1 Throop Town Board May 12, 2018 Board Members Present: Supervisor Tarby Councilman Paczkowski Councilwoman Banas Councilwoman Young Councilman Vitale Town Officials Present: Dog Warden Schillace Kathy Malenick, Town Clerk Zoning Officer Tom Weed Attorney Chirco The Meeting was called to order at 7:48 am. The minutes to the March Board Meeting were reviewed for ommissions and errors. A motion was made by Supervisor Tarby to change Councilman Paczkowski to Councilman Vitale on page 3 paragraph 3. The corrected version to read Supervisor Tarby made a motion to enter into executive session at 8:40 am. Councilman Vitale seconded the motion. The motion passed unanimously and the Board entered into executive session. Supervisor Tarby read the following reports:  Town Clerk’s Report submitted by Town Clerk Malenick  A motion was made by Councilman Paczkowski to accept the Clerk’s report as written Councilwoman Young seconded the motion. The motion passed unanimously.  Highway Report  Zoning Report Matt Schooley engineer for Barton and Loguidice discussed the progress on Nugent Road Bridge Project starting sometime in July. He stated if everything goes well, they will be done by September. Supervisor Tarby asked if the Town could reuse the material from the Bridge that is being replaced, given that it’s relatively new. Mr. Schooley confirmed they have already directed the return of the steel back to the Town of Throop, as long as it is used for a bridge and not scrapped. ---PAGE BREAK--- 2 Councilman Vitale asked Mr. Schooley if he will be present, when the County’s replacement and repair of Turnpike Road is taking place. Mr. Schooley indicated he would be on the project. Councilman Vitale asked him if he was aware of the problem on Turnpike Road and Canoga Road. There is a culvert that no longer is functioning. The water accumulates on the homeowner’s property. Mr. Schooley indicated he would definitely look into it. Councilwoman Young also asked about the drainage problem by her house on Turnpike Road as well. Mr Schooley stated they were going to be putting cross pipes in that area as well, to alleviate that problem. Councilman Vitale also asked what the plan was with the deck/bridge on Turnpike Road. Mr. Schooley stated the bridge is wooden. It’s one of several that were done back in the early 90’s and it is not slated to be redone. He stated they are going to put a thicker membrane and heavily coat it with asphalt, but it won’t alleviate the problems that exist with it right now. He indicated the wood decking is not sufficient for that type of bridge and traffic. Supervisor Tarby asked if the home owners knew that some of these houses will have a retaining wall. Mr. Schooley stated they did not. There will be 3 houses, the ones on both corners and the other next to it. Public Forum Val Robinson asked if this was going to be Mike Vitale’s last day serving on the Board. He stated it was not, he hasn’t closed on his house yet. He stated he was very proud to serve on the Board and it is difficult for him to leave. Councilwoman Banas stated there is a Quonset hut on North Division St Rd. She wanted to know if he had a permit. The property belongs to Harold Deland and Zoning Officer Weed stated he had a permit for the greenhouse. Donna Adams stated there is a fox that is injured that is chasing her cat on Turnpike Road. She wanted to know if there is someone that could take care of it. Supervisor Tarby suggested calling a wildlife trapping service. Councilwoman Banas asked when the playground will be installed. She stated she spoke to the Highway Superintendent about it, and he stated he did not know where it was going. Supervisor Tarby stated he went over it with Joe, and he knows where it’s going. The playground area was still wet, and they were waiting for it to dry out a little before they started digging it out. Councilwoman Young asked if children can ride bikes at the walking trail. Supervisor Tarby and Councilman Vitale both stated there shouldn’t be a problem with it as long as they aren’t running pedestrian’s off the trail. Councilwoman Young asked if the Port Byron Little League could practice on the field. Supervisor Tarby stated the field is already been promised to the Boys and Girls League. She indicated that the Port Byron Little League would like to use the field next year and is willing to pay the umpires on their own. Supervisor Tarby stated he would revisit next year. Councilwoman Young also asked if Powers Road was going to be repaved. Supervisor Tarby stated Powers Road is a County Road and under Dan Bowen’s jurisdiction. Councilwoman Young also asked if people could walk their dogs on the trail. Supervisor Tarby stated he didn’t have a problem with it as long as they have them on a leash, and clean up after the dog. ---PAGE BREAK--- 3 Old Business Supervisor Tarby asked Town Attorney Chirco if he had gotten the accident report involving John Gilmore and Town Truck. Attorney Chirco stated he had not. New Business Supervisor Tarby stated that some of the Board Members attended the Firemen’s dinner, and had a conversation with Senator Pam Helming. She told them she thought she might be able to find some funding for the playground. She emailed Supervisor Tarby stating she is reaching out to the Town of Throop regarding some possible grant funding, regarding the playground the Town of Throop is currently in process of installing; and upgrading the park. Senator Helming has access to funding through the SAM program. The minimum amount of $50,000.00 is given through this program. It must be capital improvements no salaries, additionally they take 12-18 months from the day the application is received. To start the process, a letter must be submitted from the Supervisor and the Town Board stating the outline of the project and the cost. Councilman Vitale made a motion to have the Town Supervisor send a letter requesting money for the playground to Senator Pam Helming’s office. Councilwoman Young seconded the motion. The motion passed unanimously. Councilwoman Banas stated she would like to put some markers for the cemetery rows to mark where the row begins. The cost is about $100.00 each. General fund Vouchers #461-#488 in the amount of $66,600.59 were reviewed for payment. A motion was made by Councilman Paczkowski to pay vouchers #461-#488 in the amount of $66,600.59 Councilman Vitale seconded the motion. The motion passed unanimously. . Highway Vouchers # 313-#329 in the amount of $9018.09 were reviewed for payment. A motion was made by Councilman Paczkowski to pay vouchers # 313-#329 in the amount of $9018.09.Councilman Vitale seconded the motion. The motion passed unanimously. ---PAGE BREAK--- 4 . Water Vouchers # 252-#257 in the amount of $4010.51 were reviewed for payment. A motion was made by Councilman Paczkowski to pay vouchers # 252-#257 in the amount of $4010.51. Councilman Vitale seconded the motion. The motion passed unanimously. SW1 Vouchers # 215-#219 in the amount of $1435.05 were reviewed for payment. A motion was made by Councilman Paczkowski to pay vouchers #215-#219 in the amount of $1435.05. Councilman Vitale seconded the motion. The motion passed unanimously. A discussion about the clothing allowance for the Highway Dept resulted in the termination of Unifirst. Supervisor Tarby made a motion to terminate Unifirst effective 05/14/2018. Councilman Vitale seconded the motion. Supervisor Tarby made a motion to reimburse John Gilmore, Tim Feocco and Joe McBride 125.00 each to purchase new jeans. The clothing allowance will be re-visited in November to determine the following year. With no further business at hand, A motion to adjourn at 9:15 am was made by Supervisor Tarby.
