1 Village of Fair Haven Board of Trustees Meeting March 13, 2017 The meeting began at 7:00 p.m. Board members present Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Judith Dunaway and Trustee Holley Webster-Goolden. Trustee Pete Hanford was excused. Also present Village Clerk-Treasurer Terri DiGregorio, Deputy Clerk Johanne Van Der Linden, DPW Superintendent Roger Granatiero, Ambulance Supervisor/Zoning Officer Stan 23 guests were present. COMMUNICATIONS: ZBA Hearing results: Tanner Brandt on Wilcox St., use variance denied – Brandon Furber on Fancher Ave., use variance withdrawn – Brandon Furber area variance continued to April 4th 7pm. Arbor Day Grant application submitted via email on 2/24/17. In receipt of January 11th and March 1st Fair Haven Library Trustees meeting minutes. In receipt of $3,843.00 for the 2017 Town of Wolcott ambulance contract. In receipt of recommendations from Workers’ Comp Alliance, Roman Rotko, regarding the loss control survey performed on January 4, 2017. In receipt of annual cable franchise payment of $8,789.54from Charter Communications. In receipt of $12,281.27 from NYMIR/Wright Risk Management for the pump house vaporizer damage and repairs. In receipt of façade recommendations from Thoma Development regarding the Hayward Building ADA ramp. PUBLIC FORUM: Charlie Gerberich, representing a group of concerned people in and around the Village, informed the Board of Trustees of a land developer recently visiting the Village looking for a site on Main Street to develop into a box store. So far, to the best of his knowledge, they have not been able to secure a site from village property owners. This group of citizens would like to propose the Village of Fair Haven zoning and comprehensive plan be updated to prevent the development of box stores or ask the Village to enact a land use moratorium to temporarily suspend development. Copies of the petition containing 500 signatures to stop the development of a box store were turned over to the Board of Trustees. Many people spoke to the Board expressing opinions against box stores in the Village. A list of volunteers to make up a committee to assist the Planning Board was established and will be submitted to the Planning Board Chairman. Mayor Basile had already spoken with the Village Attorney regarding a proposed moratorium. Chris Drogi addressed the Board of Trustees as Zoning Board of Appeals Chairman. He asked the Board to address subdivision as the Village currently has no subdivision regulations. Village zoning was last updated in 1987 and New York State zoning in 1991. All training for ZBA members is taught referring to State code which is less stringent. This was just realized after the last variance hearing and Mr. Drogi would like the Board of Trustees to address this. Also, there is no minimum size for a residence, only a minimum size for mobile homes. The ZBA would also like this addressed. Chris Drogi felt he needed to bring to the attention of the Board of Trustees past experiences dealing with a former village employee while trying to run and expand his business at Anchor Marine on West Bay Road and his Laundromat on Main Street. Mr. Drogi explained he was ready to share these unpleasant experiences now as all the municipal employees, elected officials and appointed officials involved are now retired. He stated it has been extremely difficult for business owners to thrive in the Village of Fair Haven in the past dealing with attitudes of certain people in positions of power and influence. He expressed hope that the attitude of the current Board of Trustees will continue to be positive and fair. The Village will address the problem Mr. Drogi has with his water line for the Laundromat. He presently has two ¾” lines coming into his 1 ½” meter. MINUTES: The February 9th, 13th, 21st and 28thmeeting minutes were approved on a motion by Trustee Webster- Goolden and seconded by Trustee Dunaway. All aye, motion carried. ABSTRACT #10 VOUCHERS: The following vouchers were approved for payment on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden. All aye, motion carried. General Fund: $49,616.64 Water Fund: $16,822.47 Trust & Agency: $3,469.64 February Payroll: $33,778.97 ---PAGE BREAK--- 2 Budget Modifications: The following budget modifications approved on a motion by Trustees Dunaway and seconded by Deputy Mayor Krehling. All aye, motion carried. Transfer $10.60 from A9010.8 state retirement to A1910.4 unallocated insurance Transfer $1,425.33 from A9010.8 state retirement to A9040.8 workers compensation Transfer $1,186.48 from A9010.8 state retirement to A7110.1 parks personal services Transfer $393.61 from F9010.8 state retirement to F9040.8 workers compensation COMMITTEE REPORTS: February DPW report submitted by Roger Granatiero. Checked Pump House daily; Took water samples to Lab in Auburn; Read Water Meters and investigated 2 possible water leaks; Meter Replacements; Plowed and snowblowed when needed; Washed trucks and equipment weekly; Replaced exit valve in Pump Station 1; Finished painting chipper and the old Ferris Lawnmower; Both Leaks were fixed on Lake St. Ext. and Lake St.; Backhoe was repaired successfully; NY Rural Water came to help us detect possible leaks, they will be coming back in a few weeks with another sophisticated hearing device in hopes of finding the leak; A berm was built-up along the Sue Parson’s property bordering village storage lot on Stafford St., CCWSA will be planting 10-12 white pines on berm to create a natural fence line; Working on Public bathrooms on down time, replacing a toilet & painting; Painted Men’s bathroom in