Town of Sennett Board Meeting May 15, 2018 Minutes of the Town of Sennett Town Board Meeting held on Tuesday May 15, 2018 at 7:00 PM at the Sennett Town Office Building. Members Present: Peter Adams, Supervisor Jerrold Eades, Councilman Edward Rizzo, Councilman James Jeffers, Councilman Richard Gagliardi, Councilman Kristopher LaPointe, Highway Superintendent Ron Schalck, Water & Wastewater Superintendent Richard Andino, Attorney Penelope Dennis, Town Clerk Meeting is opened with the pledge to the flag. The minutes of the previous meetings are approved on a motion made by Councilman Jeffers, seconded by councilman Gagliardi, 5 ayes 0 nays, carried. Financials: The AUD is almost completed. Also, new reports will be available soon showing year to date numbers and past two-year numbers. Old Business: Former Assessor Fred Farrell has resigned, and Jeff Lowe has been appointed Assessor. He started May 9th , and he has been/will be sitting with the tentative assessment roll for anyone with questions, etc. to review. The Weedsport water contract has been signed by all involved parties and is on file. The ‘In Memory Plaque’ has been installed. Some plants need to be replaced at the park. There are questions as to the rental of the facilities, at this time no, regulations may be drawn up in the future. It is open for residents and has been used a lot. Senator DeFrancisco may have funding (Capital Investment) available that the town could possibly use for the park. A letter would need to be sent to his office with a request. A light will be installed near the road with a conduit to be run to the pavilion and garden. There is an appeal pending in the dog control case. There is discussion on the remainder of the windows to be installed with different possible options. New Business: East Side Heights PDD – the Vitale’s would like to give prospective homeowners the option of building a duplex or a single-family home. The Town Board will review this request and respond to the Vitales. The Attorney will also check into the options/steps to take. The Cayuga County sales tax revenue has decreased by 12% from last year. The board recently held a water workshop meeting with Engineer Paul Chatfield and LaBella Associates. They discussed infrastructure repairs to WD#3. This project would also include a new water tower which will help, backflow will be ---PAGE BREAK--- available to approximately the city line and will offer benefits to all. Various options for financing where also discussed. Options for help in getting the grants is also discussed. A motion is made by Councilman Eades for the Supervisor to sign agreements with the Engineer and LaBella conditioned upon the review and approval of Attorney Andino, seconded by Councilman Jeffers. Roll Call vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers yes and Supervisor Adams abstains, carried. A motion is made by Councilman Jeffers to have Supervisor Adams sign the agreement with LaBella Associates for $ !,800.00 for the WD#3 project, seconded by Councilman Rizzo. Roll Call vote: Councilman Eades abstains, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers yes and Supervisor Adams abstains, carried. It is suggested to meet weekly to get everything done in a timely manner. Attorney Andino mentions other items that will need to be addressed also in a timely manner. May 29th is Grievance Day from 4:00 PM to 8:00 PM with other times to review assessments. Department Reports: Highway superintendent LaPointe reports that we filled nine dumpsters at the May Dumpster Days, with two being full of steel. Thank you to the department for their work on this project. Grinding of the brush began today, the department has sanded a few times, cleaning ditches and repairing, working on trucks, helping other towns with paving, brush pickup, removed a tree, and mowing. Also, stakes were installed in place for the porta john at the park. Water & Wastewater Superintendent Schalck reports: the AWQR is finished and awaiting approval, water operation reports were done and given to DOH, water samples were done, spring flushing of mains was completed, we have been locating and marking of curb stops, I have done some leak detection in WD#2, marking out digs request, weekly checks of sewer meters and pump stations, repairing yards where we had dug water leaks, Gartner Equipment replaced a leaking seal on pump at Franklin St water pump station, Judge Timian reports $4,376.00 for April. Judge Riley reports $2,513.00 for April. The Town Clerk reports $1,257.50 for April. The ZBA reports nothing for May maybe in June. The Court Clerk’s report is read and reviewed by the board. The CEO’s report is read and reviewed by the board. Jerry VeVone is present and updates the board on upcoming items/projects. Also, he and Tom Passarello will meet with the Assessor to verify building permits. There is further discussion on the steps for the issuance of a Special Use Permit (the board has received comments from both the attorneys for the ZBA and the Planning Board. As was previously discussed the applicants will first go to the ZBA and then to the Planning Board. Attorney Andino reports that the proposed Parking Local Law is being further reviewed by the Highway Superintendent and will be discussed at the June meeting. The Public To Be Heard segment is opened on a motion made by Councilman Jeffers, seconded by Councilman Eades, 5 ayes 0 nays, carried. Ed Magdziak, Beech Road, questions a letter that was sent to the CEO March 16, 2016 regarding violations to § ---PAGE BREAK--- 905 and § 504. He would like a resolution to this by the next meeting. Jerry VeVone responds that Mr. Magdziak had sixty (60) days from March 16, 2016 to appeal the CEO’s decision. Councilman Jeffers questions how is it determined if it is a “home occupation”? Mr. VeVone answers that the DBA is filed with a Skaneateles address – not Beech Road. There are comments/discussion between Mr. VeVone and Mr. Magdziak. Mr. Magdziak is asked not to make comments and is then asked to leave the meeting by Councilman Jeffers. Councilman Eades asks for a moment of silence in memory of Merritt Fletcher, brother of Planning Board member Glenn Fletcher A motion is made to close The Public to Be Heard by Councilman Jeffers, seconded by Councilman Eades, 5 ayes 0 nays, carried. The abstract in the amount of $625,125.44 is approved for payment on a motion made by Councilman Eades, seconded by Councilman Jeffers. Roll Call vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers yes and Supervisor Adams yes, carried. Communications: It is mentioned that some residents did not receive the newsletter.
