VILLAGE BOARD MEETING NOVEMBER 14, 2016 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 6:59 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, and Code Enforcement Officer Fred Delaney (entered 7:03 p.m.) were also present. · PUBLIC HEARING – LOCAL LAW #3 OF 2016 “REGULATING OPEN BURNING” Mayor Mulvaney opened the Public Hearing at 7:00 p.m. for proposed Local Law #3 of 2016 entitled “Regulating Open Burning” with a motion from Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the minutes for the October 24, 2016 Village Board Meeting, as amended. · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #193 due to conflict of interest.) (The Board approved holding payment for Bill #197 until the repair of the police vehicle was complete.) · DEPARTMENT REPORTS A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Treasurers Report for the month of October. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Public Works Report for the month of October. A motion was made by Trustee Futon, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of October. (It was noted that no new meters were installed the month of October.) A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Fuller Park Inspection Report for the month of October. (Mayor Mulvaney noted that this would be the last report until Spring 2017.) A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of October. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of October. ---PAGE BREAK--- A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the September and October Dog Control Report. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the written and verbal Code Enforcement Report for the month of October. There was also discussion about the inspections of rental units and having to re-inspect those that had violations. The Board requested the Village’s rental law be revisited. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Justice Report for the month of October. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of October. It was noted that there was no Police Report for the month of October. · CABLE Mayor Mulvaney reported that Attorney Thomas Blair emailed the Village Office with a request from Zito New York, LLC to move the public hearing for the Franchise Agreement from December 12, 2016 to January 9, 2017. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve moving the public hearing for the Franchise Agreement with Zito New York, LLC to January 9, 2017. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · SOLAR (STP) Mayor Mulvaney stated that there was no update or news on the Solar Power Grant for the Wastewater Treatment Plant. This item was tabled until the next regularly scheduled Board meeting. · ZONING AMENDMENTS (PB) Mayor Mulvaney stated that he met with Village Attorney Charles Marangola in regards to what specific changes that were needed in the Site Plan Review draft received from the Village of Moravia Planning Board that would amend the Village’s Zoning Law. Mayor Mulvaney stated that after their discussion he requested the suggested changes in writing from Attorney Marangola. This item was tabled until the suggested changes are received from Village Attorney Charles Marangola. · OAK HILL GRAVEL PIT Mayor Mulvaney stated that the signs had been installed. With no further pending business pertaining to the Oak Hill Gravel Pit, a motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to remove the Oak Hill ---PAGE BREAK--- Gravel Pit from the agenda. · MEMORANDUM OF UNDERSTANDING (CC 911 CENTER) Each of the Trustees received a copy of a letter from the Village’s Insurance Agent Walter Dabulewicz pertaining to the Memorandum of Understanding “Cayuga County 911 Center Dispatch Procedures For Requests For Police Services Nearest Available Unit Concept” that the Board had previously received from Officer in Charge Rob Brown. After some discussion, this item was tabled until the next regularly scheduled Board meeting. · LETTER OF RESIGNATION (MPD – FABRIZE) Each of the Trustees received a copy of a letter from Moravia Police Officer Edward Fabrize. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to accept the letter of resignation from Officer Edward Fabrize dated November 8, 2016, effective immediately. The Board directed Village Clerk Anne Riddell to send a letter to Officer Fabrize thanking him for his service to the community. · INFORMATIONAL ITEMS On the table for Board review was: - Vehicle Log Sheets for the month of October. - Cayuga County Foreclosures. Each of the Trustees received a copy of the following: - Cayuga County Association of Villages Agenda (11/22/16). - Village of Moravia Planning Board Minutes (08/15/16). - Cayuga County Planning Board training notice (Solar – 11/16/16). - Letter to Village resident from the Village Board (re: sidewalk repair). - Letter to Cayuga County Planning Board (re: Law for Erosion and Sediment Control). - DCJS Grant Award letter for the Moravia Police Department ($12,500). - Auburn Citizen article (Re: outside Village water users). · CLOSE PUBLIC HEARING Mayor Mulvaney asked the Board if there were any questions pertaining to Local Law #3 of 2016 “Regulating Open Burning.” There were none. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to close the Public Hearing on Local Law #13 of 2016 at 7:45 p.m. A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to adopt the following resolution: WHEREAS, In accordance with the New York State Environmental Quality Review regulations (SEQR), the Village Board of the Village of Moravia has announced its intention to act as Lead Agency with respect to proposed Local Law No. 3 of the year 2016 entitled “Regulating Open Burning”, (the “proposed local law”); and WHEREAS, the Village of Moravia has found the proposed local law to be an Unlisted Action as defined under SEQR; and ---PAGE BREAK--- WHEREAS, the Village of Moravia Board has prepared a Short Environmental Assessment Form to assess the significance of and potential for adverse environmental impact of the proposed local law; and WHEREAS, the Village Board has determined that the proposed local law will not result in any significant adverse environmental impacts; NOW, THEREFORE, BE IT RESOLVED, that the Village Board of the Village of Moravia declares that based on the Environmental Record which has been prepared, the proposed local law will not result in any significant environmental impacts. A Negative Declaration under SEQR is therefore issued for this proposal. The question of the adoption of the foregoing Resolution was duly put to a vote on roll call, which resulted as follows: Gary Mulvaney voting yes Anthony Peppe voting yes Gary Fickeisen voting yes Nancy McGuerty voting yes Christopher Fulton voting yes A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to adopt the following resolution on Local Law #3 of 2016 entitled “Regulating Open Burning”: WHEREAS, the Village of Moravia desires to regulate opening burning within the Village of Moravia pursuant to proposed Local Law No. 3 of the year 2016; and, WHEREAS, notice of a public hearing was duly advertised in the official newspaper of the Village with respect to proposed Local Law No. 3 of the year 2016; and WHEREAS, the Public Hearing was held on November 14, 2016, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law No. 3 of the year 2016, or any part thereof; and WHEREAS, the Village Board determined that the proposed Local Law No. 3 of the year 2016 was an Unlisted Action under SEQR; and WHEREAS, in accordance with the New York State Environmental Quality Review regulations (SEQR), the Village Board announced its intention to act as Lead Agency; and WHEREAS, the Village Board has prepared a Short Environmental Assessment Form to assess the significance of and potential for adverse environmental impact of the aforesaid Local Law; and WHEREAS, the Village Board notified all potentially Involved and Interested Agencies of its intention to act as Lead Agency for the Project, and circulated the Short Environmental Assessment Form, and no other Agency asserted legal authority or jurisdiction to serve as lead agency: and WHEREAS, the Village Board has determined that the aforesaid Local Law will not result in any significant adverse environmental impacts, and a Negative Declaration under SEQR was therefore issued with respect to the said Local Law; and ---PAGE BREAK--- WHEREAS, the Village Board has submitted the proposed Local Law No. 3 of the year 2016 to the Cayuga County 239L&M Committee as required under New York State General Municipal Law Section 239-M, has received the County 239L&M Report and is proceeding in compliance with the Report’s recommendations; and WHEREAS, the Village Board of the Village of Moravia after due deliberation finds that it is in the best interest of the Village to adopt said Local Law No. 3 of the year 2016; now, therefore, be it RESOLVED, that the Village Board of the Village of Moravia hereby adopts Local Law No. 3 of the year 2016 entitled “Regulating Open Burning”, a copy of which is attached hereto and made a part hereof; and be it further RESOLVED, that the Village Clerk is hereby authorized and directed to file said Local Law with the New York State Secretary of State.
