TOWN OF SUMMERHILL May 8, 2018 Town Hall 13606 State Route 90 Locke, NY 13092 Town Board Members Present: Susan Stout, Supervisor Duane Reynolds, Councilman (9:00) Christopher Ryan, Councilman Mary Osgood, Councilwoman Daniel Ripley, Councilman Town Board Members Absent: None Other Town Officers Present: John Kirk, Barb Harvey, Linda Wright, and Christina Ripley Residents: Don Forster, Gary Lansdowne Visitors: None Guests: Shane Baldino Recording Secretary: Carol Chase The meeting was called to order at 7:00 pm by Susan Stout. All stood for the pledge to the flag. Motion 37 – 2018 Resolution to Appoint Shane Baldino to the Planning Board: After interviewing Mr. Baldino, Mary Osgood made a motion a motion to appoint Shane Baldino to the Planning Board to fill out Christina Ripley’s tem, seconded by Duane Reynolds. Carried 4 ayes Stout, Reynolds, Ryan, Osgood 0 nays Resolution to Appoint Peter Contento to the Board of Assessment Review: Executive Session: Motion 38 -2018 Mary Osgood made a motion to go into Executive Session to discuss Board of Assessment Review positions at 7:09 pm, seconded by Chris Ryan. Carried 4 ayes Stout, Ryan, Reynolds, Osgood 0 nays Motion 39-2018 Mary Osgood made a motion to come out of Executive Session at 7:15 pm, seconded by Susan Stout. Carried 4 ayes Stout, Osgood, Ryan, Reynolds 0 nays Motion 40-2018 Duane Reynolds made a motion to table the appointment of Mr. Contento to the Board of Assessment Review, seconded by Mary Osgood. Carried 4 ayes Stout, Osgood, Ryan, Reynolds 0 nays Minutes of the April 10, 2108 meeting: Motion 41-2018 Mary Osgood made a motion to accept the minutes with the correction of the word ”morion” under Minutes of the March 13 meeting, seconded by Chris Ryan. Carried 4 ayes Stout, Reynolds, Ryan, Osgood 0 nays REPORTS A. Town Clerk’s Report: $69 was collected for the month of April. The Clerk has settled the taxes with the County treasurer. Motion 42-2018 Duane Reynolds made a motion to accept the Clerks report as presented, ---PAGE BREAK--- seconded by Chris Ryan. Carried 4 ayes Stout, Reynolds, Ryan, Osgood, 0 nays B. Supervisor’s Report: Susan Stout; Balance of Accounts as of April 30, 2018 Motion 43-2018 Chris Ryan made a motion to approve the Supervisor’s report as presented, seconded by Duane Reynolds. Carried 3 ayes Ryan, Reynolds, Osgood 1 abstain Stout 1. General Money Market Fund: $105,978.71 2. Highway Money Market Fund: $337,846.03 3. General Consolidated Fund: $100.00 4. Trust & Agency: $100.00 5. Sara Grant Fund: $0.00 6. Fire Protection Fund: $0.00 7. Equipment Reserve $605.79 C. Code Enforcer’s Report: Kevin McMahon, 1 building permit issued, 1 building permit inquiry, 3 Certificate of Occupancy issued, 1 certificate of compliance issued,7 plan reviews for permits, $28.00 in fees collected, $8000 in construction cost this month, 12 site/driveway visit inspections, 2 foundation /footers /posthole inspections, 4 framing/structural inspections, 4 Final/ pre-final inspections, 6 training hours completed. D. Dog Control Report: Lindsay Anderson, March report, 14 complaints, 1 dog seized and sheltered, 1 dog redeemed, 1 dog advertised, 1 redemption fee collected, 31 hours worked, 190 miles driven for the town. E. Highway Superintendent’s Report: John Kirk, He was originally going to repave Fillmore Rd, but because New visions will be working along that road, he decided to work on the south end of Lick Street. He is also doing Hatfield Road. East Lake Rd. and Fillmore will be done after New Visions is done. Ripley Farms needs to clean up Fillmore Rd. as well as Eaton Road. Chris Ryan will call the Sheriff and have them stop at Ripley farms. John has been speaking with Phelps Sungas to negotiate a price for propane. June 2nd is Clean up day and volunteers are welcome. F. Assessor Report: Linda Wright, She gave the Board a sheet on the Town’s Total value, she says to remember to deduct the state land from the total before figuring your town tax rate. The County collects for the State land and she suggests we send a certified letter to the Treasure and ask what is done with that money. She has the assessment changes and exemption changes sent out to the residents affected. G. Variance Board: No Report H. Planning Board: Barb Harvey, Their next meeting is May 17. They have held 2 survey workshops and they did not have a quorum for the April meeting. They have the final version of the tallying. I. Board of Assessment Review: No Report J. Historians Report: No Report K. Town Justice: Sherry Davenport, 31 cases, $2045.97 in fines, $220 in Civil fees, and $1911 in surcharges for a total of $4176.67. OLD