TOWN OF STERLING PLANNING BOARD MEETING October 5, 2017 A regular meeting of the Town of Sterling Planning Board was held on Thursday October 5, 2017 at the Sterling Town Hall at 7:00 pm with the following members present:  June Ouellette ~ Chairman  Sue Allen ~ Member  Vernon Bishop ~ Member  Scott Crawford ~ Member  Paul Kelley ~ Member Also Present: Joanne Longley, Attorney Salvatore Lanza, Richard Fox, Joy Duane Kyle, Gisela Schneider and Shamus Waldron. The meeting was called to order at 7:01 pm by Chairman Ouellette. BUSINESS Jason MacLeod- Preliminary Meeting - Minor Subdivision – 14896 Hadcock Drive, Sterling; Tax map #8.07-1-6.1 The applicant was not present for the meeting but had supplied his surveyed map for the Board to preliminarily review. The proposed three lot subdivision had been sent to the ZBA for a variance request regarding minimum lot size for all three proposed lots. The ZBA had approved the area variance on August 21, 2017 and a copy of the resolution is in the project file. The Board members reviewed the survey map against the required elements checklist and found the map to be complete. The EAF SEQR form was supplied and was reviewed with a DEC resource printout, it was found to be accurate but in need of the applicant’s signature. A Public Hearing was scheduled for November 2, 2017. Joan Longley – Preliminary Meeting – Minor Subdivision – 14437 Martville Road, Martville; Tax map #13.00-1-25.1 Joanne Longley, the applicant’s daughter, supplied the Board with a surveyed map of the proposed subdivision and the Board members began their review of the map against the required elements checklist. The map appeared to be complete but the clerk will check the adjacent property owners to confirm that they are all there. The Board members stated that they would also need a notarized letter for the file from Joan Longley acknowledging that she is allowing Joanne Longley to represent her for the subdivision process. The EAF form for SEQR was also reviewed by the Board and will need confirmation against the DEC’s EAF Mapper before determining that the form is complete; the clerk will provide printout for the next meeting. The Board did ask Joanne Longley to correct and initial question #3 to be 30.225 acres. Joanne Longley stated that she will be merging the newly created lot with her own which is currently surrounded by the proposed parcel. A Public Hearing was scheduled for November 2, 2017. Martin Estate – Attorney Salvatore Lanza and Richard Fox – Sketch Plan Conference – Minor Subdivision. Attorney Salvatore Lanza approached the Board to discuss the settlement of an Estate where several properties, not all in Sterling, may have encroachments which the current owner would like to correct. The Maroney Estate has been held in escrow for ---PAGE BREAK--- an extended period of time because of issues that arose when the property was surveyed, which is why he and his client, Richard Fox, are present tonight. A farmer from Anthony and Carolyn Martin, bought the property in its entirety and wishes to address all of the encroachments regardless of how small they are. The property owned by his client, Mr. Fox, has adjustments to both sides of his property – 0.18 acre on the south property line and 0.07 acre along the north property line that represents area that Mr. Fox has maintained and used for many years not knowing that he was off of his property. Attorney Lanza had a large map of the estate now owned by the Martin’s that he showed to the Board Members, as well as a smaller map of just Richard Fox’s property that they would like the Board to address. Chairman Ouellette explained that they would need to apply for a minor subdivision/lot line adjustment that would take approximately 3 meetings to complete. The subdivision request would be by the Martin’s, whom currently own the property, but could be represented and processed by Richard Fox. Mr. Fox and Attorney Lanza were told to complete the application and obtain a single copy of the surveyed map for the next meeting, which would be a preliminary review on November 2nd if they were ready. Lillian Waldron – Preliminary Meeting – Minor Subdivision – 14424 State Route 38, Sterling; Tax Map #10.00-1-61.1 Shamus Waldron, grandson of property owner Lillian Waldron, provided the requested notarized letter for the file from Ms. Waldron allowing him to proceed with the subdivision process. He also provided a surveyed map of the property which the Board members reviewed against the required elements checklist. They discussed the driveway depicted off of Onionville Road allowing right of way access for farmers to hay the field, and suggested that language of the access be included in the new property deed description. The clerk will check the map to determine if all the neighboring parcels are listed, and if not, notify the surveyor to include them. The application was also supplied with a completed EAF, which the Board reviewed, but will need a DEC Mapper printout to verify some of the questions. The clerk will run EAF Mapper for the property and supply to the Board members at the next meeting. Meanwhile the form was read aloud and Mr. Waldron was asked to correct and initial question #3 – 26.27 acres. Shamus Waldron stated that he planned to build a house near his current residence in a few years and was told to review his plans with the CEO before merging the property because he would then need a ZBA variance to build a second residence while living in the current home. Mr. Waldron supplied a check payment of the application fee which the clerk will leave in the Town Clerk’s mailbox. A Public Hearing was scheduled for the November 2, 2017 meeting. Betty Morrell –Preliminary meeting– Minor Subdivision – 1711 Maroney Road, Sterling; Tax Map #7.00-2-34 Joy (POA for mother Betty Morrell) and Duane Kyle (brother of Betty Morrell) presented a surveyed map for the board to review as well as an application, EAF form, and check payment for the subdivision application fee. The map was checked against the required elements checklist and found to be complete, except for review by the clerk to verify that all of the adjacent property owners are listed. The EAF form had been generated through the EAF Mapper and was inclusive of the answers generated by DEC resources. The Board reviewed the form and had the applicant correct and initial question #3 to be 6.23 total acres. The check payment will be left for the Town Clerk to process, and a Public Hearing was scheduled for the November 2, 2017 meeting. ---PAGE BREAK--- Gisela Schneider – Sketch Plan Conference – Minor Subdivision. Gisele Schneider approached the Board to discuss the proposed subdivision of approximately 1 acre of property that she would like to give and merge with an existing neighbor property owned by the Sherman’s. She was told that because the property was less than the 2 acre minimum she would be applying for a minor subdivision/lot line adjustment which requires the new parcel to be merged as a requirement of approval. She was supplied with an application and instructed to return with a single copy of the surveyed map for the Board to preliminarily review. Comprehensive Plan Member Sue Allen updated the Board as to the progress the Fair Haven Planning Board was making in their review of the Goals & Strategies sections of the Comprehensive Plan. She has been in contact with Darrell Uetz; and they are planning a meeting next week to work on the update and extend an invitation to anyone who would like to help. MINUTES A motion to approve meeting minutes for September 7, 2017 was moved by Member Bishop and seconded by Member Crawford. All were in favor without further discussion and the motion passed. A motion to approve special meeting minutes, with minor corrections, for September 26, 2017 was moved by Member Bishop and seconded by Member Crawford. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Kelley and seconded by Member Crawford, the meeting was adjourned at 8:45 pm.
