Regular Town Meeting, January 11, 2017 1 Town of Niles TOWN BOARD MEETING January 11, 2018 Niles Town Hall PRESENT: Joan Jayne, Supervisor Steven Cuddeback, Councilman Bernard Juli, Deputy Supervisor Attorney Brody Smith Clarence Edmonds, Councilman Joe MacDuffee, Councilman Tiffany Landis, Town Clerk Patty Podolak, Deputy Town Clerk OTHERS PRESENT: Sean Murphy, Neil Stevens, Stefanie and Edmond Raymond, Pat Merical, Karen Porter, Pat Steger and Roger Slater A. Meeting called to order at 7:00 pm by Supervisor Jayne B. Pledge of Allegiance C. Open floor to the public Stefanie Raymond spoke to the Board representing the New Hope Fire Department and 3- Town Fire district. She requested the status on the property transfer from the Building permit submitted in 2013. Attorney Smith says the ball is in his court on the property transfer. Discussion ensued concerning the steps involved in obtaining a building permit. There was some discussion on what the former Code Enforcement Officer knew or did not know about the amount of fill that was going to be brought in. Attorney Smith said that the next step is for the Fire Department to go to the Planning Board. Whatever problems there are or are not with the compaction of the gravel - can address with the Planning Board. Mr. Merical said that the Planning Board wants the property transfer to be finalized before they see them. There was some confusion on what land the transfer actually included. Attorney Smith said he will bring the transfer survey to the Board when he brings the deed. Clerk Landis was directed to refund the building permit fee upon confirming date/amount of original building permit that was submitted. Neil Stevens addressed the Board. He stated that on 12/6/2017 there was a motor vehicle accident in front of his home on Old Salt Road. A historical sign about Mr. Charles Kellogg was broken and Mr. Stevens would like the sign repaired and put back up. According to Mr. Stevens, the sign can be welded and doesn't need to be replaced. The person that hit the sign will pay for repairs from her insurance. Consensus was to repair the sign. Superintendent Steger will coordinate with Mr. Stevens on the repair. ---PAGE BREAK--- Regular Town Meeting, January 11, 2017 2 Ms. Karen Porter requested the date of Mr. Jerry VeVone's resignation as Code Enforcement Officer. The resignation date was 12/31/17. Ms. Porter asked if the town was in litigation with anyone. Attorney Smith said no. Mr. Sean Murphy addressed the Board inquiring if there was any update from the last meeting concerning the clutter surrounding the Odd Fellows Hall. Supervisor Jayne stated that Niles is going to have an Inter-municipal agreement with Skaneateles - the agreement allows 25 hours of service from the Skaneateles Code Enforcement Officer for the Town of Niles with no fee and vice versa. The Code Enforcement Officer from Skaneateles will provide assistance until we get a new hire (which is a priority for the Board). Supervisor Jayne took the Skaneateles Code Enforcement Officer, Mr. Curt Coville, down to the Odd Fellows Hall today (1/11/18) and showed him the situation. Councilman MacDuffee asked if anyone knew who owns the deed of the property - Attorney Smith has for action. D. Approval of Minutes for the following: Town Board meeting and Public Meeting (Local Law 5 of 2017 - Extending the Cold War Veteran's Exemption) 12/14/17 and End of Year meeting 12/28/2017 On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the minutes of December 14 and December 28, 2017 be approved. E. Resolutions RESOLUTION #2018-1 BLANKET UNDERTAKING Be it resolved that in lieu of individual undertakings as required by Section 25 of the NYS Town Law, the Niles Town Board authorizes a blanket undertaking permitted by Section 11(2) of the Public Officers Law covering officers, clerks, and employees of the town. This blanket undertaking indemnifies the Town against losses caused by the failure of officers and all other employees to faithfully perform their duties or by their fraudulent or dishonest acts for the year 2018. Councilman Juli asked who was Deputy Supervisor. Supervisor Jayne stated that she appointed Councilman Cuddeback. Councilman Juli asked why he was being replaced - Supervisor Jayne asked if Councilman Juli wanted to go into executive session. Councilman Juli declined executive session. that any elected or appointed town official and town employee who uses a private vehicle in performing official duties for the Town of Niles may be reimbursed at the current rate set by the IRS pending approval by the Town of Niles Board. A trip log may be required. Discussion ensued as so which paper may reach more of the Town than the other. Clerk Landis was directed to look into the cost of placing advertisements in the Shopper - the Town of Niles may have several different circulations. