TOWN OF STERLING PLANNING BOARD MEETING September 27, 2018 A Special meeting of the Town of Sterling Planning Board was held on Thursday September 27, 2018, as a rescheduled date for their October 4, 2018 meeting, at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Vernon Bishop ~ Member Paul Kelley ~ Member Scott Crawford ~ Member Also Present: Jim & Karen McIntyre, James Iannettoni, Town Councilor Joan Kelley, Jodi Sheldon, Heather Weitzner, Thomas McIntyre and Art & Marjorie Shortslef. The meeting was called to order at 7:01 pm by Chairman Ouellette. PUBLIC HEARING James & Karen McIntyre; Property owner Louis Iannettoni Family Trust Chairman Ouellette read aloud the legal notice and opened the Hearing at 7:02 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Thursday September 27, 2018 at 7:00 PM at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by James & Karen McIntyre for property owned by the Louis Iannettoni Family Trust will be heard regarding the Minor Subdivision of property located at 16291 Ontario Shores Drive, Sterling, NY 13156; Tax Map # 2.00-2-10.1. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board, Lisa Somers, Clerk Chairman Ouellette asked the applicants to explain their subdivision request. James McIntyre stated that they were subdividing their neighbor’s property on Ontario Shores Drive to gain an additional 99 feet of road frontage with a parcel size of 1.07 acres. James Iannettoni was also present and agreed to subdivide the property with the neighbor to allow them a larger buffer area between the McIntyre’s house and theirs in case they ever sell. The map needed only a minor change of Final in the title block which had been done. Chairman Ouellette opened the Hearing to public comments – there were none. The Board Members completed Parts 2 and 3 of the SEQR short form EAF aloud. With no further comments from the Board or public, and on a motion by Member Kelly that was seconded by Member Allen, the Hearing was closed at 7:10 pm. A motion was moved by Member Crawford to accept a Negative Declaration for the Unlisted Action of the Minor Subdivision of Iannettoni property by James & Karen McIntyre. The motion was seconded by Member Kelley, all were in favor and the motion carried. A motion to approve the requested subdivision was moved by Member Allen and seconded by Member Bishop, all were in favor and the motion carried. Resolution 2018-05 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Minor Subdivision by James & Karen McIntyre of property owned by Louis Iannettoni Family Trust and located at 16291 Ontario Shores Drive, Sterling, NY 13156; Tax Map #2.00-2-10.1 is ---PAGE BREAK--- hereby GRANTED upon the following express conditions: Must be filed with Cayuga County within 62 days. Roll call vote was taken: Chairman Ouellette Aye Member Allen Aye Member Bishop Aye Member Kelley Aye Member Crawford Aye 5 AYES 0 NAYES 0 ABSTENTIONS – APPROVED BUSINESS Heather Weitzner – Sketch Plan Conference for proposed café and sandwich shop Ms. Weitzner approached the Board for direction on how to proceed with developing a business on a property that she would like to renovate and operate a café and sandwich shop. The property is located near the intersection of State Routes 3 and 104A (1661 State Route 3) and is situated along the recreational trail owned by Cayuga County. She explained that she lives a short distance away from the property on Onionville Road and feels the property has potential for her to start her own business. She stated that there is nothing close by to that area where you can get a quick coffee, beverage or sandwich which indicates a need for the business choice. The location is convenient for passerby traffic to Fair Haven State Park, Renaissance Faire and people using the County Trail with dirt bikes, four wheelers and snowmobiles. She provided overview maps of the property, photos of the current structures, property details from CC Real Property, and a short narrative of proposed commercial use with an action list. She described the structure interiors as rough but sturdy without rot and decay but needing cleaning and renovation. The property will require total development of a well and septic system with electrical, plumbing, furnace installation, ducting, sealing and finishing work. Heather Weitzner asked the Board if they felt the project would be acceptable to the Town and if she should pursue the purchase. The Board members reviewed the LUR Usage Chart and found that #43 Restaurant including Fast Food was permitted in the A/R district with Planning Board action of Special Use Permit application. They explained the process would take a couple of meetings and she would need to develop a site plan illustrating the parking. exterior lighting, signage and other elements of her business. She would also need a narrative explaining the business operation. The project would need submission to the 239 Review Committee because of the proximity to the County owned trail property but the Board did not foresee any issues. The members discussed the historical usage of the building that was built in 1900 and serviced the communities grain processing with the railway that existed before the County Trail was developed. The barn had a mill and provided feed and seed to the community much like an Agway business does. Member Crawford stated that the business was in operation when his daughter was young and is a landmark to many area residents; he was in favor of her business idea and suggested that she draw out the history and significance of the property to draw in local business. He also commented on a local author’s book called Rails, Trails and Sails by Ray Sant which contains a lot of information regarding the structures she intend s to buy. She replied that there were several old large signs on the property that she plans on decorating with. Member Crawford also suggested that she look into the possibility of grant money for restoration of building s having historical significance. Member Allen was also aware of the book and history of the ---PAGE BREAK--- property and offered the Sterling Historical Society as an avenue of information for her. Heather Weitzner stated that she would need some further professional inspections to determine the soundness of the structure and feasibility of water and septic with over all costs of renovation before proceeding but that any purchase offer made would include obtaining Town approval of a Special Use Permit via the Planning Board. Marjorie Shortslef – Sketch Plan Conference – Minor Subdivision Marjorie Shortslef and other family members approached the Board to discuss subdividing property belonging to their father, Paul McIntyre. The property is a large farm of more than 200 acres which straddles Sterling Creek from Cooper Bluff Road (near McIntyre Road intersection) and extends southward until the Creek splits and flows east and west. The family would like to create 4 parcels total as follows: 1. Farmhouse and 5 to 6 acres of land. 2. Small parcel (2 acres) with barn for family member. 3. Agricultural farm acreage. 4. Small parcel near creek and towards southern end of property for family member. The Board discussed the proposed subdivision classification as a major subdivision because of the creation of 4 lots which has a higher application fee. The applicants had various maps generated from google and Cayuga County real property which were difficult to interpret and locate property lines and structures. The applicants stated that they received two tax bills therefore two separate parcels exist but it was unclear which properties were involved. The Board referred the applicants to Lezli Parsons to determine the parcel tax numbers and boundary lines. The Clerk supplied the applicants with an application and EAF form. Kimberly Duffy – Minor Subdivision A subdivision application that had been filed by Kimberly Duffy and processed through the Planning Board has been rescinded in writing and is no longer actionable by the Planning Board. Original paperwork submitted has been requested to be returned to the applicant, copies will be retained for planning board property file. MINUTES A motion to approve meeting minutes with correction for September 6, 2018 was moved by Chairman Ouellette and seconded by Member Kelley. All were in favor without further discussion and the motion passed. PRIVILEGE OF THE FLOOR Town Councilor Joan Kelley updated the Board that the Comprehensive Plan Update was completed and approved on September 24, 2018 with a joint Public Hearing with the Village of Fair Haven and completion of SEQR. A single correction on pages 12a and 32 is yet to be made to specify that the barrier bar is in the northwest corner of the bay, not the northeast corner.
