1 Village of Fair Haven Board of Trustees Meeting July 11, 2016 The meeting was called to order followed by the Pledge of Allegiance. Board members present Mayor James Basile, Deputy Mayor Walter Krehling, Trustee Judith Dunaway and Trustee Pete Hanford. Trustee Holley Webster-Goolden was excused. Also present Village Clerk-Treasurer Terri DiGregorio, Deputy Clerk Johanne Van Der Linden, DPW Superintendent Roger Granatiero and Village Historian Susie Parsons. Ambulance Supervisor-Zoning Officer Stanley was excused. Also present Ed Robinson, Vivian Sciarabba, David Dan Larsen, Gus Taft, Frank Perkins, Don Chamberlain, Louis Speciale, Nanda Speciale and Matthew Osterhaudt. LIBRARY NEWS:  Fair Haven Library will receive $30,000.00 from collection of RCCS school taxes this year. There is no longer Federal and State funding for libraries. Matt Osterhaudt thanked the Village for this year’s funding for the library.  On a motion by Deputy Mayor Krehling and a second by Trustee Dunaway the appointment of Dr. Henry Spang to the Library Board of Trustees was approved. All aye, motion carried.  Matt Osterhaudt announced a donation of $600.00 was received for a 15” speaker with try pod to improve the sound system used mainly in the park and housed at the library.  Mr. Osterhaudt informed the Board of the walkway to be installed at the library by TNT Paving. The Board approved the project and DPW Superintendent Granatiero will advise the paving company on this project. Matt also requested a new sign for the front of the library. They would like a two sided sign similar to the signs throughout the village. Pricing will be obtained. COMMUNICATIONS:  Kevin Clark of Clark CPA, PC briefed the Mayor and Board of Trustees at the July agenda meeting regarding reports and audits performed annually.  Pat Maxon and Joe Thompson briefed the Mayor and Board of Trustees at the July agenda meeting regarding activity at the West Barrier Bar Park (WBB).  June boat launch donations: King St. $46.00, Cottage St. $37.60. The Bay Betterment Association reimbursed the Village of the donation boxes.  In receipt of the fully executed 2015 New York Main Street Technical Assistance Program Grant Agreement.  Bruce Natale, P.E., Environmental Engineer with Cayuga County Planning informed the village office they will be starting to take boring samples from old canning factory around July 18th pending County Judge give approval.  A flag light was purchased for Standbrook Park. DPW Superintendent Granatiero checking the bell tower light over the bandstand as it is no longer illuminated.  In receipt of June 28th ZBA hearing minutes.  In receipt of “Thank you” note from Little League players.  The Board reviewed the USDA loan information regarding the water system improvement project acknowledging the final payment due in 2036 and fire engine loan final payment due in 2023. PUBLIC FORUM:  Dan Larson requested the American Legion/Community Center lease be renewed which expires in July. Trustee Dunaway pointed out this renewal was budgeted in the 2016-2017 budget.  Ed Robinson thanked the Village for the mowing of the vacant property next to him. A grass violation letter had been sent to the property owner.  David had questions and concerns on a number of items such as requesting speed bumps on Cayuga St. as too many cars are exceeding the speed limit and two dead trees on 13th Street need to be removed. DPW Superintendent Granatiero responded these trees are planned for removal. Mr. inquired about two properties mentioned at a previous meeting that were not connected to the sewer. According to Zoning Officer report all are on schedule at this time. David asked about the easement for the Deming property regarding the ditch that ran through the property. The Village does not have an easement and is not responsible for that ditch and informed Mr. Deming of this. Mr. inquired of the outcome of meeting with State Park representative Fred Bonn regarding the damage to Lake St. Ext. by heavy equipment. The State Park will ask for $10,358.10 in next year’s budget to assist in the repairs for 610 feet of road. ---PAGE BREAK--- 2 MINUTES:  On a motion by Trustee Dunaway and a second by Trustee Hanford the June 9th and 13th meeting minutes were approved. All aye, motion carried. ABSTRACT #2 VOUCHERS: The following vouchers were approved for payment on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried.  