VILLAGE BOARD MEETING JUNE 25, 2018 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell and Treasurer Susan Wade, Sean Cochran (WWTP) and Bill Davis (MRB Group) were also present. · PUBLIC Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the June 11, 2018 Village Board meeting, as amended. · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Voucher #19 due to conflict of interest.) · TRANSFER & BUDGET MODIFICATION A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following transfer. From: Sewer Repair Reserve $ 6,428.00 To: Sewer Fund Checking Account And then corresponding Budget Modification to increase appropriation. Budget Modification: G511 Approp. Reserves $ 6,428.00 G8130.4 Treat. & Disp. $ 6,428.00 · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Trustee McGuerty stated that she and Trustee Fulton had met with Town Councilman Joe Gentilcore to discuss the Glenside Water/Sewer District Agreements. They are scheduled to meet again on July 10, 2018 at 2:00 p.m. at the Village Office. This item was tabled until the next regularly scheduled Board meeting. · NEW METER REPLACEMENT Mayor Mulvaney stated that there was no update on new water meter installations. · VILLAGE ORDINANCES Mayor Mulvaney stated that Village Attorney Charles Marangola reported that the drafted Chicken and Livestock law should be an amendment to the Village of Moravia’s Zoning Law. Therefore, this needs to go to the Village of Moravia Planning Board for their review. This item was tabled until the next regularly scheduled Board meeting. · SEWER BREAKS AND FLOODING ---PAGE BREAK--- Mayor Mulvaney reported that the paving (driveways and Adams Street) and reseeding of the lawns were to be completed for the South Main Street sewer line project. This item was tabled until the next regularly scheduled Board meeting. · VILLAGE’S WATER/SEWER SYNOPSIS 2017 Mayor Mulvaney reported that there was no news on the Village’s Water/Sewer Synopsis 2017. · MRB GROUP (SEWER USE LAW UPDATE) Bill Davis from MRB Group addressed the Board pertaining to the need in updating the Sewer Use Law (refer to proposal dated May 25, 2018) and to enact a Pretreatment Program (refer to proposal dated April 9, 2018) per the direction of the NYSDEC. Mr. Davis also discussed an available NYSDEC Water Infrastructure Engineer Planning Grant to conduct a study of the Village’s Wastewater Treatment Plant that was available. He explained that the grant writing fee would be $1,000-2,000. He also explained that the maximum award was $30,000 with a $6,000 Village match (which could be “in-kind”). After some discussion, a motion was by Trustee Peppe, seconded by Trustee McGuerty and carried with a 5-0 vote to adopt the following resolution: WHEREAS, the Moravia Board, Village of Moravia, Cayuga County, supports the submission of a Consolidated Funding Application (CFA) on behalf of the Village, for the Water Infrastructure Engineering Planning Grant (EPG) program to conduct a study of physical infrastructure improvements needed at the Village’s Wastewater Treatment Plant (WWTP); and WHEREAS, the New York State Department of Environmental Conservation (DEC), in conjunction with the New York State Environmental Facilities Corporation (EFC), provides a competitive statewide reimbursement grant program to assist in the initial planning of eligible Clean Water State Revolving Fund water quality projects; and WHEREAS, the Village of Moravia meets EPG eligibility criteria, based on a DEC annual inspection rating of “marginal” along with recommendations to address a number of WWTP infrastructure improvements issues; and WHEREAS, if funding is received it will allow the Village of Moravia to prepare an engineering report for WWTP infrastructure improvements, enabling them to seek financial assistance for construction through the program to advance the needed water quality improvements; NOW THEREFORE BE IT RESOLVED, the Village Board, on behalf of the Village, identifies Mayor Gary D. Mulvaney as the authorized representative for the project, able to execute necessary documents relative to and as required for the CFA; and BE IT FURTHER RESOLVED, that the Moravia Village Board, on behalf of the Village, recognizes and fully supports the submission of the CFA for an EPG for infrastructure improvements at the WWTP. The question of the adoption of the foregoing Resolution was duly put to a vote on roll call, which resulted as follows: Mayor Gary Mulvaney Voting YES Trustee Nancy McGuerty Voting YES Trustee Anthony Peppe Voting YES ---PAGE BREAK--- Trustee Gary Fickeisen Voting YES Trustee Chris Fulton Voting YES (Bill Davis (MRB Group) and Sean Cochran (WWTP) exited at 7:49 p.m.) · DAVIS-ULMER AGREEMENT (JUSTICE CENTER SPRINKLER SYSTEM) Each of the Trustees received a copy of the Davis-Ulmer Agreement for the Justice Center’s sprinkler system. