VILLAGE BOARD MEETING SEPTEMBER 11, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, Anthony Peppe (entered at 7:05 p.m.) were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, Village Attorney Charles Marangola, Code Enforcement Officer Patrick Doyle, Village Justice June Shepardson, Kean (WWTP), Sean Cochran (WWTP), Shawn Bray (MRB group) were also present. · MOMENT OF SILENCE The Board and the public had a moment of silence in remembrance of September 11, 2001. · OPEN PUBLIC HEARING (LOCAL LAW #3 OF 2017) A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to open the Public Hearing for Local Law #3 of 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’” at 7:02 p.m. Mayor Mulvaney asked if there were any questions or comments. There were none. Mayor Mulvaney then stated that the Public Hearing would remain open until the end of the meeting. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 3-0 vote to approve the minutes for the August 28, 2017 Village Board Meeting. (Trustee Peppe entered at 7:05 p.m.) · BILLS A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills. (Trustee McGuerty abstained from Bill #123 due to conflict of interest.) · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Treasurer’s Report for the month of August. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Public Works Report for the month of August. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Water Meter Replacement Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Fuller Park Inspection Report for the month of August. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Sewer Treatment Plant Report for the month of August. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Vehicle Log Sheet Report for the month of August. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Dog Control Report for the month of August. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the Police Report for the month of August. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the verbal Code Enforcement Report for the month of August. (It was noted that due to a computer problem, there was no written report for the month of August.) A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the Justice Report for the month of August. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 4-0 vote to approve the Justice Building Inspection Report for the month of August. · MEDICAL DROP BOX (JUDGE SHEPARDSON) Judge Shepardson addressed the Board with several concerns for the recently approved and installed medical drop box located in the foyer of the Justice Center. (Judge Shepardson also distributed photos of the medical drop box.) Judge Shepardson stated that she believed the medical drop box could be a security risk to the court. She also reported that she had conveyed her concerns to Officer In Charge Robert Brown prior to the approval of the Village Board. After some discussion, Mayor Mulvaney stated that he would call the Cayuga County Undersheriff to discuss the concerns further and report back to the Board and that the box would be covered on court nights and for the upcoming primary election. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). · VILLAGE ORDINANCES Each of the Trustees received a copy of the Village Ordinance, Chapter 2, Section 8, information and sample laws pertaining to bicycles on sidewalks. This item was tabled for further discussion at the next regularly scheduled Board meeting so that the Board could review the materials distributed. · SEWER BREAKS & FLOODING (MRB GROUP) Each of the Trustees received copies of emails from MRB group pertaining to the North Main Street and South Main Street sewer lines that need repair. ---PAGE BREAK--- Mr. Bray suggested that the Mayor, Bill Davis (MRB Group), Brian Romeiser (MRB Group), Sean Cochran (WWTP), and Kean (WWTP) meet prior to their scheduled meeting with the NYSDEC about the recommendations that NYSDEC had made. Mayor Mulvaney agreed. Mr. Bray reiterated that the Cayuga County Soil and Water Department agreed to assist the Village with the North Main Street sewer line project and presented the Board with revised plans. Mr. Bray then continued and reviewed the plans for the South Main Street sewer line replacement and will be pursuing this and will keep the Board updated. (Shawn Bray – MRB Group - exited at 7:48 p.m.) · CLOSE PUBLIC HEARING (LOCAL LAW #3 OF 2017) Mayor Mulvaney asked if there were any questions or comments from the Board or the public. There were none. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to close the Public Hearing for Local Law #3 of 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’” at 8:10 p.m. · SEQRA RESOLUTION A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 5-0 vote to adopt the following resolution: WHEREAS, 1. In accordance with the New York State Environmental Quality Review Act (“SEQRA”) regulations, the Village Board of Trustees of the Village of Moravia (“Village Board”) announced its intent to serve as Lead Agency on July 10, 2017, to conduct an environmental review of proposed Local Law No. 3 of 2017. The proposed action will result in the adoption of a law to amend its comprehensive zoning and land use law and add Article XV for site plan review and approval within the Village. 