General Fund: $25,189.18  Water Fund: $5,850.59  Trust & Agency: $3,584.26  2001 CDBG: $263.65  2013 CDBG: $35,928.48  June Payroll: $33,247.70 COMMITTEE REPORTS:  June DPW report submitted by Roger Granatiero. Checked Pump house daily; took water samples to Lab in Auburn; read Water Meters; brush & leaves picked up; seasonal water turn- ons; meter replacements; weekly weed eating and mowing; weekly garbage removal from parks, etc.; replaced various street signs; replaced a water service line across the road on Lake St.; replaced water service line valve on Lake St. Ext.; replaced a fire hydrant valve on Victory St.; flushed and exercised fire hydrants on the north side; trimmed trees in area where the branches were obstructive; parking across from village hall was graded and more crusher run brought in; cleaned out drainage culverts; went around town again with Round-Up; assisted the Town of Sterling with road paving on a couple their roads; pavilion and gazebo were cleaned, light bulbs and electric were checked; addressed electrical and communication issues at pump station made preparation for 4th of July, put up signage, flagged ropes, put up barricades, trimming, mowing and cleaning up parks. Kline drainage fixed on Lake St. It was discovered the pipe had been damaged when the sewer line was installed. Mr. Granatiero is looking into purchasing or renting a road plate to cover open holes in the road when performing water digs. Two prices have been obtained so far. Roger will continue to look into this. The report was accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Dunaway. All aye, motion carried.  Treasurer’s report submitted by Terri DiGregorio for period ending 6/30/2016. General fund balance $506,755.28 which includes WBB $4,228.38, Water fund $79,426.40, 2001 CDBG $263.65, Trust & Agency $8,999.72, $3,888.07, 2013 Victory St. CDBG $1.00. The report was accepted on a motion by Trustee Dunaway and seconded by Trustee Hanford. All aye, motion carried.  June Ambulance report submitted by Stan The ambulance service answered 44 calls: 7 BLS, 22 ALS, 13 no transport, 1 cancelled call, 1 DOA. Total calls to date 198. Of these 44 calls 15 in the Village, 14 in the Town of Sterling, 2 in the Town of Martville, 11 mutual aid to Lakeshore Ambulance, 2 mutual aid to CIMVAC. Vehicles responding to calls: 35 for Ambulance 1 for Ambulance 10 for Medic Car, 5 for both the medic car and ambulance together. The response time was 2.40 minutes. Also in receipt of a $50.00 donation. The report was accepted on a motion by Deputy Mayor Krehling and seconded by Trustee Hanford. All aye, motion carried.  June Code Enforcement report submitted by Stan 6 building permits issued; 9 violation letters sent; 14 violations corrected; 4 Appearance tickets issued; 13 on-site inspection performed; 4 general village inspections performed. The report was accepted on a motion by Deputy Krehling and seconded by Trustee Dunaway. All aye, motion carried. UNFINISHED BUSINESS:  Trustee Dunaway reported on signage entering the Village on Route 104A and the two other roads entering the Village. She recommended removing the following signs: “Curfew”, “Neighborhood Watch”, “Peddling Permit Required” and “Zoning Laws in Effect”. The signs regarding parking on village streets in the winter will be replaced with new signs and speed limit signs will be smaller. The NYSDOT must give permission to remove green “Village of Fair Haven” signs on Rt. 104A if necessary.  New telemetry installed by NEC. The chart graph stopped working. Pricing for this is ongoing. In receipt of a quote of $9,034.00 from EMA to replace the VFD for the pump.  The Trustees reviewed all current water rates including those for Wayne County Water & Sewer Authority and Cayuga County Water & Sewer Authority (CCWSA). ---PAGE BREAK--- 3  On a motion by Trustee Dunaway and a second by Trustee Hanford Mayor Basile was authorized to sign the BMB Hardscapes proposal for material to rebuild the stone work around the “Welcome to Village of Fair Haven” signs at both ends of the village on State Route 104A. Roger will check with the NYSDOT regarding the installation of culvert pipe near the signs.  Mayor Basile proposed installing a gate at the end Stafford Street. The Village not only has a stock pile of stone in that area but now uses it for storage of equipment.  The proposed Road Preservation Law will be reviewed by the Planning Board at their July 21st meeting and Trustee Webster-Goolden will be attending. NEW BUSINESS:  John Marshall, Tula Standbrook’s grandson, requested a new park bench be placed in Standbrook Park replacing the one that was removed due to deterioration. He volunteered to pay for the bench. The village will email examples of benches to Mr. Marshall so he may choose the one he wants. Resolution Supporting the Cayuga County Water and Sewer Authority’s Application For a Grant to Support a County-wide Water and Sewer Study and Plan WHEREAS, the Cayuga County Water and Sewer Authority (CCWSA) was created as a corporate governmental agency constituting a public benefit corporation and its purpose is to serve the people of Cayuga County; and as part of the CCWSA’s enabling legislation, a district to be known as the “Cayuga County Water and Sewer Authority District” was established, which embraces all of the territory located within Cayuga County; and WHEREAS, the CCWSA’s mission includes undertaking all necessary and reasonable actions within the district to conserve, preserve and protect the water supply