Public Hearing on Proposed Scipio Zoning Law Wednesday, September 9, 2015 at 6:30 pm This Public Hearing on the proposed Scipio Zoning Law was called to order by Town of Scipio Supervisor Janet Reohr at 6:30 pm on Wednesday September 9, 2015 at the Scipio Town Barn. Present were: Supervisor: Council Members: Janet Reohr Howard Nelson Greg Rury Keith Welch Gary Whitten Deputy Town Clerk: Dodie Rowlands Presenters: Jeanie Gleisner Tom Olenych _ Mark Vorreuter Guests: Keith Batman, Leslie Baxter, Ron Curvin, Gary Gordon, Tom Higgins, Randy Lawrence, Gary Mutchler, Bill Nivison , Code Enforcement Officer Mick Piechuta, Ken Post, Miguelina Cuevas-Post, Ann Robson , Andrew Simkin, Town Attorney David Thurston. Copies of Public Hearing Process and Summary of Zoning Law were distributed . Official announcement of the Hearing as published and posted was read. Supervisor Reohr reviewed the Guidelines for the Public Hearing to ensure that all are heard in a respectful and productive manner. She stated that this hearing is an opportunity for all to be heard ; there will be no voting on the Zoning Law tonight. She expressed thanks to the Zoning Commission and especially to Jeanie Gleisner of Central NYS Planning and Development for her invaluable help and support. Tom Olenych reviewed the many-year process leading to this current proposed Zoning Law, based on the Town 's Comprehensive Plan which was approved in May 2011. Mark Vorreuter presented information and photos about the proposed Zoning Law. Responses to a town-wide survey prior to formulation of the Comprehensive Plan indicated that the rural character of the town was of primary importance to residents. So the goal was to make a Zoning Law that allows for some planned development while protecting the environment , including agriculture, lakefront, watershed , wood lands, open land, and views. The major change in the Zoning Law is to provide for subdivision with conservation a primary concern. The Town 's previous Zoning Law did not address subdivision at all, which left no protection for any of these sensitive areas. The proposed Zoning Law establishes two main land use districts: Agricultural/Residential and Hamlets (Scipio Center, Scipioville, and Sherwood), and two overlay districts with special concerns (waterfront and light commercial/ind ustrial). Jeanie Gleisner outlined the subdivision options described in the Zoning Law. The first step in each is a pre-application meeting with the Planning Board . The floor was opened for comments, questions and concerns. ---PAGE BREAK--- Among the issues raised were: definition of road cuts as opposed to driveways length of docks noise regulations exclusion of farmers in prohibiting fence in public right-of-way no encumbrance to ingress or egress 50 feet from high water mark enforcement of Zoning Law concern for whole watershed , not just lakefront definition of "stable" prohibiting lake rights to others clarification of "mobile home" prohibiting underground fuel tanks s1gnage renting rooms references to 1990 Zoning Law after stated to have been repealed use of word nuisance referring to agriculture Those who spoke introd uced themselves and observed Public Hearing Guidelines. Jeanie Gleisner answered questions, and expressed appreciation for all input. She said all comments from residents are valuable in putting together a Zoning Law which will work for the current and future residents of Scipio. The Zoning Commission will be meeting soon to address the issues raised. Tom Olenych introduced the members of the Zoning Commission and offered an opportunity for them to share any thoughts. Tom Olenych stated that responses to comments and questions will be posted on the town 's website . Supervisor Reohr opened the floor for any further comments . She announced that any further questions or concerns may be addressed to the town email [EMAIL REDACTED]. The meeting was adjourned at 8: 12 pm.
