VILLAGE BOARD MEETING DECEMBER 12, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 6:59 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Code Enforcement Officer Fred Delaney, and Denice Spingler (E-911 Administrator), Village Attorney Charles Marangola (entered 7:09 p.m.) and Joshua Marnell were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the minutes for the November 28, 2016 Village Board Meeting, as amended. · BILLS A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #221 due to conflict of interest.) · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Treasurers Report for the month of November. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Public Works Report for the month of November. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of November. (Mayor Mulvaney stated he had written a note to Mike Perkins (Department of Public Works) pertaining to the fact that no new meters had been installed since September. He had not received a reply.) A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of November. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of November. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Dog Control Report for the month of November. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Police Report for the month of October. Each of the Trustees received a copy of an email from the Division of Criminal Justice Services (DCJS) with answered questions pertaining to the $12,500 grant the Village of Morava Police Department was awarded. Mayor Mulvaney explained that it was a reimbursement grant, which the Village was unaware of. He also stated that the Village was authorized to only spend it on a patrol vehicle and updated computer equipment for the vehicles and officers’ use. ---PAGE BREAK--- A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Police Report for the month of November. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of November. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of November. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of November. · PURCHASE ORDER A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Purchase Order to Alfal Lava for $3,076.45 for the purchase of three gears for the Sewer Treatment Plant. · TRANSFER A motion was made by Trustee McGuerty, seconded by Trustee Fulton to approve the following transfer: From: A1990.4 Contingent To: A1110.2 Justice – Equipment $320.00 · CABLE Mayor Mulvaney reported that there was a planned Public Hearing scheduled for the Cable Franchise Agreement on January 9, 2017. Mayor Mulvaney informed the Board that the Village had not received any reimbursements for the attorney fees associated with the franchise agreement. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Mayor Mulvaney stated that the Board would start reviewing more of the Village Ordinances after the first of the year. · ZONING AMENDMENTS (PB) Village Attorney Charles Marangola stated he had a few changes to propose to the Board pertaining to the drafted Site Plan Review from the Village of Moravia Planning Board that he would have for the next regularly scheduled Board meeting. He also stated that he compiled the proposed changes after reviewing six Site Plan Review laws from other municipalities. · SOLAR POWER GRANT (STP) ---PAGE BREAK--- The Board received a copy of an email from Chris Carrick updating the Village on the SolarizeCNY solar procurement process for the Sewer Treatment Plant. It stated that they had received twelve (12) Proposals that they would need to review. This item was tabled until the next regularly scheduled Board meeting. · MEMORANDUM OF UNDERSTANDING (E-911 CENTER – DENISE SPINGLER) The Board had previously received a copy of a Memorandum of Understanding “Cayuga County 911 Center Dispatch Procedures For Requests For Police Services Nearest Available Unit Concept.” Mayor Mulvaney reiterated that this had been addressed before in the past and after signing the MOU the Village of Moravia had cancelled the agreement due to insurance reasons. Denise Spingler (E-911 Administrator) told the Board that the insurance remains with the Police Officer when traveling outside their jurisdiction if dispatched by 911. She also noted a few minor changes and that all the agencies involved had signed the MOU except for the Village of Moravia. Village Attorney Charles Marangola stated that the insurance was a large concern for the Village of Moravia and not having police coverage in the Village if dispatched by 911 to another jurisdiction. The Board agreed that these were their two main concerns. After some discussion, this item was tabled until the next regularly scheduled Board meeting. · SPILLMAN PROGRAM (MPD) E-911 Administrator Denise Spingler addressed the Board pertaining to the Spillman program that the E-911 center would be implementing in 2017. She explained the program that had been purchased with a grant that included eight years of maintenance coverage. She explained the benefits for emergency personnel and the public. She also explained that the only cost to the Village of Moravia would be for the two computers that would be needed for the police vehicles, of which the Village received a $12,500 DCJS grant. She stated that all the police officers would receive training on the Spillman program. After several questions and answers, the Board thanked her for attending and explaining in more detail about the program. (The Spillman contract with the county was on the table for Board review that listed all the modules that had been purchased that would be included in the software package.) · RENTAL PERMIT LOCAL LAW #5 OF 1990 REVIEW Each of the Trustees received a copy of an email pertaining to the New York State Building Codes defining a multiple unit. This item was tabled until the next regularly scheduled Board meeting. · CAYUGA COUNTY PLANNING BOARD REPRESENTATIVE 2017 (NELSON) Each of the Trustees received a copy of a letter from the Cayuga County Planning Board requesting a nomination for the Village of Moravia’s representative for 2017 (or to have the current representative, Village of Moravia Planning Board Chairperson, Paul Nelson, continue to serve). A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve Village of Moravia Planning Board Chairperson Paul Nelson’s continuation of service as the Village of Moravia’s representative to the Cayuga County Planning Board for 2017. · EMPLOYMENT APPLICATION (DPW – RAYMOND) An employment application from Ricky Raymond for Part-Time Laborer was on the table for Board review. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to accept and place on file the employment application from Ricky Raymond for Part-Time Laborer. · MPD EMPLOYEE REMOVAL FROM PAYROLL (RYAN) Mayor Mulvaney reported that the certified letter to part-time Moravia Police Officer Joseph Ryan that the Village had sent (requesting the status of his employment), was returned undeliverable. Mayor Mulvaney explained that Officer in Charge Robert Brown had also previously hand delivered a similar letter to Officer Ryan. With no response and not having been on the work schedule since 2014, a motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 to remove part-time Moravia Police Officer Joseph Ryan from the Village of Moravia payroll effective December 12, 2016. · RESCHEDULE VILLAGE BOARD MEETING (12/26/2016 CHRISTMAS) A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to reschedule the Monday, December 26, 2016 Village Board meeting to Tuesday, December 27, 2016 at 7:00 p.m. due to the Christmas holiday being observed on Monday, December 26, 2016. · INFORMATIONAL ITEMS On the table for Board review was: - Vehicle Log Sheets for the month of November. Each of the Trustees received a copy of the following: - Letter to Village from Renovus (Solar Farm Project – Spaulding). - WeCare Garbage Pick Up Schedule 2016/2017/2018. - Email to Village from Finch (12/14/16 meeting pertaining to the Route 81 reconstruction project). - Quarterly Open Agenda Items. - Workers’ Compensation figures for 2017. - Email from Cayuga County Water & Sewer Authority (Regional Master Plan award). - 6 month Village of Moravia Budget review distributed by Treasurer Susan Wade. After reviewing the status of the budget, the Board expressed concern for the Moravia Police Department’s payroll. It was noted that more than ½ of the annual budget had been used. Mayor Mulvaney and Trustee Fickeisen explained that they had met with Officer in Charge Robert Brown about the payroll and the schedule. Treasurer Susan Wade also had contacted OIC Robert Brown two months ago stating that he was going over budget. After some discussion, the Board agreed that a letter be sent to OIC Robert Brown pertaining to the payroll and the schedule. Mayor Mulvaney reported that Thane Benson had expressed interest on leasing some Village property for farming. Village Attorney Charles Marangola suggested that Mr. Benson have his attorney draw up a lease/agreement and present it to the Board.
