and WHEREAS all such claims must be presented at the next regular meeting for audit; and WHEREAS the claimant and the officer incurring or approving the claim are jointly and severally liable for any amount the board of trustees disallows. NOW THEREFORE BE IT RESOLVED that the Board of Trustees authorizes the Village Clerk- Treasurer to make payment in advance of audit of claims for public utility service, postage, freight and express charges on a motion by Trustee Webster-Goolden and a second by Trustee Dunaway. All aye, motion carried. Resolution for Mileage Allowance WHEREAS the board of trustees has determined to use the same rate for mileage as the IRS establishes, which is 53.5¢ cents per mile as of January 1, 2017 and will update accordingly for reimbursement to Village officers and employees who use their personal automobiles while performing their official Village duties; NOW THEREFORE BE IT RESOLVED that the Board of Trustees has determined to use the same rate for mileage as the IRS establishes effective immediately upon a motion by Trustee Hanford and a second by Deputy Mayor Krehling. Resolution for Attendance at Schools and Conferences WHEREAS there is to be held during the coming official year a) the New York State Conference of Mayors Annual Meeting and Training School; b) the New York State Conference of Mayors Fall Training School for City & Village Officials; c) the New York State Conference of Mayors Public Works School; d) Municipal Clerks Institute; e) County Association Meetings; etc.: and WHEREAS attendance by certain municipal officials and employees at one or more of these meetings, conferences or schools benefits the municipality; NOW THEREFORE BE IT RESOLVED that the Board of Trustees authorizes designated employees to attend training effective immediately upon a motion by Trustee Webster-Goolden and a second by Trustee Dunaway.
