VILLAGE BOARD MEETING APRIL 9, 2018 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. (Trustee McGuerty was absent.) Village Clerk Anne Riddell, Treasurer Susan Wade, Officer in Charge Robert Brown, and Joshua Marnell were also present. · MOMENT OF SILENCE – DONALD MYERS Mayor Mulvaney, Trustees, and the public had a moment of silence in memory of Donald Myers who served the Village as Mayor for twenty years and as Trustee. · PUBLIC HEARING LOCAL LAW #1 OF 2018 – PROPERTY TAX CAP A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to open the public hearing at 7:01 p.m. for Local Law #1 of 2018 entitled “A Local Law Authorizing A Property Tax Levy In Excess Of The Limit Established in General Municipal Law Mayor Mulvaney stated that after the Board had completed the 2018-2019 Village Budget it was found that this local law would not be needed. Mayor Mulvaney asked if there were any questions. There were no questions. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to close the public hearing at 7:02 p.m. A motion was made by Trustee Fulton, seconded by Trustee Peppe to adopt Local Law #1 of 2018 entitled “A Local Law Authorizing A Property Tax Levy In Excess Of The Limit Established in General Municipal Law The motion was defeated by the following vote. Mayor Gary Mulvaney Voting NO Trustee Anthony Peppe Voting NO Trustee Gary Fickeisen Voting NO Trustee Chris Fulton Voting NO · PUBLIC HEARING – 2018-2019 BUDGET A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 3-0 vote to open the public hearing at 7:03 p.m. for the 2018-2019 Budget. · PUBLIC TO BE HEARD Mayor Gary Mulvaney stated that if any of the public would like to speak during the public hearing/meeting, to do so. · MINUTES A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the minutes for the March 26, 2018 Village Board Meeting. ---PAGE BREAK--- · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the following bills. · PURCHASE ORDERS A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 3-0 vote to approve the following purchase orders. $3,730.00 to Tierney’s Sealcoating to sealcoat and stripe Justice Center and stripe Main Street. $ 826.24 to Webster’s Garage for 2007 Chevy One Ton (white) for maintenance and repairs. $ 550.00 to C&M Co., Inc. (Christopher Leonard) Load of Stone for Sewer Treatment Plant. · DEPARTMENT REPORTS A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Treasurer’s Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the Public Works Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to approve the Water Meter Replacement Report for the month of March. A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to approve the Sewer Treatment Plant Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to approve the Vehicle Log Sheet Report for the month of March. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the Dog Control Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to approve the Police Report for the month of March. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the written Code Enforcement Report for the month of March. A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the Justice Building Inspection Report for the month of March. It was noted that there was no Justice Report for the month of March. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that the Board received the report (see above). ---PAGE BREAK--- · VILLAGE ORDINANCES Mayor Mulvaney stated that the Zoning Board would be meeting on May 7, 2018 so that the Board of Trustees could receive their input. This item was tabled until the next regularly scheduled meeting. · SEWER BREAKS & FLOODING Mayor Mulvaney stated there was no updates on the sewer breaks, however the sewer break repair on South Main Street may be started on May 1, 2018, weather permitting. · VILLAGE’S WATER/SEWER SYNOPSIS 2017 Mayor Mulvaney stated that NY Rural Water Association had recently found ten (10) fire hydrants that were leaking. The NYRWA would be getting a meter to monitor the water flow for thirty (30) days at both pump stations and Glenside District that would detect leaks in this area. Mayor Mulvaney stated that NYRWA would be coming once a week to Moravia to assist in leak detection. · RIGHT OF WAY (20 EAST CAYUGA STREET) Each of the Trustees received two emails pertaining to the Village’s right of way on 20 East Cayuga Street. (One email from Village