VILLAGE BOARD MEETING AUGUST 24, 2015 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Mill Stream residents Mary Lou Dunham and Alberta Border, Four Town Ambulance members Peter Breese, Matt Smokoski, Tamara Perry, Terry Lamphier, and David Nelson (Cayuga County Planning Department) were also present. Village of Moravia Planning Board Chairperson Paul Nelson entered at approximately 7:01 p.m. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · ALBERTA BORDER (SIDEWALKS IN VILLAGE) Alberta Border, resident of Mill Stream, addressed the Board with her concerns of the poor condition of many sidewalks within the Village. She distributed pictures of many of the bad areas, along with a newspaper article pertaining to dangerous sidewalks in the City of Cortland. She also noted low tree limbs and overgrown shrubs that make walking difficult within the Village. She brought up concerns for sidewalks that are not shoveled during the winter time. Mayor Mulvaney stated that the poor condition of the sidewalks have been an ongoing concern and explained the financial strain that it would cause many of the property owners if the local law was enforced. (Local Law #1 of 1997 “Sidewalk Repair and Maintenance” was given to Alberta Border, Mary Lou Dunham, and each of the Board members.) Mayor Mulvaney also told them that letters are continuously being sent to the property owners during the winter months when their sidewalks had not been shoveled within a timely manner. On another note, Alberta Border and Mary Lou Dunham stated their dismay about the weeds growing up along the Mill Stream creek bed and blocking their “view.” Mayor Mulvaney stated that the Army Corps of Engineers had just inspected the creek bed and would be sending their report to the NYSDEC. He stated that the NYSDEC was notified by the Village Clerk and would check to see if they found this particular area to be addressed. The Board thanked Alberta Border and Mary Lou Dunham for coming with their concerns. · MINUTES A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the August 10, 2015 Village Board Meeting, as amended. · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the following bills. · DEPARTMENT REPORT A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of July. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS ---PAGE BREAK--- Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney stated that the water meters that the Village had been purchasing are no longer available from EJP that the Village had been working with. However, they are offering a different meter that is compatible at approximately $50.00 less per meter. Mayor Mulvaney noted that twenty-four (24) new meters had been ordered. · VILLAGE ORDINANCES Mayor Mulvaney reported that there was no news on the Village Ordinances; specifically the penalties for offenses for a new parking law. · WATER LEAK DETECTION UPDATE Mayor Mulvaney reported that there was no news on the water leak detection. · FOUR TOWN AMBULANCE 2015-2016 CONTRACT AND RESOLUTION Peter Breese, Treasurer of Four Town Ambulance, explained in more detail the answers to the Village’s questions concerning how the contract amounts are figured. Mr. Breese stated that the Village’s contract for 2015-2016 was $21,551.72. After much discussion, the Board thanked the Four Town Ambulance for attending the Board meeting. The Four Town Ambulance 2015-2016 Contract and Resolution were tabled until the next regularly scheduled Board meeting so that the contract could be verified by the Village. · CABLE AGREEMENT Each of the Trustees received a copy of the check for the 3% Moravia Village Franchise Fee from Southern Cayuga County Cablevision for July-December 2014. Mayor Mulvaney stated that he spoke with the cable owner, Ray Dyer, and was told that Mr. Dyer was currently waiting for his renewal certificate from New York State. · CAYUGA COUNTY PLANNING DEPARTMENT (SITE PLAN REVIEW, ETC.) Each of the Trustees received a copy of the following that the Village of Moravia Planning Board had been working on: ---PAGE BREAK--- 1. Zoning and Land Use Code: Section 803: Parking Lot Landscaping code draft 2. Zoning and Land Use Code: Section 903: Amendment to Buffer Strip Required code 3. Zoning and Land Use Code: Article XV: Site Plan Review code draft 4. Site Plan Review Application draft 5. Completed SEQR Form 6. Unified Solar Permit information Cayuga County Planner, David Nelson, addressed the Board reviewing a draft of the Site Plan for the Village of Moravia. He then proceeded to propose two amendments to the Village’s Zoning Law pertaining to parking lots and buffer strips. The Board recommended some changes, which David Nelson stated that he would do and submit a revised copy to Village Clerk Anne Riddell and to the Village Planning Board Chairperson Paul Nelson. David Nelson also copied the Board on the completed SEQR Form that the County would file on behalf of the Village, which was a necessary step in order for the Village Board to adopt the Site Plan and the two proposed amendments. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: - Town of Moravia Minutes (06/17/15). - Cayuga County Association of Villages Minutes (06/23/15). Mayor Mulvaney reported that there was an anonymous telephone call to the Village Office stating that they had observed a woman walking a dog and dumping the dog’s feces into a storm drain. The caller stated that she thought that was not allowed and wanted to bring it to the Village’s attention. Mayor Mulvaney stated to the Board that the office had past reports on this and that Village Clerk Anne Riddell had posted on the Village’s Face Book page that there is no dumping allowed in the Village storm drains because they all lead to the Owasco Lake. The Board suggested this information also be inserted into the next water/sewer billing. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to adjourn at 8:48 p.m. Anne Riddell – Village Clerk
