VILLAGE BOARD MEETING AUGUST 13, 2018 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Gary Fickeisen, Chris Fulton, Nancy McGuerty, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Officer in Charge Rob Brown, and Judge June Shepardson were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. (Mayor Mulvaney noted that Judge Shepardson was on the agenda and could address any of her concerns then.) · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the July 23, 2018 Village Board Meeting, as amended. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #83 due to conflict of interest.) · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Treasurer’s Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Public Works Report for the month of July. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of July. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Fuller Park Inspection Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of July. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Dog Control Report for the month of July. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Report for the month of July. Mayor Mulvaney thanked the Moravia Police Department from the Village of Moravia and the Moravia Fair Association for the police coverage during the VFW-MFD Fair. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Code Enforcement Report for the month of July. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Reports for the month of July. Judge Shepardson expressed her concern that the Cayuga County Board of Elections is using the Village Justice Center for elections and primaries. She reminded the Board that the elections and primaries are held on a Tuesday (Village Court night) and sometimes on a Thursday (Town Court night). She continued stating that when this happens, the Courts need to cancel court night and it creates a problem when tickets are being written for the nights that Court is cancelled, which sometimes happens. After some discussion, Mayor Mulvaney stated that he would talk with the Town of Moravia to see if the elections/primaries could be held at the Town Hall and if they could, a letter would be sent to the Cayuga County Board of Elections notifying them. (The letter will be copied to Judge Shepardson.) A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of July. · PURCHASE ORDER A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve a Purchase Order for $1,387.33 to Alfa Laval for the Sewer Treatment Plant for parts to repair the press. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Trustee McGuerty stated that they are scheduled to meet again on September 18, 2018. This item was tabled until the next regularly scheduled Board meeting. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Mayor Mulvaney stated that the Village of Moravia Planning Board had the drafted local law pertaining to chickens and livestock for their review and that the Village Attorney and Planning Board Chairperson were to meet to discuss further. This item was tabled until the next regularly scheduled Board meeting. · SEWER BREAKS & FLOODING Each of the Trustees received a copy of an estimate from National Water Main Cleaning to clean and televise the drain/culvert pipe on North Main Street. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the estimate of $7,200.00 from National Water Main Cleaning to clean and televise the drain/culvert pipe on North Main Street and have them also look at Congress Street. · VILLAGE’S WATER/SEWER SYNOPSIS 2017 Mayor Mulvaney reported that a leak on North Main Street had been repaired and the ones on Adams Street and on Skinner Hill were to be repaired as soon as possible. This item was tabled until the next regularly scheduled Board meeting. ---PAGE BREAK--- · MRB GROUP (SEWER USE LAW) After some discussion, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to amend the previously adopted motion made at the Village of Moravia Board of Trustees regularly scheduled meeting held on July 9, 2018 to approve MRB Group’s Sewer Use Law Update proposal for $9,800.00 and the Wastewater Treatment Plant SPDES Permit Pretreatment Compliance Assistance for $10,000.00 subject to the approval of Village Attorney Charles Marangola for funding to approving and authorizing Mayor Mulvaney to sign the two proposals. (The Village discovered that the Sewer Repair Reserve Fund could not be used for these two proposals. It was decided that the cost of the two proposals will be used from the current budget.) · VILLAGE ATTORNEY ANNUAL AGREEMENT (LETTER OF ENGAGEMENT) Each of the Trustees received a copy of the 2018-2019 Village Attorney Charles Marangola’s Letter of Engagement in the amount of $6,250.00 per year to be paid quarterly. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve and authorize Mayor Mulvaney to sign the Letter of Engagement from Village Attorney Charles Marangola for 2018-2019. · FALL CLEAN-UP A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to have Fall Clean-Up days scheduled for October 6th & 7th, 2018. It was noted that no electronics would be collected for this Fall Clean-Up. · PLANNING BOARD MEMBER RESIGNATION (BULMER) Each of the Trustees received a copy of a letter of resignation from Planning Board member Randy Bulmer. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the letter of resignation from Planning Board member Randy Bulmer dated July 18, 2018. (The Board directed the Village Clerk to send a thank you letter for his years of service to the community.) · PLANNING BOARD APPLICATION (CLARK) Each of the Trustees received a copy of a Planning Board application from Joshua Clark. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to accept the application from Joshua Clark and appoint him to the Planning Board. · NEW VISIONS APPLICATION FOR PERMIT Each of the Trustees received a copy of an Application for Permit from New Visions Communications. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve and authorize Mayor Mulvaney to sign the Application for Permit for New Visions Communications to install fiber optic cable in the Village of Moravia. (It was noted that this was reviewed by the Attorney and the Village’s Insurance Agent.) · REMOVAL OF EMPLOYMENT (BOWEN, FRIEND) ---PAGE BREAK--- A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to remove Adreian Bowen (School Crossing Guard Part-Time) and Trent Friend (Laborer) from the Village’s payroll, effective August 13, 2018. It was noted that Bowen and Friend had not worked for the Village for several years. · CREATE NEW POSITION (FULL-TIME POLICE OFFICER) After some discussion, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to create a new position of Full-Time Police Officer effective August 13, 2018. · VILLAGE JUSTICE REQUEST (NYSMA CONFERENCE) Each of the Trustees received a copy of a letter from Judge June Shepardson requesting to attend a conference and to split the cost with the Town of Moravia. After some discussion and input from Judge Shepardson, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to authorize Judge June Shepardson to attend the Conference of the New York State Magistrates Association from September 23-26, 2018 in Niagara Falls, New York and to split the cost of the conference with the Town of Moravia. · ZONING BOARD APPLICATION (TOWNSEND) Each of the Trustees received a copy of a Zoning Board application and a Planning Board application from Thomas Townsend. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to accept the application from Thomas Townsend and appoint him to the Zoning Board of Appeals. · INFORMATIONAL ITEMS Mayor Mulvaney discussed a request from Family Health Network of Central New York, Inc. applying for a grant. He stated that they needed a location in the Village to set up a small space for people to enroll or renew their health insurance. Mayor Mulvaney reiterated that the village Office would be a potential second location to be listed in the grant. (The grant is not to be awarded until spring 2019.) Mayor Mulvaney stated that he requested a letter be sent to the Village about this item. On the table for Board review was: - Vehicle Log Sheets for the month of July. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to enter Executive Session at 8:17 p.m. to discuss contract negotiation.