2. The Village Board has determined that the proposed action is an Unlisted Action as defined under SEQRA section 617. 3. The Village Board, as lead agency has caused to be prepared an environmental assessment of the significance of and potential environmental impact of the action described above. 4. On or about July 12, 2017, the Village Board notified all potentially Involved and Interested Agencies of its intention to act as Lead Agency for the Project, and circulated the Short Environmental Assessment Form. No other Agency asserted legal authority or jurisdiction to serve as lead agency. 5. The Village Board has carefully considered the environmental record prepared for this action, including any comments received from the Involved Agencies. ---PAGE BREAK--- NOW, THEREFORE, BE IT RESOLVED, that the Village Board of Trustees of the Village of Moravia hereby determines that the action proposed will not have a significant adverse effect upon the environment and an environmental impact statement will not be prepared for the reasons set forth in the negative declaration attached. The question of the foregoing Resolution was duly put to a vote and upon roll call was as follows: Mayor Gary Mulvaney Voting YES Trustee Anthony Peppe Voting YES Trustee Gary Fickeisen Voting YES Trustee Nancy McGuerty Voting YES Trustee Chris Fulton Voting YES · RESOLUTION TO ADOPT LOCAL LAW #3 OF 2017 A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to adopt the following resolution: WHEREAS, the Village of Moravia desires to amend its comprehensive zoning and land use law and add Article XV for site plan review and approval within the Village, by the passage of proposed Local Law No. 3 of the year 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’ and WHEREAS, notice of a public hearing was duly advertised in the official newspaper of the Village with respect to proposed Local Law No. 3 of the year 2017; and WHEREAS, the Public Hearing was held on September 11, 2017, and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law No. 3 of the year 2017, or any part thereof; and WHEREAS, the Village Board determined that the proposed Local Law No. 3 of the year 2017 was an Unlisted Action under SEQR; and WHEREAS, in accordance with the New York State Environmental Quality Review regulations (SEQR), the Village Board announced its intention to act as Lead Agency; and WHEREAS, the Village Board has prepared a Short Environmental Assessment Form to assess the significance of and potential for adverse environmental impact of the aforesaid Local Law; and WHEREAS, the Village Board notified all potentially Involved and Interested Agencies of its intention to act as Lead Agency for the Project, and circulated the Short Environmental Assessment Form, and no other Agency asserted legal authority or jurisdiction to serve as lead agency: and WHEREAS, the Village Board has determined that the aforesaid Local Law will not result in any significant adverse environmental impacts, and a Negative Declaration under SEQR was therefore issued with respect to the said Local Law; and ---PAGE BREAK--- WHEREAS, the Village Board has submitted the proposed Local Law No. 3 of the year 2017 to the Cayuga County 239L&M Committee as required under New York State General Municipal Law Section 239-M, has received the County 239L&M Report and is proceeding in compliance with the Report’s recommendations; and WHEREAS, the Village Board of the Village of Moravia after due deliberation finds that it is in the best interest of the Village to adopt said Local Law No. 3 of the year 2017; NOW, THEREFORE, BE IT RESOLVED, that the Village Board of the Village of Moravia hereby adopts Local Law No. 3 of the year 2017 entitled “Amending Local Law #1 of 1988 entitled ‘Village of Moravia Comprehensive Zoning and Land Use Law’, a copy of which is attached hereto and made a part hereof; and be it further RESOLVED, that the Village Clerk is hereby authorized and directed to file said Local Law with the New York State Secretary of State. The question of the foregoing Resolution was duly put to a vote and upon roll call was as follows: Mayor Gary Mulvaney Voting YES Trustee Anthony Peppe Voting YES Trustee Gary Fickeisen Voting YES Trustee Nancy McGuerty Voting YES Trustee Chris Fulton Voting YES · BUILDING PERMIT FEE WAIVER REQUEST Each of the Trustees received a letter of request from Mike Miller (First Baptist Church of Moravia) requesting the Board waive the $161.00 Building Permit Fee. A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to waive a $161.00 Building Permit Fee for the First Baptist Church of Moravia. (It was noted that the building permit was for repair of their building on 37 Church Street due to a wind storm on May 1, 2017.) (Code Enforcement Officer Patrick Doyle exited at 8:16 p.m.) (Village Attorney Charles Marangola exited at 8:23 p.m.) · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Town of Moravia Minutes (06/21, 07/19/17). - Quarterly Open Agenda Items. - Letters pertaining to Disaster Declaration request –floods. - Email announcement (Gov. Cuomo request to Declare Disaster Declaration). - Invitation letter from Cayuga County Water & Sewer Authority (09/19/17). - Cayuga County Association of Villages Agenda.
