TOWN OF STERLING PLANNING BOARD MEETING May 4, 2015 A regular meeting of the Town of Sterling Planning Board was held on Monday May 4, 2015 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Grover Horn ~ Member Vernon Bishop ~ Member Susan Lemon ~ Member Also Present : Christopher Ferlito, Steve Keeling and Tim McIntyre. Chairman Ouellette called the meeting to order at 7:03 pm. CORRESPONDENCE o Towns & Topics BUSINESS Christopher Ferlito – Martville Sand & Gravel Mine – Preliminary Review for Special Use Permit (#20.00-1-68.1) C.J. Ferlito was asked by Chairman Ouellette to briefly explain the project and to update any changes made to the proposed operation or design plans. A complete packet with maps dated April 2015 was supplied and will be copied for the Members. Mr. Ferlito stated that a change had been made by the DEC to have a single ingress/egress at the second (south) driveway location only – maps and text reflect the changes. The change was initiated to eliminate truck traffic directly across from a residence close to the north driveway, it also allows additional sight distance on the hill traveling south on Sanford Road. Mr. Ferlito also stated that he had appeared before the ZBA on April 27th and had received a variance for the setback requirements for surrounding residences and ingress/egress of the mine, which the Planning Board had a copy of in the project file. A Negative Declaration had been determined by the DEC for the required SEQR review in which the DEC retained the Lead agency status in July of 2014 – copy of Determination dated May 4, 2015 was supplied for the project file and copies to be made for Board members. The Members reviewed the project file documents and asked the following questions: ~ Chairman Ouellette asked what machinery would be present on site for normal operations. C.J. Ferlito replied that 4 machines were required – excavator, bulldozer, screening plant and dump trucks. ~ Member Lemon asked for details regarding the land reclamation controls? The land is reclaimed after a phase is mined as described by the DEC approved reclamation plan which is secured with a bond held by the DEC. The bond amount is approximately $30,000.00 and is held until the land is seeded; another bond is established for the new phase to commence. ~ Member Allen asked who watches for conformance to the requirements. The DEC regulates the entire permitting and reclamation process with scheduled inspections as well as holding the bonds which acts as insurance if the applicant doesn’t perform the reclamation. ~ Member Bishop asked what amounts of gravel had been removed in the past and why hadn’t they been permitted. Steve Keeling, the original property owner, answered that it had never been a constant business and that you can remove 750 yards a year without needing a permit from the DEC. ~ Members Bishop and Lemon questioned expected yields. C.J. Ferlito answered that he didn’t know but that he had 2 current bids for the Sterling waterline project and the Onondaga Lake project. He also stated that the distance hauled largely affects the price therefore most projects would probably be located close to the Sterling area. He also stated that the timeframe for phase 1 was smaller than any of the others because a lot of material had already been removed from this area in the past. ---PAGE BREAK--- ~ Member Lemon asked how many trucks per hour was estimated. He replied that a road bond had been set by the Highway Supervisor Brian Soper through the Road Preservation Law and that a maximum of 50 trucks a day would be allowed. ~ Member Bishop asked what the loudest noise maker on site is. Several people replied that it’s the back up alarms on all construction vehicles and equipment. A resident commented that all of C.J.’s equipment is new and has the latest sound buffering reducers already installed. Some remaining discussion ensued regarding the 100’ evergreen buffer that was created along the roadway and the addition of a 7’ berm surrounding the entire mine perimeter which replaced a proposed 2’ berm. The application was deemed complete and a Public Hearing was scheduled for June 1, 2015 at 7:00 pm. Notification to neighbors via certified mail and requested receipt to be completed by clerk. Tim McIntyre – Preliminary Review for Major Subdivision (#14.00-1-14.2) Mr. McIntyre supplied a proposed four lot subdivision map of a property totaling 45.9 acres on Fintches Corners Road. He explained that he would be keeping lots 1 and 4, lot 3 was for a son to build a home on, and lot 2 was for another son possibly in the future. The Board members reviewed the map against a required elements list for subdivisions and the dimensional requirements of the Land Use Regulations. Lot 3 although irregular in shape complies with the 4 to 1 ratio requirement and is shaped as such to allow the construction of a house and septic on a sloped property with a small pond. Some discussion regarding access to lot 2 ensued because the Regulations state that a landlocked parcel can not be formed. Tim McIntyre explained that a gravel driveway that runs parallel to the eastern property line of lot 1 continues into lot 2 and extends along the eastern property line 280’ , turns east over a culvert and extends another 280’ to connect with the Cayuga County ROW at the rear of the property. The ROW is traveled by various ATV’s and allows access to the pond on lot 2 which family and friends utilize 4 seasons a year. The Board stated that the ROW needed to be 50’ wide and clearly located on the map and written in the deed description. Some other required elements that need to be added to the map are the setback dimensions from property lines to existing buildings on lots 1 and 4; as well as the title of ‘Preliminary Plat’. In 6 months the applicant will need to come back with another 5 copies titled Final Plat and receive approval provided nothing has changed. The applicant needs to file the application with the Town clerk and a Public Hearing was scheduled for June 1st at 7:00 pm. Steve Keeling – Sketch Plan Conference for Minor Subdivision Mr. Keeling presented an application for the minor subdivision of property located on State Route 104 in Martville. The property is 55 acres and they would like to subdivide a 10 acre parcel from it to sell to a neighboring property. The applicant had an old map for the Board members to advise him for dimensional compliance before he has a surveyor draft a map. He plans on returning to the June meeting for a preliminary review. MINUTES Meeting minutes for April 6, 2015 were approved with corrections by a motion moved by Member Bishop and seconded by Member Horn. All were in favor without further discussion and the motion passed. ADJOURN On a motion by Member Horn and seconded by Member Lemon, the meeting was adjourned at 8:45 PM.