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-8 RESOLUTION #2018-9 NYS & LOCAL GOVERNMENT RETIREMANT SYSTEM STANDARD WORK DAY Resolved that a standard work day and reporting procedure is established for the Town of Niles employees participating in the New York State and Local Government Retirement System. Claims for these payments shall be presented at the next regular meeting for audit. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-14 RESOLUTION #2018-15 PURCHASES BY TOWN EMPLOYEES Resolved that any routine purchase by any Officer of the Town in excess of $1,000.00 must receive approval from a majority of the Town Board at a duly-noticed meeting of the Town Board. Emergency purchases in excess of $1,000.00, but not exceeding $3,000.00, may be authorized by the Supervisor or the Deputy Supervisor upon consultation with at least two other members of the Board. The need to purchase an item or service shall be deemed an emergency if the health and safety of the public, or any Town employee, would be endangered by waiting until the next scheduled Town Board meeting to obtain approval for the purchase. Budgeted Public Works Contracts in excess of $3,000.00 also must receive Town Board approval. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-15 RESOLUTION#2018-16 RETURN CHECK FEE Resolved that any check rendered to the Town of Niles and returned for any reason may be charged per bank charge and appropriate fees. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-16 RESOLUTION #2018-17 AUTHORIZE DEPUTY SUPERVISOR TO SIGN CHECKS IN THE ABSENCE OF SUPERVISOR Resolved that the Deputy Supervisor be empowered to sign checks in the absence of and/or at the request of the Supervisor. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-17 ---PAGE BREAK--- Regular Town Meeting, January 11, 2017 9 RESOLUTION #2018-18 ANNUAL UPDATE DOCUMENT Resolved that the Supervisor shall file with the Town Clerk within 60 days after closing of the fiscal year, a copy of the Annual Update Document to the NYS comptroller. Be it further resolved that the Town Clerk shall publish in the official newspaper, within 10 days, notice that said report is on file for public inspection in the Clerk’s Office On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-18 RESOLUTION #2018-19 ADOPTION OF PROCUREMENT POLICY Resolved that the Town of Niles adopts the Procurement Policy dated January 1, 2012, and the Purchase by Any Officer of the Town Resolution dated February 13, 2014. Supervisor Jayne stated that we will look at and possibly update this policy. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-19 RESOLUTION #2018-20 TOWN CREDIT CARD Resolved that the Town will maintain its Visa credit card with First National Bank of Groton, with $2,000.00 limit, payable The Town Supervisor and the Deputy Town Supervisor shall be the signers on the account. The credit card is for use for and on behalf of the Town of Niles. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-20 RESOLUTION #2018-21 FOUR TOWN AGREEMENT Whereas the Four Town Ambulance Service agrees that it shall, upon called, use its equipment and personnel for the purpose of transporting the sick and injured persons found within the Town of Niles to the hospital, clinic, sanatorium or other place for treatment of such illness or injury. Now therefore be it resolved that the Town of Niles agrees to pay the Ambulance Service the sum of $11,469.00 for such service in the 2018 calendar year. