Scipio Town Board Meeting The regular public meeting was called to order at 7:00 PM on Wednesday July 19, 2017 by Supervisor Mutchler with the following people present. Supervisor: Gary Mutchler Town Clerk: Tom Olenych Town Board Members: Howard Nelson Highway: Mark Chamberlain Leslie Baxter Code Enforcement: Mick Piechuta Mark Ferrari Gary Whitten Guests: No guests. Motion to approve agenda for the July 19, 2012 town board meeting. (Mutchler / Nelson) All in favor. Issues to come before the board from town residents and guests. There were no issues from town residents. Motion to approve the minutes of the June 14, 2017 town board meeting. For clarity reasons, it was decided the June minutes would be amended to more accurately depict the Allen Farms project and would be approved at the August 9, 2017 town board meeting. Town Board Members reports: Leslie Baxter: 1) the contract letter from the Dave Thurston, the town’s attorney to Allen Farms LLC was read and discussed with the town board members generally agreeing this document accurately reflects the towns concerns and the town’s position regarding the Allen’s new barn project. The board questioned whether the Allen’s could continue with the project if they elect not to sign the contract. Yes, they could continue but the town has the authority to regulate what flows through the town’s culverts and ditches. Gary Mutchler the town supervisor will sign the document and it will be mailed certified mail / receipt requested to the Allen’s. Motion to approve the contract letter to the Allen Farms LLC. Gary Mutchler AYE Leslie Baxter AYE Howard Nelson AYE Gary Whitten NAY Mark Ferrari AYE Motion is approved. 2) Leslie attended the water shed meeting in Auburn as well as other public meetings regarding the water quality in Owasco Lake, answering questions from residents and recruiting people for the rules and regulations committee. ---PAGE BREAK--- 3) Leslie reported on July 18th. she attended the Owasco Lake Water Quality Management meeting. The permits needed to begin work on the blue / green algae problems at the south end of Owasco Lake have not yet been issued so this is still on hold. 4) Leslie will contact Dr. Benson to see if he will hold a rabies clinic in the fall. She will try to get that information in time for the Fall Newsletter. Mark Ferrari: 1) Mark took the measurements of the town offices from which he will produce a 3D model for the board’s review. Mark will also produce a spec sheet and a cost projection to be reviewed by the town board members. Howard Nelson: 1) passed out copies of the Letter of Intent, to be sent to Abundant Solar, to be reviewed by the board members. Howard emphasized this is a non-binding letter and poses no risk to the town if signed. It is only needed for the town to go forward with the solar panel project and for Abundant Solar to provide the town with an estimate of the costs of the project. Motion to approve Supervisor Mutchler signing Letter of Intent. (Nelson / Ferrari) All in favor. 2) Howard reported that on average it looks like there are between 10 and 15 people using the transfer stations during the summer Wednesday hours. Town Supervisor’s report: 1) Supervisor Mutchler read the Planning Boards letter, regarding the permitting of a wind turbine on Melvin Kurtz’s property on Gilling Road, to the town board members. After a brief discussion, it was agreed there is no reason to hold up this project. Mick Piechuta the town’s code enforcement officer, will issue the permits needed as soon as he receives the permit fees from United Wind who is erecting the wind turbine. 2) Supervisor Mutchler asked the board to approve the following transfer of funds. From: A1990.41 Contingent $25.00 To: A8010.4 Zoning Officer Contractual From: DA911 Unappropriated Fund Balance $75,000.00 To: DA5110.4 Repair of Roads Contractual Motion to approve transfers of funds. (Mutchler / Whitten) All in favor. Town Officers reports: Assessor: 1) There was no report from the town assessor. Town Clerk: 1) Tom Olenych told the board he had attended a meeting of the Zoning Board of Appeals, at the request of Keith Welch who chairs the ZBA, for the purpose of taking the minutes of that meeting. A copy of the minutes was passed out to the board members. 2) Tom also told the board he has started the task of collecting old town documents for the purpose of destroying that which can be destroyed and keeping those records that are permanent and cannot be destroyed. ---PAGE BREAK--- This will not be as easy as he had hope because some of the contents of the first permanent file box he started contained documents other than what the box should have contained. There was also some discussion as to how to destroy those documents that are not permanent and have used up their shelf live. Tom will look into this and should be able to discuss further at the August town board meeting. Highway Superintendent: Mark Chamberlain told the board his crews have been busy mowing, chinking and oiling and chipping town roads. In addition, Scipio helped the Town of Venice lay an 80’ pipe. Code Enforcement: Mick Piechuta provided the board members with a written report outlining his activities for the month with regards to permits issued, inspections, visits and meeting he has had with town residents. Mick also told the board that, although the progress was slow regarding the properties in violation in Scipioville, he had met with the property owners and is confident the situation will improve and the violations will be corrected. Other Business: There was no other business. Approval of vouchers: General Fund 101 – 115 totaling $18,842.46 (Nelson / Whitten) All in favor.
