TOWN OF NILES PLANNING BOARD Niles Town Hall, New Hope, New York August 16, 2018 MEMBERS PRESENT: Terry Green, Chairwoman D’Allah Laffoon Bob DeWitt Sara Finizio, Secretary ABSENT: Nate Hatfield OTHERS PRESENT: David Zobkiw, Clancy Edmonds, Ron Rybak, Debra Denman, Loraine Denman, Michael Casa, John Farrell, Sam Giacona, Brody Smith The meeting was called to order at 7:33 PM. Ms. Green asked everyone to stand for the Pledge of Allegiance. Sara Finizio read the July 2018 minutes. Mr. Laffoon made a motion to accept the minutes as read and Mr. DeWitt seconded the motion. All approved. NEW BUSINESS: David Zobkiw and his legal representative, Sam Giacona, approached the Planning Board for final approval of a subdivision of a prior merger. The merged parcels are to be split into 2 parcels to provide proper lake frontage and square footage to meet Town of Niles code requirements. One parcel includes 150 feet of lake frontage and the other 50 feet of lake frontage. To meet the 75 feet lake frontage requirement, 25 feet of the parcel with 150 feet will be transferred to the parcel with 50 feet of lake frontage. Property located at 336-340 Fire Lane 15 on Owasco Lake. Tax map # 145.14-1-14.111. o Forms received: Application for Subdivision Short Environmental Assessment Form (negative declaration) Survey Map Legal Representative Form A motion was made by Mr. DeWitt and seconded by Mr. Laffoon for approval. All approved. Michael Casa approached the Planning Board for final approval (preliminary February 18, 2016) of a minor subdivision of 20 acres from an existing 103 acre parcel. Property located at 3872 Carver Road, Moravia, New York. Tax map # 168.00-1-2.1. The 20 acres include the house and barn. o Forms received: Application for Subdivision ---PAGE BREAK--- Short Environmental Assessment Form (negative declaration) Survey Map A motion was made by Mr. DeWitt and seconded by Mr. Laffoon for approval. All approved. Loraine Denman approached the Planning Board for preliminary approval of a minor subdivision of 2.823 acres from an existing 36.262 acre parcel. The 2.823 acres include the house and pole barn. Property is currently owned by Loraine and William Denman, and is located at 4383 Vanderstouw Road, Auburn, New York. Tax map # 155.00-1-10.1. o Forms received: Application for Subdivision Short Environmental Assessment Form Final approval will depend on a merger application from the buyer of the 33.429 remaining acres to his existing property, or installation of a culvert to create ingress and egress to meet Town of Niles code requirements. John Farrell approached the Planning Board for further discussion of purchasing lake frontage on Twisting Lane on Skaneateles Lake in the Town of Niles. All options for Mr. Farrell were explored to meet all the requirements for the Town of Niles codes. The Planning Board made a recommendation that Mr. Farrell discuss his plans with the Town of Niles Code Enforcement Officer. The Planning Board will need to see any preliminary plans. OTHER DISCUSSION: Clancy Edmonds, Town of Niles Board member, informed the Planning Board that there will be a public hearing on September 13, 2018 at 7:00 PM regarding solar farms. Mr. Clancy provided a copy of the preliminary code to the Planning Board. Planning Board members will gather more information on solar system regulations in other towns and provide that information to the Town of Niles Supervisor and the Town of Niles Attorney prior to the public hearing. Ms. Green gave an overview of the August 2018 Cayuga County Planning Board meeting she attended. Ms. Green announced the dates for the upcoming Cayuga County Recycling Events. The Electronics recycling event will be held October 6, 2018, and the Hazardous Materials recycling event will be held October 20, 2018. Ms. Green announced that the SEQRA form will be changing, effective January 1, 2019. Type I and II will be amended. ---PAGE BREAK--- The next meeting is scheduled for September 20, 2018 at 7:30 PM.