BUSINESS A. Special Meeting April 30, 2018: There was a special meeting on April 30 to clean out and sort the stuff on the porch and in the back storage room. Mary Osgood, Duane Reynolds, Susan Stout, John Kirk and Jennifer Hogan sorted the items and labeled them for Junk day or garbage. B. Update on Roof Repair: An ad has been placed and we are waiting for contractors to pick up bids. The bids will be opened and awarded at the special meeting Tuesday May 29 at 7pm. ---PAGE BREAK--- C. Update on New Visions: Nothing new, everything is on hold. They are waiting for the cable supply and permission from the County to work on County roads. D. Work day Resolution: This applies to all employees that are part of the State Retirement system. Duane Reynolds would like the employees to sign the calendars they have submitted. Motion 44-2018 Mary Osgood made a motion to table this until the June meeting, seconded by Chris Ryan. Carried 4 ayes Stout, Ryan, Reynolds, Osgood 0 nays E. Resolution to change the Town’s Workmen Compensation Provider: Motion 45-2018 A resolution was made by Mary Osgood to accept the change in the Town’s workmen compensation provider from Comp Alliance and to 497 New York State Public Entities Safety Group managed by Glatfelter Brokerage Group, seconded by Duane Reynolds. Carried 4 ayes Stout, Ryan, Osgood, Reynolds 0 nays F. Cold War Exemption: We need to pass a new local law to change a local law. G. Scholarship Applications: Executive Session Motion 46-2018 Susan Stout made a motion to go into Executive session to discuss the applications at 8:20pm, seconded by Duane Reynolds. Carried 4 ayes Stout, Ryan, Reynolds, Osgood 0 nays Motion 47-2018 Susan Stout made a motion to come out of Executive session at 8:33pm, seconded by Mary Osgood. Carried 4 ayes Stout, Reynolds, Osgood, Ryan 0 nays Motion 48-2018 Mary Osgood made a motion to award one scholarship to Bethany Kulas of Moravia High School, seconded by Chris Ryan. Carried 4 ayes Stout, Ryan, Reynolds, Osgood 0 nays H. Supervisor to attend Finance School: Susan Stout will be attending Finance School in Ellicottville from Wednesday to Friday. I. Sherman Gulf Rock Wall: There is nothing new to report. J. Review of the 1991 Site Plan Review law: Tabled until after the August training on Site Plan review. K. Procedure for Recommendations from the Planning Board when a New Business Comes into Town: The Town Board would like the Planning Board Secretary to email them the minutes from their meetings. L. Updated Rules of Procedure, Code of Ethics and Conflict of Interest, and Employee Handbook: Motion 49-2018 Mary Osgood made a motion to table this until the July meeting, seconded by Dan Ripley. Carried 5 ayes Stout, Ryan, Reynolds, Ripley, Osgood 0 nays M. Clean Up Day: Saturday June 2 from 8am-2pm N. Florence Lansdowne Memorial: June 16 from 2pm-4pm with a luncheon to follow at the Town hall. Dan will provide chocolate milk and cheese. Carol will call people about dishes to pass. NEW BUSINESS ---PAGE BREAK--- A. Board of Assessment Review: Motion 50-2018 Chris Ryan made a motion to remove Mike Cody from the Board of Assessment Review, seconded by Mary Osgood. Carried 5 ayes Stout, Ryan, Ripley, Reynolds, Osgood 0 nays RESIDENT ISSUES 1. Don Forster- He would like better monitoring for snow drifting on Salt Rd. between Route 90 and Montgomery Rd. and further south where drifting closes one entire lane. His son hit a drift and ended upside down in the ditch. The Board will follow up with the Highway Superintendent. 2. Gary Lansdowne- Lake Como Association will be meeting Saturday May 26 at 10 am at the Lake Como Inn. Gary asks permission to put what they collect on the Lake Como cleanup in the dumpster. They will be meeting at Fire Lane at 8:30 am if any one would like to volunteer. He also asks permission to use the parking lot for their annual chicken barbeque on July 28, 2018. Lake Como Association has agreed to another $250 donation to the scholarship. Audit- Clerks and Collectors books- tabled until June. PAYMENT OF BILLS There were 17 General account bills, vouchers 112-128, totaling 3,879.17 and 10 Highway account bills voucher numbers 129-138 totaling $23,586.49 presented for payment Motion 51-2018 Dan Ripley made a motion to approve payment of these bills, seconded by Duane Reynolds. Carried 5 Ayes Stout, Ryan, Ripley, Reynolds and Osgood 0 Nays The next regular Town Board meeting will be June 12, 2018 at 7pm. There will be a Special Board meeting to open bids on the roof project May 29 at 7pm. Motion 52-2018 A motion to adjourn was made by Duane Reynolds, seconded by Susan Stout.
