Town of Sennett Board Meeting July 17, 2018 Minutes of the Town of Sennett Town Board Meeting held on Tuesday July 17, 2018 at 7:00 PM at the Sennett Town Office Building. Members Present: Peter Adams, Supervisor Jerrold Eades, Councilman Edward Rizzo, Councilman Richard Gagliardi, Councilman Ron Schalck, Water & Wastewater Superintendent Jerry VeVone, Zoning Officer Cheri Major, Bookkeeper Richard Andino, Attorney Penelope Dennis, Town Clerk Meeting is opened with the pledge to the flag. Financial Report: at six months the budget has spent less than 50% of budgeted amounts. $250,000.00 CD was opened, done quarterly. Councilman Eades reads the following budget transfers: $200,000.00 from A9901.900 to Highway Revenue; $873.73 from A599 to A1420.420; $5,576.25 from A599 to A1420.460 and $4,725.00 from A599 to A1420.470. A motion is made by Councilman Gagliardi to approve the transfers, seconded by Councilman Eades. Roll Call vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers absent, Supervisor Adams yes, carried. Old Business: Window Replacement Project – nothing new YMCA Summer Swim Program – We have approximately thirty children signed up and there was no requests/need for busing this year. Proposed Local Law A of 2018 – Seasonal Parking Prohibition. Attorney Andino reads and explains the proposed law. The Public Hearing is opened on a motion made by councilman Eades, seconded by Councilman Gagliardi. Roll Call vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers absent, Supervisor Adams yes, carried. Ed Magdziak questions if there will be signs alerting people – yes there will. The Public Hearing is closed on a motion made by Councilman Eades, seconded by Supervisor Adams. Roll Call vote: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers absent, Supervisor Adams yes, carried. ---PAGE BREAK--- The following resolution was offered by Councilor Gagliardi, who moved its adoption, seconded by Councilor Eades, to wit: WHEREAS, pursuant to the provisions of the Municipal Home Rule Law, a proposed local law entitled Local Law No. A of 2018, “A Local Law to Enact a Seasonal Parking Prohibition on Town Roads in the Town of Sennett”, was presented and introduced at a regular meeting of the Town Board of the Town of Sennett held on June 19, 2018 and was determined to be a Type II action for purposes of SEQR; and WHEREAS, a public hearing was held on such proposed local law on the 17th day of July 2018 by the Town Board of the Town of Sennett and proof of publication of notice of such public hearing, as required by law, having been submitted and filed, and all persons desiring to be heard in connection with said proposed local law having been heard, and said proposed local law having been in the possession of the members of the Town Board of the Town of Sennett in its final form in the manner required by Section 20 of the Municipal Home Rule of the State of New York; and WHEREAS, it is in the public interest to enact said Proposed Local Law No. A of 2018. NOW, THEREFORE, it is RESOLVED, that the Town Board of the Town of Sennett, Cayuga County, New York, does hereby enact Proposed Local Law No. A of 2018 as Local Law No. 1 of 2018 as follows: TOWN OF SENNETT PROPOSED LOCAL LAW NO. 1 OF 2018 A LOCAL LAW TO ENACT A SEASONAL PARKING PROHIBITION ON TOWN ROADS IN THE TOWN OF SENNETT Be it enacted by the Town Board of the Town of Sennett as follows: SECTION 1. LEGISLATIVE PURPOSE AND INTENT. The Town Board of the Town of Sennett adopts this Local Law to regulate parking on town roads during certain times during the year in order to ensure the provision of efficient highway department services, prevent obstacles to snow removal, and to protect the health, safety and welfare of the general public. SECTION 2. AUTHORITY. ---PAGE BREAK--- This local law is enacted pursuant to the New York State Constitution and New York Municipal Home Rule Law § 10. SECTION 3. SEASONAL PARKING PROHIBITION. The parking of motor vehicles, trailers, equipment or any other item is hereby prohibited on both sides of all Town of Sennett roads and rights of way from November 1st of each year to April 1st of the following year. SECTION 4. SEVERABILITY. If the provisions of any article, section, subsection, paragraph, subdivision or clause of this Local Law shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any article, section, subsection, paragraph, subdivision or clause of this Local Law. SECTION 5. EFFECTIVE DATE. This Local Law shall be effective upon filing with the office of the Secretary of State.” The question of the adoption of the foregoing resolution was duly put to a vote and upon roll call, the vote was as follows: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers absent, Supervisor Adams yes, carried. The foregoing resolution was thereupon declared duly adopted. Cayuga County Consolidated Services Plan is discussed by Supervisor Adams – some of the options discussed have been consolidation of town and village courts, smaller courts, water, equipment sharing, etc. Some of these options are being done now. Health care options were also discussed, 2000 participants would be needed. More information will be available next month. Grant request for the park- three phase buildout: equipment and improvements – lighting, paving the parking and entrance, water supply, power, lights. Information has been sent to Senator DeFrancisco’s office -more info will be sent. Supervisor will talk to Owasco about used equipment possibilities. New Business: WD#3 water project – there are many steps to be accomplished – repair and upgrades to be considered. More information will be available at the meeting on the 24th. ---PAGE BREAK--- The following resolution was offered by Councilor Eades, who moved its adoption, and seconded by Councilor Rizzo, to wit: WHEREAS, the Town of Sennett Town Board has undertaken consideration of a water project in the Town to be known as the Water District No. 3 Water Improvement Project; and WHEREAS, the Town Board previously adopted a Negative Declaration and completed its SEQRA review relative to the Water Project; and WHEREAS, it is