Attorney Charles Marangola to Camardo Law Firm and a response email back to Village Attorney Charles Marangola.) · SEWER RATE INCREASE (RESOLUTION) A motion was made by Trustee Fulton, seconded by Trustee Fickeisen to approve the following resolution. LET IT BE KNOWN THAT, at the regular scheduled meeting held on April 9, 2018, the Board of Trustees of the Village of Moravia do hereby resolve to increase the SEWER RATE effective July 1st, 2018 SEWER billing according to the following schedule. Unit Charge Based on water consumption Current Rate 4/2016 $ 13.00 1.50/thous inside 2.25/thous outside Effective July Billing 4/2018 $ 13.00 2.00/thous inside 3.00/thous outside The motion was approved by the following vote. Mayor Gary Mulvaney Voting YES Trustee Anthony Peppe Voting NO Trustee Gary Fickeisen Voting YES Trustee Chris Fulton Voting YES · KILBORNE AGENCY DISCLOSURE STATEMENT Each of the Trustees received a copy of the Kilborne Agency Disclosure Statement. ---PAGE BREAK--- A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 3-0 vote to accept and place on file the Disclosure Statement from Walter Dabulewicz of Kilborne Insurance Agency, the Village’s Insurance Agent. · GARDEN CLUB REQUEST Each of the Trustees received a copy of a letter from the Moravia Area Garden Club (Magic) requesting up to $150.00 to purchase summer flowers (from Anna’s) for the planters on Main Street, assistance in placing the pots, assistance in picking up garden debris from the Peace Garden in Fuller Park, and spreading some mulch on the Peace Garden. A motion was made by Trustee Fickeisen, seconded by Trustee Peppe and carried with a 3-0 vote to approve the Moravia Area Garden Club (Magic) above request. (Trustee Fulton abstained; Mayor Mulvaney voted.) · PUBLIC NOTICE – VILLAGE ELECTION PUBLIC NOTICE IS HEREBY GIVEN that at the regular meeting of the Village Board of Trustees held on April 9, 2018, the following resolution was proposed by Trustee Peppe, seconded by Trustee Fulton and adopted by a unanimous vote: WHEREAS that Annual Election for Village Officers will be held on Tuesday, June 19, 2018, and; WHEREAS the Village of Moravia shall constitute a single Election District for Village Elections, and; WHEREAS no person shall be entitled to vote at the Village Election whose name does not appear on the Cayuga County voter’s registration book; NOW THEREFORE BE IT RESOLVED that the Annual Village Election will be held at the Village of Moravia Justice Center, 48 West Cayuga Street, Moravia, New York on Tuesday, June 19, 2018 between the hours of 12:00 noon and 9:00 p.m. · LETTER OF SUPPORT (CAPITAL FUNDING FOR WATER INFRASTRUCTURE) Each of the Trustees received a request from NY Rural Water Association asking the Village to send a letter to the Assembly and Senate leaders asking for their support of the Safe Water Infrastructure Action Program (SWAP) which is similar to the CHIPs program. A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to send a letter to our and Senator requesting they support the SWAP Bill. · PERMISSION FOR WATER SCHOOL (PERKINS, SMITH, PHOENIX) A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 3-0 vote to authorize Mike Perkins, Bill Smith, Kean and Dick Phoenix to attend W2Operator Winter Work Shop in Cortland on April 27, 2018. · SEWER REDUCTION REQUEST (LABARO) Each of the Trustees received a copy of a letter from Tammy and Sal Labaro pertaining to the water/sewer account for 108 Main Street. The letter stated that there was a broken water line, which had since been repaired and requested a reduction on the sewer bill. ---PAGE BREAK--- A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 3-0 vote to credit the sewer bill #40860 for 108 Main Street in the amount of $177.45 per the Village policy. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Citizen Preparedness Corps – Flyer (04/16/18). - Cayuga County Association of Village’s Agenda (04/24/18). - Cayuga County Planning Board 2018 Land Use Training. On the table for Board review was: - Vehicle Log Sheets for the month of March. · PUBLIC HEARING – 2018-2019 BUDGET A motion was made by Trustee Fulton, seconded by Trustee Peppe and carried with a 3-0 vote to close the public hearing at 7:40 p.m. for the 2018-2019 Budget. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 3-0 vote to adopt the 2018-2019 Village of Moravia Budget, as presented.