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-21 ---PAGE BREAK--- Regular Town Meeting, January 11, 2017 10 RESOLUTION #2018-22 SCAT VAN AGREEMENT Resolved that the Town of Niles agrees to pay the Transportation Project for Cayuga County (Scat Van) the sum of $1,000.00 in 2018. Such funding for the Scat Van is included in the 2018 budget, A6772.42 On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-22 RESOLUTION #2018- 23 DESIGNATE TOWN SUPERVISOR AS DELEGATE TO ATTEND ASSOCIATION OF TOWNS ANNUAL BUSINESS MEETING Resolved that Supervisor Jayne be assigned as the Town of Niles delegate to attend the Association of Town’s annual business meeting with the purposes of electing the president, five vice presidents and voting on the Association’s annual legislative platform. Supervisory Jayne stated she and Bookkeeper Anderson would be attending this year February 18-21, 2018. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-23 RESOLUTION #2018-24 THE TOWN SHALL PAY THE FULL HEALTH INSURANCE PREMIUM FOR THE HIGHWAY SUPERINTENDENT AT THE CURRENT YEAR RATE, AND PRE-FUND THE HIGHWAY SUPERINTENDENT’S MEDICAL SAVINGS ACCOUNT IN THE AMOUNT OF $3,250.00 TO COVER OUT-OF-POCKET EXPENSES. Code Enforcement: Currently vacant. ---PAGE BREAK--- Regular Town Meeting, January 11, 2017 11 B: Attorney Report: Mutual Aid Agreement for Code Enforcement Officer - Attorney Smith gave an overview and provided copies of the Mutual Aid Agreement for Building Inspection and Building Code Enforcement Services with the Town of Skaneateles. Document provides for 25 hours of service/assistance with no charge. After 25 hours the Town would reimburse Skaneateles the Code Enforcer's cost. Attorney Smith wanted the Board to know he was the Attorney for the Town of Skaneateles too. Councilman MacDuffee asked what would happen if the Town of Skaneateles sued the Town of Niles - Attorney Smith said he wouldn't represent either Town if that happened. Discussion ensued and consensus was to add "Junkyard Services" to the title and document and to acknowledge conflict of interest. RESOLUTION #2018- 25 TO ENTER MUTUAL AID AGREEMENT FOR BUILDING INSPECTION AND BUILDING CODE ENFORCEMENT SERVICES WTIH THE TOWN OF SKANEATELES AND TO ADD JUNKYARD SERVICES TO TITLE AND BODY OF AGREEMENT. THE CONFLICT OF LEGAL COUNSEL IS WAIVED. Attorney Smith stated that the Town of Skaneateles has a Board meeting on Monday and can approve. Discussion ensued on differences between full-time and part-time Code Enforcement. Questions were asked about when the Board would see this gentleman from Skaneateles. Attorney Smith said next week if Skaneateles Board approves agreement. Supervisor Jayne stated Skaneateles' Code Officer would cover all meetings and activities until a new person is hired. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-25 Building permit fee schedule and potential addition of building permits being required for sheds/outbuildings and requiring a land survey with permit application - Attorney Smith discussed that the Board has entertained the idea of not exempting sheds and also requiring a survey for submitting a building permit application. Right now there is no requirement for a survey. A proposed draft of the local code change was given to the Board members with red lines showing the potential changes. Attorney Smith requested that the Board look it over - no vote tonight. Discussion ensued and there was not a consensus. The Board would like this issue to be brought up to the Planning Board and has requested that the Planning Board provide an opinion on this matter. ---PAGE BREAK--- Regular Town Meeting, January 11, 2017 12 RESOLUTION #2018- 26 GIVE AUTHORITY FOR SUPERVISOR TO SUBMIT AND SIGN REQUIRED RETIREMENT PAPERWORK TO THE STATE OF NEW YORK PENSION SYSTEM. On a motion by Councilman Cuddeback, seconded, by Councilman Edmonds the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-26 RESOLUTION #2018-27 APPROVE SUMMARY SHEET FOR CONTRACTOR'S PAY APPLICATION FOR PAYMENT NUMBER 1; SEWER PROJECT PAYMENT IS $33,715.50 AND WATER PROJECT PAYMENT IS $54,720.00. Attorney Smith stated this is planned cost, this is the first payment out of the bond - there is no additional cost. On a motion by Councilman Juli, seconded, by Councilman Cuddeback the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-27 B. Assessor's Report: Assessor Schramm was not in attendance but she provided a report. Ms. Schramm is continuing to receive renewal applications; out of 448 exemption renewals sent out, 122 have been returned to date. New sales to comparable sales sheets have been entered in excel for each neighborhood - this will be ongoing as sales come in leading up to reassessment project. Utility and State owned