Throop Town Board July 14, 2018 Board Members Present: Supervisor Tarby Councilman Paczkowski Councilman Vitale Councilwoman Banas Absent: Councilwoman Young Town Officials Present: Dog Warden Schillace Zoning Officer Weed Kathy Malenick, Town Clerk Highway Superintendent McBride Supervisor Tarby called the meeting to order at 8:02 am opening with the pledge of allegiance. A motion to accept the minutes for June was made by Councilman Paczkowski and seconded by Councilman Vitale Supervisor Tarby read the following reports: Town Clerk’s Report submitted by Town Clerk Malenick A motion was made by Councilman Paczkowski to accept the Clerk’s report as read. Councilman Vitale seconded the motion. The motion passed unanimously. Highway Report submitted by Highway Superintendent McBride Zoning and codes report submitted by zoning officer Weed. Old Business Supervisor Tarby asked Attorney Chirco if there was any progress with the possibility of sharing the water system on Turnpike Road with the County. Attorney Chirco said he wrote a letter to Attorney Galbato, and has not heard anything back. Supervisor Tarby asked if Attorney Chirco if the small claims hearing was still set to take place August 1st. Attorney Chirco affirmed it was. Attorney Chirco will schedule a Public Hearing for August 11th on the proposed local law regarding solar energy. Councilman Paczkowski had a question about large scale solar systems, and what deemed a large scale or small scale. He was also concerned that the restrictions may be to confining. Councilman Vitale was concerned about the weight of the panels on these roofs. He believes there may be a problem with the structures of the houses. Councilman Paczkowski made a motion to hold a public hearing regarding the proposed local law #3 regarding Solar Energy immediately prior to the Town Board meeting on August 11th. Supervisor Tarby seconded the motion. Attorney Chirco stated he would advertise the hearing. New Business ---PAGE BREAK--- A payment request form from MRB was submitted for the new water line. They are requesting payment in the amount of $204,642.97 for all the work completed thus far. There were concerns from the Town Attorney and Board Members about the wording in the letter stating 80% of the restoration of the driveways are completed. Attorney Chirco stated his mother lives on Turnpike Road and her driveway restoration is nowhere near 80% complete. Supervisor Tarby and Councilman Vitale also noted the driveways along Turnpike Road were clearly not at 80% completion. Supervisor Tarby suggested authorizing payment of less than 204,642.97 subject to whatever he can negotiate. Councilman Vitale made a motion to authorize Supervisor Tarby to negotiate payment of less than 204,000.00. Councilman Paczkowski seconded the motion. The motion passed unanimously with Supervisor Tarby abstaining. Supervisor Tarby announced Councilman Vitale will be resigning when the water line is complete, which should be at the August meeting. Barton and Loguidice are requesting approval to move the watermain for the Turnpike Road project. The project has been reviewed and approved by Water Operator John O’Connell. The application was approved Open Public Forum Val Robinson asked if the speed limit could be lowered on Day Road to 45 MPH. The current speed limit is 55. Supervisor Tarby suggested someone canvasing the residents on Day Road Lynn Cayward on Youngs Road complained he has very poor to low water pressure. Highway Superintendent McBride said he would go to Mr. Cayward’s house and look at his service. Supervisor Tarby told him to check and see if they have a bad pressure reducing valve. Mr.Cayward indicated he did not know whether they even had a valve. Supervisor Tarby told him if they don’t have a pressure reducing valve to call him and he will send John O’Connell out to investigate. Attorney Chirco stated he sent a letter to the Trooper regarding the incident with the Plow and John Gilmore. He has not heard anything yet. Supervisor Tarby made a motion to enter into executive session to discuss personnel at 8:30 am. The Board reconvened at 9:03 am. Supervisor Tarby asked Councilwoman Banas about additional fees for off hours burials. It has become necessary to increase the fee’s to cover overtime for weekend and off hour burials. A motion was made by Councilman Vitale to raise the fees for burials to be full burial $600 Monday -Thursday $800.00 for a Friday, Saturday or Sunday. Cremation rates $300 Monday-Thursday $400.00 Friday, Saturday or Sunday. General Fund Vouchers # 523-#564 in the amount of $70,971.58 of were reviewed for payment. Councilman Paczkowski made a motion to pay Vouchers #523-#564 in the amount of $70,971.58 Supervisor Tarby seconded the motion. Councilman Vitale abstained. The motion passed unanimously. Highway Vouchers # 346 - #352 in the amount of $6212.80 were reviewed for payment. Councilman Paczkowski made a motion to pay Vouchers # 346-#352 in that amount of $6212.80. Councilman Vitale seconded the motion. The motion passed unanimously. Water ---PAGE BREAK--- Vouchers #263-267 in the amount of $14,946.16 were reviewed for payment. Councilman Paczkowski made a motion to pay vouchers # 263-#267 in the amount of $14,946.16. Supervisor Tarby seconded the motion. The motion passed unanimously. SW-1 Vouchers #224-#227 in the amount of $1458.39 were reviewed for payment. Councilman Paczkowski made a motion to pay Vouchers # 224-#227 in the amount of 1458.39. Councilman Vitale seconded the motion, The motion passed unanimously. Supervisor Tarby made a motion to adjourn at 9:45 AM. Councilman Vitale seconded the motion.