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to authorize Mayor Mulvaney to sign the three year Davis-Ulmer Renewal Agreement for the sprinkler inspections at the Justice Center with the deletion of #8 and #9 and change the 5% increase per year to 2% increase per year #15. · WATER ACCOUNT BALANCE (#50861) Treasurer Susan Wade explained to the Board pertaining to a property on Skinner Hill Road that was a two family home (2 meters) and was now a one family home. She stated that the meter was removed, however the charge of $45.00 (plus a late fee of $4.50) was inadvertently charged over a year ago. The prior balance on the account was paid in full ($523.64) by the bank. Treasurer Susan Wade requested the Board remove the meter charge because the meter is gone and a bill is no longer generated. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to remove the balance of $49.50 from water account #50861. · EMPLOYEE DISABILITY Treasurer Susan Wade explained that now all part-time employees (that work more than 30 days in a calendar year) along with full-time employees are to receive New York State Disability benefits. She explained that the employees are to contribute ½ of 1% of wages paid, but not in excess of 60 cents per week. These contributions no longer cover the quarterly premium and the Village picks up the difference. Per the suggestion of Treasurer Susan Wade, a motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote for the Village to waive all employee contributions and have this as an added benefit. (The Village will pay the full disability premium.) · 2018/2019 EMPLOYEE CARRY OVER TIME Each of the Trustees received a copy of the 2018/2019 Village of Moravia Employee Carry Over Time. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the 2018/2019 Employee Carry Over Time. · MFD/VFW PARADE A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the MFD/VFW Parade scheduled for July 21, 2018 and to waive the deposit. (It was noted that a copy would be sent to the Department of Public Works and the Moravia Police Department along with a memo sent to the Moravia Police Department.) · ANNUAL AUDIT OF JUSTICE BOOKS Trustee McGuerty reported that she and Trustee Fulton recently reviewed Judge June Shepardson’s Village Justice books and completed the Justice Audit Checklist. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 5-0 vote to approve the following resolution: BE IT RESOLVED THAT the Board of Trustees of the Village of Moravia, New York, hereby acknowledges that it has examined and audited, to the best of their knowledge, the records of the Justice Court of the Village of Moravia, New York, for year June 1, 2017 to May 31, 2018; and BE IT FURTHER RESOLVED THAT the Clerk of the Village of Moravia, New York, is hereby directed to provide a copy of this resolution and report of such audit to: Joan Casazza, Internal Auditor, NYS Office of Court Administration, 2500 Pond View, Suite 104, Castleton on Hudson, NY 12033. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve and accept the letter from the Finger Lakes Runners Club for the Fillmore 5K on July 12, 2018. (The Certificate of Insurance for the Village of Moravia and map were attached.) Mayor Mulvaney stated that this would be copied to the Department of Public Works and the Moravia Police Department along with a memo sent to the Moravia Police Department. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Village of Moravia’s Planning Board Minutes (05/21/18). - Letter to Mayor and Trustees from MRB Group. - Cayuga County Association of Villages Minutes (05/30/18). On the table for Board review was: - Operations Efficiency and Capital Improvement Plan from Cayuga County Water and Sewer Authority. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to enter Executive Session at 8:31 p.m. to discuss personnel. (Village Clerk Anne Riddell was invited to attend.)
