VILLAGE BOARD MEETING DECEMBER 28, 2015 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 6:58 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Anthony Peppe, and Chris Fulton were in attendance. Village Clerk Anne Riddell and Treasurer Susan Wade were also present. · PUBLIC TO BE HEARD Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · PUBLIC HEARING – LOCAL LAW #2 OF 2015 – AMENDING CHAPTER 4, SECTIONS 4 & 5, OF THE GENERAL POLICE REGULATIONS OF STREETS AND SIDEWALKS Mayor Mulvaney opened the Public Hearing on proposed Local Law #2 of 2015 entitled Amending Chapter 4, Sections 4 & 5, of the General Police Regulations of Streets and Sidewalks with a motion from Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote. · MINUTES A motion was made by Trustee McGuerty, seconded by Trustee Peppe and carried with a 4-0 vote to approve the minutes for the December 14, 2015 Village Board Meeting. · BILLS A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the following bills, as amended. · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW WATER METER REPLACEMENT Mayor Mulvaney reported that there was no news on the New Water Meter Replacements. · VILLAGE ORDINANCES Mayor Mulvaney stated that the public hearing for amending Chapter 4, Sections 4 & 5, of the General Police Regulations Of Streets And Sidewalks was open for comments and questions. · WATER LEAK DETECTION UPDATE Mayor Mulvaney reported that there was no news on the Water Leak Detection from NYLD. · CABLE AGREEMENT ---PAGE BREAK--- Mayor Mulvaney reported that Village Attorney Charles Marangola would address this after the first of the year. · ZONING AMENDMENTS (PLANNING BOARD) Mayor Mulvaney stated that there was no update from the Planning Board on the Zoning Amendments. · SOLAR POWER GRANT (WWTP) Mayor Mulvaney reported that Village Clerk Anne Riddell contacted the company that was working on the solar power grant for the Wastewater Treatment Plant for a second time via email. The company responded stating they had not received the first email from October. After several correspondences via email and answering many more questions, the Village is waiting for their response. · OAK HILL GRAVEL PIT Mayor Mulvaney reported to the Board that the Village is currently looking for getting a decibel sign to place on Oak Hill Road since the Village had received permission from the Cayuga County Highway Department (Oak Hill Road being a County road). Mayor Mulvaney stated that he would keep the Board updated on the status of the sign. · MAIN ST. STREET LIGHT (BY WEBSTER’S) After some discussion on whether or not the street light on Main Street (in front of Webster’s Garage) needed to be replaced since it had been hit by a vehicle, the Board agreed that there was enough light in the area and was not necessary. · LETTER OF RESIGNATION (MPD – OFFICER FRANKLIN) Each of the Trustees received a copy of a letter of resignation from Moravia Police Officer Robert Franklin. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept the letter of resignation from part-time Moravia Police Officer Robert Franklin, effective immediately. · SEWER UNIT REDUCTION REQUEST (GREENE) Each of the Trustees received a copy of a note from Jim Greene pertaining to his commercial sewer unit charge for 115 Main Street. The note explained that the building has only four apartments and one business now (the dry cleaning business had closed) and would like the sewer units to be reduced to five After some discussion, a motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to reduce Jim Greene’s sewer unit charge from 8.1 to 5 on his account #20200 (115 Main Street), per the Village policy. · SEWER UNIT REDUCTION REQUEST (ZWIRN) Each of the Trustees received a copy of a letter from Richard Zwirn pertaining to his water/sewer account for 157 Main Street. The letter stated that there was a toilet leak, which has since been repaired and requested a ---PAGE BREAK--- discount. A motion was made by Trustee Fickeisen, seconded by Trustee McGuerty and carried with a 4-0 vote to credit Richard Zwirn’s sewer bill #20810 in the amount of $8.09, per the Village policy. · INFORMATIONAL ITEMS The Village Board of Trustees each received a copy of the following: - CHIPS Reimbursement received ($19,825.08 & $2,837.41). On the table for Board review was: - Owasco Lake Stakeholders Minutes. Village Clerk Anne Riddell stated that she had received an email from the Village of Weedsport pertaining to changing the date of the February Cayuga County Association of Villages meeting. · CLOSE PUBLIC HEARING A motion was made by Trustee Fulton, seconded by Trustee Fickeisen and carried with a 4-0 vote to close the Public Hearing on Local Law #2 of 2015. · LOCAL LAW #2 OF 2015 – AMENDING CHAPTER 4, SECTIONS 4 & 5, OF THE GENERAL POLICE REGULATIONS OF STREETS AND SIDEWALKS A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 4-0 vote to adopt the following resolution on Local Law #2 of 2015 entitled Amending Chapter 4, Sections 4 & 5, of the General Police Regulations of Streets and Sidewalks. WHEREAS, a public hearing was duly held on December 28, 2015, by the Village of Moravia, New York, with regard to Local Law No. 2 of the Year 2015, a Local Law pertaining to, Amending Chapter 4, Section 4 & 5, of the General Police Regulations Of Streets And Sidewalks. NOW, THEREFORE, BE IT RESOLVED BY THE Village Board of the Village of Moravia, New York as follows: The Village Board of the Village of Moravia, New York, hereby adopts Local Law No. 2 of the Year 2015, a Local Law pertaining to Amending Chapter 4, Sections 4 & 5, of the General Police Regulations Of Streets And Sidewalks. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Anthony Peppe voting yes Gary Fickeisen voting yes Nancy McGuerty voting yes Christopher Fulton voting yes Dated: December 28, 2015 ---PAGE BREAK--- A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to adjourn at 7:41 p.m. Anne Riddell – Village Clerk