Garage; Chipped all the brush that was piled up at the West Barrier Bar from the Fall; Mowers were all serviced and ready for Spring; installed 150 ft. of 12” drain pipe down at Dr. Tesoriero’s on 12th Street. Roger will be on vacation the week of March 20th. Report accepted on a motion by Trustee Webster-Goolden and seconded by Trustee Dunaway. All aye, motion carried. Treasurer’s report submitted by Terri DiGregorio for period ending 02/28/2017. General fund balance $467,605.25 which includes WBB $4,232.19, Water fund $102,766.56, Trust & Agency $657.57, $1.00, 2013 CDBG $1.00. Report accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden. All aye, motion carried. February Ambulance report submitted by Stan In receipt of $100.00 donation in February. The ambulance service answered 39 calls; 4 BLS, 15 ALS, 8 no transport; 1 cancelled calls; 1 air medical. Total calls to date 65. Of these 39 calls, 2 in the Village, 12 in the Town of Sterling, 2 in Martville, 8 mutual aid to Lakeshore Ambulance; 4 mutual aid to CIMVAC. Vehicles responding to calls: 19 for Ambulance 9 for Medic Car, 3 for both the medic car and ambulance together. Response time 3.19 minutes. Report accepted on a motion by Trustee Dunaway and seconded by Deputy Mayor Krehling. All aye, motion carried. Stan will notify MultiMed to update the billing system to reflect village residents will not be subject to collections as stated when the ambulance service billing was originally set up. February Code Enforcement report submitted by Stan 4 building permits issued; 5 violation letters issued; 3 stop work orders issued; 1 unsafe structure order issued; 6 on site inspections performed; 4 general village inspections conducted. Stan briefed the Board on the Code Enforcement training he had recently attended. Report accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Webster-Goolden. All aye, motion carried. UNFINISHED BUSINESS: The “Vehicles & Traffic Article IV Parking Prohibitions” amendment and sewer law revisions regarding 100 feet are with Attorney Palermo. NYSERDA Clean Energy Communities Program: working on action items “Clean Energy Upgrades” and “Energy Code Enforcement Training”. In receipt of $2,500.00 for unified solar permit. The spot for the community garden has been staked out in the park behind the village hall and agreed upon by the Board of Trustees and garden committee. Susan Gateley submitted a sample form for release of all claims and will be submitting a formal proposal with plot plan including the fence. This will be a one year proposal and if it doesn’t work out, the area will be restored to its original state. They currently have six people interested and would like to get started by the end of May. Mayor Basile has been in contact with Planning Board Chairman Darrell Uetz regarding the Comprehensive Plan. Both the Village and Town of Sterling Planning Boards may be working together to update the Comprehensive Plans. NEW BUSINESS: The2017-2018 Budget Hearing, Organizational Meeting and Public Hearing on Local Law #2 of 2017 authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c are scheduled for April 10that 6:30pm. Stephan House has been in contact with Mayor Basile regarding the establishment of a historical district in the Village. It was suggested he submit names to the Board to form a committee. Mayor Basile clarified, village employees must be responsible for attending the training classes they sign up for as some of this training is costly. ---PAGE BREAK--- 3 Village Attorney Palermo sent a communication clarifying a local law must be enacted by the Board of Trustees to appointment a nonresident official. There is no residency requirement to hire regular employees. The Board will be reviewing all appointed positions within the Village for consideration to expand into nearby counties for future appointments. 3 Planning Board, 1 ZBA and 1 ZBA alternate positions up for reappointment. These positions have been advertised and the members up for reappointment have been notified to respond if they wish to continue to serve. These appointments will be made at the organizational meeting on April 10th. Homeland Security training will be held April 3rd 6:30 pm in Auburn. Mayor Basile, Deputy Mayor Krehling, Clerk-Treasurer DiGregorio, Deputy Clerk Van Der Linden and POC Cathy Byers will be attending. Businesses and residences in the central business district and Bayfront district that have not connected to the public sewer will be sent violation letters as they should have been connected by now. The remainder of the Village of Fair Haven must be connected by October of 2017. The Board of Trustees approved revisions to the Employee’s Handbook on a motion by Trustee Webster-Goolden and seconded by Deputy Mayor Krehling. All aye, motion carried. All village employees will be supplied with pages containing the revisions to add to their handbook and asked to sign a new acknowledgement form. A list of substitute snow plow drivers will be established. Trustee Dunaway attended a meeting on the proposed walking trail to extend along West Bay Road to the West Barrier Bar Park. It was suggested to as Thoma Development if there were any grants available to assist with this project. The Town of Sterling also uses Thoma Development as a grant writer. On a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden the Board entered into executive session at 9:18 p.m. to discuss the performance of a particular employee. All aye, motion carried. On a motion by Trustee Dunaway and seconded by Trustee Webster-Goolden the Board existed executive session at 9:47 p.m. All aye, motion carried.
