VILLAGE BOARD MEETING JULY 10, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:02 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, and Village Attorney Charles Marangola were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the June 26, 2017 Village Board Meeting. · BILLS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bills #43 and 50 due to conflict of interest.) · TRANSFER A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the following transfer: From: A1990.4 Contingent To: A1450.4 Election $ 100.00 · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Treasurer’s Report for the month of June. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Public Works Report for the month of June. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of June. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of June. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Police Report for the month of June. Each of the Trustees received a copy of a Memorandum of Understanding from Officer In Charge Robert Brown pertaining to having a medical drop box at the Village Justice Center. After some discussion and questions, the Board requested Officer Brown to attend the next regularly scheduled Board meeting. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Code Enforcement Report for the month of June. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of June. ---PAGE BREAK--- There was no Dog Control Report or Justice Report for the month of June. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES This item was tabled until the next regularly scheduled Board meeting due to several open projects that the Board is currently working on. · ZONING AMENDMENTS (PB) – SITE PLAN REVIEW Each of the Trustees received a copy of the following resolution pertaining to Local Law #3 of 2017. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 5-0 vote to approve the following resolution. WHEREAS, the Village of Moravia seeks to amend its comprehensive zoning and land use law and add Article XV for site plan review and approval within the Village, by the passage of proposed Local Law No. 3 of the year 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’ and WHEREAS, no other agency has the legal authority or jurisdiction to approve or directly undertake the enactment of a local law in the Village of Moravia, such that there are no other involved agencies within the meaning of the New York State Environmental Quality Review Act (SEQRA) with respect to the enactment of said Local Law No. 3 of the year 2017, with the result that the Village Board of Trustees shall act as lead agency in this matter: and NOW, THEREFORE BE IT RESOLVED, that the Village Board of the Village of Moravia hereby determines that: 1. The action is an Unlisted Action; 2. The Village Board of the Village of Moravia shall act as lead agency; 3. The Town of Moravia, Moravia Fire Department, and the Cayuga County Department of Planning and Economic Development are interested agencies in connection with the SEQRA review; 4. The action will require the preparation of a Short Environmental Assessment Form to provide information with regard to the environmental issues pertinent therein; and it is further RESOLVED, that the Village of Moravia shall hereby notify all interested agencies that it shall be lead agency for this action unless it receives written objection to this determination within thirty (30) days from the date of mailing of such notice; and be it further BE IT FURTHER RESOLVED that proposed Local Law No. 3 of the year 2017 and any other documents with respect to the proposal be submitted to the Cayuga County 239 L&M Committee as required under New York State General Municipal Law §239, m, for review and comment; and be it further RESOLVED, that the Mayor of the Village of Moravia is hereby directed to sign the Short Environmental Assessment Form Part 1 – Project Information with respect to this Local Law, and is hereby further authorized to sign any other ---PAGE BREAK--- forms and documents in connection with said Local Law; and be it further RESOLVED, that the Village Board of the Village of Moravia will conduct a Public Hearing at the Village Offices on September 11, 2017 at 7:00 p.m., or as soon thereafter as the matter can be heard, for the purpose of taking public comment on, and giving due consideration to, the enactment of proposed Local Law No. 3 of the year 2017; and be it further RESOLVED, that a copy of said Local Law is available at the Village Clerk’s Office for public inspection during regular business hours; and BE IT FURTHER RESOLVED, that the Village Clerk be and hereby is authorized and directed to publish notice of said Public Hearing in the official newspaper. He stated that he would research this item further and report back to the Board. · POLICE POLICIES The Mayor reported that there was no news on the drafted police policies. This item was tabled until the next regularly scheduled Board meeting. · PARK STREET RESIDENTS (SPEED CALMING MEASURES) Each of the Trustees received a copy of a letter that would be sent pertaining to the speed calming measures that had been taken on Park Street per the residents’ request. The Board agreed to send the letter. This agenda item will be moved to the Quarterly Open Agenda Items. · ZONING BOARD AND PLANNING BOARD APPLICATION (MANNA) Each of the Trustees received a copy of a Zoning Board application and a Planning Board application from Maria Manna. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to accept and place on file the applications from Maria Manna for Zoning Board and Planning Board. · PLANNING BOARD APPLICATION (MARNELL) Each of the Trustees received a copy of a Planning Board application from Joshua Marnell. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to accept and place on file the application from Joshua Marnell for Planning Board. · 2017/2018 FISCAL YEAR APPOINTMENTS A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following annual appointments: (Trustee McGuerty abstained from voting on the Official Newspaper.) Dates & Time – every 3rd Monday of every month at 7:00 p.m. Zoning Board Member – Maria Manna Planning Board Member – Joan Ferreira and Joshua Marnell COMMITTEE APPOINTMENTS Water Department – Gary Mulvaney Sewer Department – Gary Fickeisen & Chris Fulton Police Department – Gary Mulvaney & Gary Fickeisen Streets & Sidewalks – Nancy McGuerty & Chris Fulton Equipment – Tony Peppe & Gary Fickeisen Intermunicipal Representatives – Nancy McGuerty & Tony Peppe Summer Recreation Program Representative – Tony Peppe · QUARTERLY FAIR HOUSING PUBLIC NOTICE A motion was made by Trustee Peppe seconded by Trustee Fulton and carried with a 4-0 vote to approve the advertising of the Quarterly Fair Housing Public Notice. · CONFLICT OF INTEREST Village Clerk Anne Riddell distributed the Annual Conflict of Interest Disclosure Forms to the Village Board and to all the employees of the Village. Mayor Mulvaney requested that the forms be completed, signed, and returned at the meeting. · VILLAGE ATTORNEY ANNUAL AGREEMENT (LETTER OF ENGAGEMENT) Each of the Trustees received a copy of the 2017-2018 Village Attorney Charles Marangola’s Letter of Engagement in the amount of $6,250.00 per year to be paid quarterly. Attorney Marangola addressed the Board stating that he now has a program that can generate a report on the amount of hours he spends on the Village’s legal services. He noted that in the future the Village would be billed for hours that exceeded the yearly retainer amount (50 hours) at the rate of $125.00 per hour. (The Board requested he give a quarterly report on the hours spent.) A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve and authorize Mayor Mulvaney to sign the Letter of Engagement from Village Attorney Charles Marangola for 2017- 2018. ---PAGE BREAK--- · EMPLOYMENT APPLICATION (COOPER) An application for employment for Motor Equipment Operator from Scott Cooper was on the table for Board review. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to accept and hire Scott Cooper as part-time Motor Equipment Operator at $12.50 per hour beginning July 5, 2017. · VILLAGE OF MORAVIA EMPLOYEE POLICY Each of the Trustees received a copy of the Village of Moravia’s Employee Policy for their review. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Village of Moravia Employee Policy, with no changes. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - A copy of a letter from Village to Red Apple (sidewalk repair). - Cayuga County Planning Board training (memo 07/19/17). - A copy of the Declaration of a Local State of Emergency (Mayor). - New York State Department of Labor Notice of Violations. On the table for Board review was: - Vehicle Log Sheets for the month of June. Mayor Mulvaney reported on the recent July 1, 2017 flood and the status of clean up.