anticipated that bond counsel services for the financing of said Water Project will be necessary to accomplish the goals for the construction and replacement of infrastructure and other activities occurring in the improvement area; and WHEREAS, the Town of Sennett desires to engage bond counsel services from professionals with experience in such matters; and WHEREAS, the Town of Sennett has been presented with a bond counsel services proposal/agreement dated June 19, 2018 by Orrick, Harrington & Sutcliffe LLP; and WHEREAS, the Town of Sennett desires to engage the services of Orrick, Harrington & Sutcliffe LLP for such purposes pursuant to the terms of said proposal/agreement; and WHEREAS, the engagement of Orrick, Harrington & Sutcliffe LLP for such services constitutes a Type II action for purposes of State Environmental Quality Review and, as a result, no environmental impact is anticipated. NOW, THEREFORE BE IT RESOLVED that the Town of Sennett Town Board hereby authorizes the Town Supervisor to execute the proposed agreement between the Town of Sennett and Orrick, Harrington & Sutcliffe LLP relative to certain bond counsel services relative to the construction of the Water Improvement Project and to take such other and further actions as are necessary to engage such services. The question of the adoption of the foregoing resolution was duly put to a vote and upon roll call, the vote was as follows: Councilman Eades yes, Councilman Gagliardi yes, Councilman Rizzo yes, Councilman Jeffers absent, Supervisor Adams yes, carried. The foregoing resolution was thereupon declared duly adopted. The MAP plan report for the project will be discussed on Tuesday. ---PAGE BREAK--- CH4 – Digester Project: the Health Department has no issue with the SEQRA. Also, as a reminder to Sennett residents – septic systems need to be inspected by November1, 2018. Sroka PDD: Engineer Joe Durand is present and explains the project. /he has maps and information for the board members. Repair Plus was granted the original PDD in 2011. They are requesting modifications of the PDD to allow a gas station/convenience store on the corner of the lot. Total of 13 acres with the proposal to be located on 2.25 acres. The area in question (located on Rte. 34) is now zoned a Commercial Overlay zone, it is consistent with the zoning. Mr. Durand states that he has meet with the NYS DOT and a traffic study will be done. Attorney Andino explains the steps involved – the Town Board receives/reviews the request; referred to the Town Planning Board; referred to the County for a GML 239 l,m&n review; then a local law would need to be enacted to amend the PDD. It will take a few months to accomplish. CH4 – complete SEQRA, the plans have been received from the Engineer. The Town will need an agreement for the work that is being done on the Town ROW. Department Reports: the Highway superintendent’s report is read by the Supervisor -the department has been mowing the roadsides, the park and the town office building lawn; paved Mutton Hill Road; got Swamp, Cherry Street, Center Street, Baker and Nelson Roads prepared for stone and oiling; sent trucks to assist in Aurelius, Throop and Fleming; cut back some trees on various roads and have patched certain spots. The bid received for the roadside mower was $2,100.00, a fair price. Water & Sewer Department reports: locating and marking curb stops and leak detection; repaired a side walk where it was dug up to install a hydrant; water samples were done; water operation reports were done by the 10th; water meters were read and bills sent out; data logs were done for leaks and high readings; marking out many dig requests; cut grass at Franklins Street pump station and pulled pump at Quincy Hill pump station due to an overload again. It needs cutters replaced. Pump repair = $2,500.00. There is discussion on a new one-ton dump truck for the W&S department - the current truck will be seven years old in 2019. The cost is $51,916.41± with a sixteen to twenty-week time frame to get one. There is also discussion on sharing equipment between the Highway and W&S Departments. The ZBS reports that they will be rehearing the Rex appeal. Judge Timian reports $3,709.00 for June 2018. Judge Riley reports $5,295.00 for June 2018. The Town Clerk reports $8,355.88 for June 2018. The Court Clerk’s report is read and reviewed by the board. The CEO’s report is also read and reviewed by the board. Attorney – nothing. Assessor – a motion is made by Councilman Eades to appoint Jeff Lowe as the Assessor PT for the remainder of the term; September 1, 2018 until September 30, 2019 at the rate of $20,500 per year ---PAGE BREAK--- (prorated for the reminder of 2018), seconded by Councilman Rizzo. A motion is made by Councilman Eades, seconded by Supervisor Adams to open The Public To Be Heard segment, 4 ayes I absent 0 nays carried. Ron Dennis, Cherry Street Road, asks if the Town has heard anything on the shooting range lately? No, they haven’t. He states that he has seen the plans and they still intend to construct it. There is discussion on this – SEQRA review, stormwater management, etc. Also, the town is aware of a solar farm in the planning stage – the town will send a letter and reach out to the involved parties. There is discussion on this also. The Public To Be Heard segment is closed on a motion made by Supervisor Adams, seconded by Councilman Rizzo, 4 ayes I absent 0 nays, carried. A motion is made by Councilman Rizzo to enter into an Executive Session for the medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation, seconded by Councilman Eades. A motion is made by Councilman Rizzo to come out of Executive Session, seconded by Councilman Eades. Supervisor Adams states that he is in contact with the Greater Tompkins County Municipal Health Insurance Consortium, more information to follow. The minutes of the previous meeting are approved on a motion made by Councilman Eades, seconded by Councilman Rizzo, 4 ayes 1 absent 0 nays, carried. The abstract in the amount of $499,435.43 is approved for payment on a motion made by Councilman Eades, seconded by Councilman Rizzo.
