TOWN OF STERLING PLANNING BOARD MEETING October 3, 2016 A regular meeting of the Town of Sterling Planning Board was held on Monday October 3, 2016 at the Sterling Town Hall at 7:00 pm with the following members present: June Ouellette ~ Chairman Sue Allen ~ Member Susan Lemon ~ Member Scott Crawford ~ Member Absent: Member Vernon Bishop Also Present: Larry Benedict, Virginia Fichera and Robin Allinger. Chairman Ouellette called the meeting to order at 7:02 pm. PUBLIC HEARING Larry Benedict Chairman Ouellette read the notice into the record and opened the Hearing at 7:04 pm. Notice is hereby given that the Planning Board of the Town of Sterling will hold a Public Hearing on Monday October 3, 2016 at 7:00 PM at the Sterling Town Hall, 1290 State Route 104A, Sterling, NY 13156. An Application for the Review of Subdivision by Larry Benedict will be heard regarding the Minor Subdivision of property located at 1383 State Route 104A, Sterling, NY 13156; Tax Map # 10.00-1-19.2. All those wishing to be heard in favor of or in opposition of said application may appear in person or by other representation at said time and place. By order of the Planning Board Lisa Somers, Clerk Chairman Ouellette asked Larry Benedict to explain his request for subdivision of property on State Route 104A. He stated that the owner of the house and acreage which he had initially subdivided now wanted to purchase an additional 6.5 acres. The land to be subdivided is the wooded section next to the house, leaving the agricultural property to be retained by Mr. Benedict. The Board members had no further questions and the checklist of required elements had been reviewed at the last meeting and the found to be complete. The Hearing was opened for public comments, the only one being a neighbors enquiry to see the map which was provided on the front table for him to view. The short form EAF was completed and reviewed by the Board to fulfill SEQR requirements. Questions number 13b and 19 had been left blank – the applicant checked and initialed those areas on the form. The Hearing was closed at 7:42 pm on a motion moved by Member Lemon and seconded by Member Crawford, all were in favor and the notion carried. A motion to accept the Benedict minor subdivision request as submitted was moved by Member Crawford and seconded by Member Allen, all were in favor without further discussion and the motion carried. Resolution 2016-06 BE IT RESOLVED, by the Planning Board for the Town of Sterling, upon the facts presented and the determination made, that the application for a Minor Subdivision of property owned by Larry Benedict and located at 1383 State Route 104A, Sterling, NY 13156; Tax Map # 10.00-1-19.2 is hereby GRANTED upon the following express conditions: NONE but to be filed with Cayuga County within 62 days. Roll call vote was taken: Chairman Ouellette Aye ---PAGE BREAK--- Member Allen Aye Member Bishop Absent Member Lemon Aye Member Crawford Aye 4 AYES 0 NAYES 0 ABSTENTIONS – APPROVED BUSINESS Proposed Gravel Mine – 13181 Sanford Road, Martville (20.00-1-68.1) Christopher J. Construction’s application for a Site Plan Review and Special Use Permit to operate a sand and gravel mine has begun its process again with the Planning Board with the implementation of the requested traffic study from last year. The engineering company chosen to complete the study, Creighton Manning, was notified and has begun the field data collection. Training - Chairman Ouellette had attended the last training session held by Cayuga County Planning and informed the members what had transpired. The County has been developing a map that designates potential conservation lands as described by each individual town, village and city zoning laws. The intent is to provide a tool that can assist municipal boards when planning larger scale projects. Fee Schedule – Member Allen supplied a revised copy of the fee schedule with highlighted changes in connection to subdivision fees. After some discussion the following changes were suggested: 1. Major subdivision of 4 lots without roads should not have a per lot fee after approval. 2. The third subsection – “Any reasonable and necessary costs incurred…” should be added to the other categories affected such as Special Permits and Site Plan Review. Member Allen stated she would bring an updated version to the next meeting. The statement should also be added to the Zoning Board of Appeals section in the Land Use Regulations. MINUTES Meeting minutes for September 12, 2016 were approved on a motion moved by Member Allen and seconded by Chairman Ouellette. All were in favor without further discussion and the motion passed. PRIVILEDGE OF THE FLOOR Robin Allinger – Stated that she had met the engineer from Creighton Manning on September 20th performing the data collection for the traffic studies. He had explained the process to her and she had observed count lines on Sanford and Pople Roads where counting occurred for 24 hours. On September 28th she observed and heard loud activity across the road involving many trucks from Cascade Drilling - she wondered if the Board knew what was going on at the property. Virginia Fichera – Ms. Fichera commented that maybe the activity involved borings being taken for contracts being formulated by the applicant. She stated that the applicant continued to disregard agreements and was now using another entrance not approved by the ZBA, working outside of the agreed upon hours of 7:00 to 5:00 – in all showing a complete lack ---PAGE BREAK--- of respect. She also felt that the Creightom Manning study scope should be amended by the Board to include the knobs along Sanford Road.