land advisory requests for 2019 reassessment will be submitted to NYS by March 1st. Field review to take updated photos and verify missing inventory is ongoing. Exemption forms are due back March 1st. D. Town Clerk's Report: Clerk Received shares totaled $165.00 and they have been deposited. Deputy Clerk Landis asked Supervisor Jayne to make a Motion to approve Abstract 1 (January bills). Councilmen MacDuffee and Edmonds offered to assist with the final edit. RESOLUTION #2018-28 APPROVE FUNDING UP TO $1,100 TO PUBLISH AND MAIL 2018 NEWSLETTER. On a motion by Councilman Cuddeback, seconded, by Councilman Juli the following Resolution was ADOPTED Ayes Cuddeback, Edmonds, Jayne, Juli, MacDuffee Nays RESOLVED, that the Town of Niles board adopt RESOLUTION #2018-28 Clerk Landis reported that the Town has collected over $525,000 in County and Town revenue which is $250,000 more that what was collected at this time last year due to the early 2017 tax collection. Clerk Landis stated that it is her intent to wait one more week for checks to clear and then she will pay the Highway Fund, 3-Town Fire District, Garbage and Refuse, Sewer district No. 1 and Water District No. 1 levies to the Town Supervisor. Clerk Landis then introduced the new Deputy Clerk, Patty Podolak. The Board welcomed her. E. Highway Superintendant's Report: Superintendent Steger summarized his daily journal which was provided to the Board members. Highlights included a warranty repair to the sander motor and gear box and a fuel cap replacement on the F550. The excavator was pulled into shop to remove blade to straighten and repair welds. There were a few ice to snow situations - caused corn stalks to blow in and freeze in culvert on Split Rock Road. Fuel tank pump froze - had to thaw and treat tank. Cortland pump came to diagnose fuel pumping problem, found that filters were gelling from cold after running 10 gallons - eliminated filters for winter. Superintendant Steger said during the deep freezes they put tarps over fuel tank and ran heater inside dike of fuel tank to warm fuel. F250 had a transmission leak - filter cover and gasket were replaced. The tires on the grader are getting worn. Superintendent Steger said he did not budget for them but he has the money. The Board agreed that the tires should be replaced and requested that Superintendent Steger get bids on the cost. Attorney Smith stated that one idea is to use the unspent fund balance. Superintendant Steger is working with Williamson to upgrade system so Highwaymen can put their own records in the database; estimated cost is $250. Superintendent Steger said that it is getting harder to find locations that will take Freon - some charge $15 per unit. RESOLUTION #2018-29 APPROVE BUDGETED COST OF 2018 F-350 XL CREW CAB - TOTAL $46,751.70. Truck is being purchased from Van Bortel Ford. Current F-250 will be auctioned off in May at the Elmira auction - expecting a $27,000 sale. RESOLUTION #2018-32 APPROVE 2018 DOG CONTROL AND 2018 DOG SHELTER AGREEMENTS (1/1/18-12/31/18) The Dog Control Officer 2018 salary is $3,900.00. Country Acres Pet Services will provide sheltering services; Town will pay $75 per dog that is sheltered and not redeemed by an owner. Dog Control Officer reports will be received every month. Agreements are on file at the Town office. Other Business Supervisor Jayne stated that our Historian, Dar Winters is also providing reports. In January Ms. Winters is labeling and organizing books in the history room filing cabinet and researching a request for information on a family. Councilman MacDuffee asked about the dog kennels. Supervisor Jayne said that they would be picked up in the spring. Suzie Tracy, the new dog control officer stated that she wants to hold a rabies/immunization and adoption clinic. Councilman MacDuffee collected a rifle, a dart gun and a badge from Stacey Morris, the past Dog Catcher. During this process it was discovered that a weapon was sold to the Town by Jim Matijas (was transferred to George Komer) during the 1983-83 time frame. The weapon is missing. Councilman MacDuffee collected a rifle from Stacy Morris but it was not the same one that was sold to the Town. The Clerk will check records and report back. The Board members were not aware of this situation. The 2018 Dog Control Officer will not be requiring any weapons from the Town. J.