to the district, including the making of plans and studies; and WHEREAS, the CCWSA has identified a critical need for a countywide, comprehensive water and sewer plan; and WHEREAS, prior comprehensive evaluations of water and sewer infrastructure were last completed in 1970; and WHEREAS, the CCWSA intends to act as lead applicant and submit a planning grant application in support of a countywide, comprehensive water and sewer plan to the New York State Department of State (NYSDOS), under its Local Government Efficiency (LGE) Program, as part of the Year 2016 Consolidated Funding Application process; and WHEREAS, the Cayuga County Legislature has already resolved to support this LGE grant application including providing required matching funding for the grant; and WHEREAS, the CCWSA is inviting all municipalities in Cayuga County to be active participants in the development of a countywide, comprehensive water and sewer plan; NOW THEREFORE BE IT RESOLVED that the Village of Fair Haven fully supports Cayuga County Water and Sewer Authority’s effort to develop a long-range comprehensive plan to address water and sanitary sewer service needs throughout the County of Cayuga. DiGregorio Clerk-Treasurer ---PAGE BREAK--- 4 Resolution to file an Application for Funds from the New York State Office of Community Renewal through its New York Main Street Program 2016 I, Terri DiGregorio, the duly qualified Clerk of the Village of Fair Haven, New York, do hereby certify that the following resolution was adopted at a regular meeting of the Village of Fair Haven held on July 11, 2016, and is incorporated in the original minutes of said meeting, and that said resolution has not been altered, amended, or revoked and is in full force and effect. RESOLVED: That James Basile, as Mayor of the Village of Fair Haven, is hereby authorized and directed to file an application for funds from the New York State Office of Community Renewal through its New York Main Street Program 2016 to assist downtown property owners, and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to the Village of Fair Haven for the Fair Haven New York Main Street Project. DiGregorio Clerk-Treasurer  Plans to repair the fire hydrant on Fancher Ave. that has been out of service for quite some time should occur next week. The DPW will try to maneuver the back-hoe into that tight curve. If they are unable to do so a smaller back-hoe will be used.  A section of a very deep ditch on Fancher Ave. across from Pleasant Beach needs to be trimmed and cleaned out. This will be addressed by the DPW.  On a motion by Deputy Mayor Krehling and seconded by Trustee Hanford a request by Richard & Judy Dunaway for new water service at 14489 Richmond Ave. was approved. Deputy Mayor Krehling aye, Mayor Basile aye, Trustee Hanford aye, Trustee Dunaway abstained. Motion carried. It was noted a water service was already available at that location. The meter and valve will be located in the basement.  MultiMed, third party billing company for the village ambulance, would like permission to accept on the Village’s behalf settlement of claims offered at 90 percent or greater of the amount charged. This request was approved on a motion by Trustee Dunaway and seconded by Deputy Mayor Krehling. All aye, motion carried  Simon’s Collection agency submitted an updated report of money owed to the Village for ambulance calls. This is a list of people who received a check from their medical insurance carrier, cashed the checks and failed to forward the money to Fair Haven Village Ambulance to pay for the service call. The Board agreed to have Village Attorney Chris Palermo address this issue and start proceedings to send these violators to small claims court for theft of service.  Fifty percent of building and zoning permit fees can be refunded to the applicant if a variance is denied provided no work has commenced according to Local Law #3 of 1985, a local law providing for the administration and enforcement of the New York State Fire Prevention and Building Code. The Board noted variance fees are not refundable. A note regarding refunds will be added to the fee schedule for building permits, etc.  Zoning Officer Stan will report on updates to the schedule of fees for building permits at the August meeting.  On a motion by Deputy Mayor Krehling and Trustee Dunaway authorization was given for Clerk-Treasurer DiGregorio and Deputy Clerk Van Der Linden to attend NYCOM Fall School September 12th through 16th at the Hilton Saratoga Springs. All aye, motion carried. The village office will be closed that week and the September board meeting rescheduled to Monday September 19th at 7pm. ---PAGE BREAK--- 5  The Board of Trustees discussed the possibility of abandoning 13th Street west of Lake St. Ext. This topic will be revisited after consulting with the Village Attorney. ADJOURNMENT: The meeting was adjourned at 8:35 p.m. on a motion by Trustee Dunaway and a second by Deputy Mayor Krehling.
