TOWN OF STERLING PLANNING BOARD MEETING July 6, 2017 A regular meeting of the Town of Sterling Planning Board was held on Thursday July 6, 2017 at the Sterling Town Hall at 7:00 pm with the following members present:  June Ouellette ~ Chairman  Vernon Bishop ~ Member  Scott Crawford ~ Member  Paul Kelley ~ Member Absent: Member Sue Allen Also Present: Russell Patchen, Joan Kelley and Virginia Fichera Chairman Ouellette called the meeting to order at 7:00 pm. BUSINESS Russell Patchen – Preliminary Meeting - Minor Subdivision – 935 Sterling Station Road, Sterling (15.00-1-35.11) Mr. Patchen presented a survey map of his property for a minor one lot subdivision on Sterling Station Road. The Board members reviewed the map against the required elements checklist and found the following information missing: ~ Add existing septic and well location. ~ Add slope arrows. ~ Add adjacent property owner’s information around entire parent parcel – both sides of the road. ~ Add Final to title block. The property is nearly 30 acres total and the map was drawn to a smaller scale than required, 1”to 200’, to make the final drawing smaller which was acceptable to the Board. Mr. Patchen also provided an application with a completed short form EAF for SEQR which was reviewed by the Board. The project was determined to be an Unlisted Action and therefore requires only the short form, and had the following corrections to be made and initialed by the applicant: ~ Question 5b should be yes, the proposed project is consistent with the Comprehensive Plan. ~ Question 9 was answered yes but should be N/A (not applicable) because a subdivision of properties meet or exceed energy code requirements. The application was scheduled for a Public Hearing on August 3, 2017 at 7:00 pm. Land Use Regulations The CEO recently presented an issue with the LUR regarding Accessory Structures and would like for the Planning Board to be aware and/or remedy the situation. The interpretation of the LUR by the CEO is that accessory structures, such as a pole barn, cannot be built on a vacant property unless a principal structure, such as a residence, already exists. The Use Chart specifies dwellings, commercial entities or agricultural based structures as principal uses and accessory uses are incidental to that use. If a resident wants to build a pole barn for personal storage usage on a vacant parcel then a Use Variance would be his only option at this time. The Board briefly discussed the issue and decided that they would research it and discuss it again at their next meeting. ---PAGE BREAK--- MINUTES A motion to approve meeting minutes for June 1, 2017 was moved by Member Crawford and seconded by Member Kelley. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Bishop and seconded by Member Crawford, the meeting was adjourned at 7:45 pm.
