Thurston, Esq., Town Attornev Title )iStaKP(ty Town Date: DOS-239 (Rev. 05/05) Page 3 of 3 ---PAGE BREAK--- ---PAGE BREAK--- TOWN OF VICTORY LOCAL LAW NO. 1 OF 2012 A Local Law to amend the Zoning Law of the Town of Victory to amend the Town Zoning Law pursuant to Article IX thereof to establish the North East Christian Conference Center Residential Planned Development District to be located at 1989 Jones Road in the Town of Victory and being known as tax map number 33.00-1-L SECTION 1 STATUTORY AUTHORIZATION AND PURPOSE Section 1.1 Title. This Local Law shall be known as "A Local Law to amend the Town of Victory Zoning Law to establish the North East Christian Conference Center Residential Plarmed Development District." Section 1.2 Purpose, It is the purpose of this Local Law to establish the North East Christian Conference Center Residential Planned Development District to be located at 1989 Jones Road in the Town of Victory and being known as tax map number 33.00-1-1. Section 1.3 Statutory Autliorization. This Local Law has been adopted pursuant to and in conformity with Article 10 of Municipal Home Rule Law, Article 16 of the Town Law, Article IX of the Town of Victory Zoning Law (the "Zoning Law"), and the New York State Constitution. SECTION 2 ESTABLISHMENT OF PLANNED DEVELOPMENT DISTRICT Section 2.1 Creation of District, There is hereby created in the Town of Victory the North East Christian Conference Center Residential Plarmed Development District (the "PDD"). The PDD shall be comprised of all real property commonly known as 1989 Jones Road in the Town of Victory and being more particularly described as tax map number 33.00-1-1 on the land and tax map of the County of Cayuga, New York. Section 2.2 Zoning Map, The Zoning Map of the Town of Victory is hereby amended to provide that the premises commonly known as 1989 Jones Road in the Town of Victory and being more particularly described as tax map number 33.00-1-1 on the land and tax map of the County of Cayuga, New York shall be a Residential Planned Development District in the Town of Victory and shall no longer provide that said premises are zoned agricultural / residential. Section 2.3 Permitted Improvements, The following new structures are hereby permitted to be constructed in the PDD, subject to compliance with the New York State Uniform Fire and Building Code: 2.3.1 The removal of 57 RV lots on the upper portion of the site and construction of 60 five-row town home type units. 1 ---PAGE BREAK--- ---PAGE BREAK--- 2.3.2 The of small cabin type units on east side hill and other units as required. 2.3.3 The construction of a five acre storm water pond on rear east side of site as required. 2.3.4 The construction of a 2000 seat meeting hall on the east side of the site. 2.3.5 The construction, upgrade and addition to the existing recreational center located on the site. 2.3.6 Any and all future structures will require an amendment of the PDD in accordance with the Zoning Law. Section 2.4 Maximum Density, In no case shall more than sixteen percent (16%) of the gross site area, including paved or otherwise constructed road and parking areas, shall be permitted for uses other than open space. Section 2.5 Heiglit Restrictions, All improvements constructed and located within the bounds of the PDD shall conform to the height restrictions contained in Section 400 of the Zoning Law, and as amended, for Agricultural/Residential districts, subject to the exceptions set forth in Section 403 of the Zoning Law. Section 2.6 Seasonal Use, All residential improvements and structures constructed on or after the effective date of this Local Law shall be seasonal in nature and may not be used as permanent residences. No party shall reside in any such structure for a period of time exceeding fourteen (14) consecutive days. Section 2.7 Incorporation of Zoning Law, The PDD shall comply with all other provisions of the Zoning Law, and as amended, not inconsistent herewith. SECTION 3 MISCELLANEOUS Section 3.1 Separability, If any part or provision of this Local Law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part, provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances and the Town of Victory, by its Town Board, hereby declares that it would have enacted this Local Law or the remainder thereof had the invalidity of such provision or application thereof been apparent. Section 3.2 Headings, Section headings are used only for convenience and have no meaning or effect. Section 3.3 Effective Da^e.This Local Law shall become effective upon the filing of same with the Secretary of State. ---PAGE BREAK---
