VILLAGE OF FAIR HAVEN PLANNING BOARD MEETING March 27, 2018 The Fair Haven Planning Board was called to order at 7:00 pm on Tuesday, March 27, 2018 at the Village Hall. Board members present were Larry Cosser, Debra Rose, Catherine Byers and Linda Clum. Absent was Geoff Hanford, who was still out of town. Shortly before the meeting, the building power went out. A power outage affected a county-wide area for the next hour. Lights for the meeting were provided by the Village’s generator. There were no guests. Larry Cosser opened the meeting. A detailed agenda had been prepared. MINUTES: The minutes of the March 13, 2018 meeting were approved on a motion, second and all votes aye. UNFINISHED BUSINESS: Since the last Planning Board meeting of two weeks ago, March 13th, the Board has continued the work of updating Fair Haven’s part of the Town of Sterling and Village of Fair Haven Comprehensive Plan. Mr. Cosser asked Ms. Rose to present the latest information and progress. 1. Proposed Temporary Moratorium. The Trustees are in receipt of the Planning Board’s formal resolution proposing a temporary moratorium. At the Trustee meeting of March 12, there was discussion about the moratorium. A public hearing will be scheduled by the Trustees for Thursday, April 19. Ms. Rose reported that in a recent conversation with Cayuga County Planning member David Nelson to find out what agreements exist between the Village and County regarding exceptions for County 239 review, it was confirmed that the proposed moratorium law is not excepted. She found out the deadline for submission to the County for this review (in April) is April 10. The County requires a copy of the proposed law, SEQR Part 1, and a supporting statement of explanation. If this is submitted by April 10, the County will put it on their docket for review the following week, and necessary comments will be sent back to the Village soon after. The Planning Board will provide the Village Trustees with complete procedures and documents, ready for action and approval at their regular meeting of April 9, such that all materials for the proposed moratorium law are ready for submission to the County on April 10. 2. Part 1 SEQR – the Planning Board authorized requesting Amy D’Angelo of Sterling Planning Services to prepare the Part 1 SEQR for the proposed Moratorium law. 3. “Future Land Use” final review with a few clarifications. 4. “Recent History/Current Conditions” final review with a few clarifications. 5. “Goals, Objectives & Implementations” final review with a few clarifications. 6. Committee for Updating/Amending the Village Zoning and Land Use Regulations. There seems to be interest in forming a committee made up of motivated volunteers from the ZBA, Planning Board and public. If this functioned as an advisory committee to the Planning Board, it would probably allow for flexibility in scheduling and meeting. Further discussion will be had at the next PB meeting. ---PAGE BREAK--- 7. Zoning Amendment Timeline and Recommendations. Amy D’Angelo from Sterling Planning Services, upon request, wrote a letter to the Village with her recommendations and an estimate of time necessary to complete the Zoning Law Amendment. This letter, along with notes from Ms. Rose for clarification of terms, was submitted to the Village Trustees and Planning Board last week. Ms. D’Angelo believes it will take six to twelve months to accomplish what the Village would like to do, and she stressed the importance of, in her opinion, involving the public in the process, to ensure there is community support for upcoming changes. NEW BUSINESS: 1. Site Plan Review – possible early amendment discussion. There has been interest in enacting a zoning amendment, as soon as possible, specifying Site Plan Review for any new project in the Central Business District. Ms. D’Angelo does not recommend such an action. The Planning Board, while initially favorable to this idea, now recommends that interested parties consult further with Ms. D’Angelo and also with Cayuga County Planning before proceeding with this idea. 2. Discussion of SEQR Part 1 for proposed Comp Plan Update, not authorized yet; SEQR part 2 & 3 for proposed moratorium law, not authorized yet. 3. Recommendations and information to submit to the Village Trustees, by April 3: A) Note: April 10 deadline for moratorium materials to be submitted to Cayuga County Planning for 239 review IN APRIL. This is the day after the regular April Trustee meeting. B) Note: Language of moratorium needs to specify that the square footage is a “footprint” designation. C) Note: only SEQR Part 1 is needed for County 239 review, and will be done by April 3. SEQR Part 2 & 3 are still necessary. “Future Land Use” will be the supporting document. D) Submit: Printed copies of two letters from Ms. D’Angelo and two supporting letters of notes for clarification from Ms. Rose. List of exceptions for 239 review provided from Cayuga County Planning. E) Note: Expected time frame for submittal of final proposed Comprehensive Plan Update: by April 5. 3. Planning Board meeting. The Planning Board intends to set a regular meeting date, which will probably be the first Tuesday of the month. The next meeting of the Planning Board will be in one week Tuesday, April 3, 2018 at 7:00 pm, at the Village Hall. Notice of this meeting was given to the Deputy Village clerk on Friday Mar 23, for timely publication in the Lakeshore news.
