VILLAGE BOARD MEETING JUNE 26, 2017 · PLEDGE OF ALLEGIANCE Mayor Gary Mulvaney called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance. Trustees Nancy McGuerty, Gary Fickeisen, Chris Fulton, and Anthony Peppe were in attendance. Village Clerk Anne Riddell, Treasurer Susan Wade, and Planning Board Chairperson Paul Nelson were also present. · PUBLIC Mayor Gary Mulvaney asked if there was anyone present that wanted to speak that was not on the agenda. No one spoke. · MINUTES A motion was made by Trustee Peppe, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the minutes for the June 12, 2017 Village Board meeting. · BILLS A motion was made by Trustee Fickeisen, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following bills. (Trustee Fulton abstained from Bill #22 due to conflict of interest.) · PURCHASE ORDERS A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the following Purchase Orders: - to Mather Electric for $2,250.00 for a rebuilt electric motor - to W2Operator for $11,175.00 for a replacement pump - to W2Operator for $750.00 for motor repair - to ES2 Environmental Systems for $1,419.00 for a UV lamp ballast - to USA Bluebook for $798.27 for a pH meter · GLENSIDE WATER/SEWER DISTRICT AGREEMENTS Mayor Mulvaney reported that there was no news on the Glenside Water/Sewer District Agreements. · NEW METER REPLACEMENT Mayor Mulvaney noted that 3-4 new meters were installed. He also reported that New York Leak Detection (NYLD) had been here and found a leak on West Cayuga Street by the old Dollar Store along with the leak still remaining on North Main Street (Spaulding) that needs to be repaired. · VILLAGE ORDINANCES This item was tabled until the next regularly scheduled Board meeting due to several open projects that the Board is currently working on. · ZONING AMENDMENTS (PB) – SITE PLAN REVIEW Each of the Trustees received a copy of the drafted Local Law #3 of 2017 pertaining to Site Plan Review. Mayor Mulvaney requested the Trustees review the law prior to the next Board meeting. Planning Board ---PAGE BREAK--- Chairperson Paul Nelson also reminded the Board of two other requested amendments that were discussed with the Planning Board several years ago (Buffer Strips and Parking Lots). Village Clerk Anne Riddell stated that she would review them and speak to Village Attorney Charles Marangola about them. This item was tabled so that the Board could review Local Law #3 of 2017 for the next regularly scheduled Board meeting. · SOLAR POWER GRANT (STP) Each of the Trustees received a letter pertaining to the SolarizeCNY Municipal Solar Project from the Central New York Regional Planning and Development Board. This item was tabled until the next regularly scheduled Board meeting. · POLICE POLICIES Mayor Mulvaney stated that Officer in Charge Robert Brown was making some corrections on the drafted Police Policies before the Board could review. This item was tabled until the next regularly scheduled Board meeting. · PARK STREET (SPEED CALMING MEASURES) Mayor Mulvaney stated that Village Attorney Charles Marangola had discovered that speed limits in New York State cannot be lower than 25 mph except in a designated school zone. Each of the Trustees had received a draft copy of a local law to reduce the Park Street speed limit to 25 mph. After some discussion, the Board agreed to wait a few months to see if what had been done by the Village and the school did alleviate the Park Street residents’ concerns. · SOUTHERN CAYUGA COUNTY CABLE (DYER) Each of the Trustees received a copy of the check from Ray Dyer that was for the amount agreed upon (half of the legal fees) that were to be reimbursed by him to the Village of Moravia regarding the sale of Southern Cayuga County Cable that were incurred by legal counsel. This agenda item is to be removed since this is now closed. · RENTAL INSPECTION FEES (RELEVY) Village Clerk Anne Riddell explained that after speaking with Cayuga County Real Property, it was discovered that the Village does not have to have a local law to relevy any unpaid rental inspection fees, lawn mowing fees, etc. The County does this for the Villages as a courtesy. However, it was explained that if the County was not able to collect the fee, then it would not be paid out to the Village. This agenda item is to be removed since this is now closed. · 2017/2018 EMPLOYEE CARRY OVER TIME Each of the Trustees received a copy of the 2017/2018 Village of Moravia Employee Carry Over Time. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to approve the 2017/2018 Employee Carry Over Time. · MFD/VFW PARADE A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to approve the MFD/VFW Parade scheduled for July 15, 2017 and to waive the deposit. · ANNUAL AUDIT OF JUSTICE BOOKS ---PAGE BREAK--- Trustee McGuerty reported that she and Trustee Fulton recently reviewed Judge June Shepardson’s Village Justice books and completed the Justice Audit Checklist. Judge David Wade’s books were also on the table for Board review. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 5-0 vote to approve the following resolution: BE IT RESOLVED THAT the Board of Trustees of the Village of Moravia, New York, hereby acknowledges that it has examined and audited, to the best of their knowledge, the records of the Justice Court of the Village of Moravia, New York, for year June 1, 2016 to May 31, 2017; and BE IT FURTHER RESOLVED THAT the Clerk of the Village of Moravia, New York, is hereby directed to provide a copy of this resolution and report of such audit to: Joan Casazza, Internal Auditor, NYS Office of Court Administration, 2500 Pond View, Suite 104, Castleton on Hudson, NY 12033. A motion was made by Trustee McGuerty, seconded by Trustee Fulton and carried with a 4-0 vote to adopt the Limited English Proficiency (LEP) plan in order to be USDA compliant. · ANNUAL FINANCIAL REPORT 2016/2017 The Village of Moravia Annual Financial Report for 2016/2017 was on the table for Board review. A motion was made by Trustee Fulton, seconded by Trustee McGuerty and carried with a 4-0 vote to approve the Village of Moravia Annual Financial Report for 2016/2017. · REFUND ETHEL FULLER PARK (AMPHITHEATER) $25.00 FEE Chris Fulton had a Board approved Request For Use Of Amphitheater at Fuller Park that was scheduled and then cancelled several days in advance (due to weather forecast) for June 17, 2017. A motion was made by Trustee Peppe, seconded by Trustee Fickeisen and carried with a 3-0 vote to approve the $25.00 refund to Chris Fulton for the cancelled Request For Use Of Amphitheater at Fuller Park. (Trustee Fulton abstained due to conflict of interest.) · COPIER MAINTENANCE AGREEMENT ---PAGE BREAK--- Each of the Trustees received a copy of the annual Maintenance Agreement from Copier Products for the Village Office’s copier. A motion was made by Trustee Peppe, seconded by Trustee Fulton and carried with a 4-0 vote to approve the maintenance agreement with Copier Products Sales & Service, Inc. at the cost of $750.00 per year. · EMPLOYMENT APPLICATION (GLEASON) Application for employment for Laborer or Sewer Treatment Plant from Joshua Gleason was on the table for Board review. A motion was made by Trustee McGuerty, seconded by Trustee Fickeisen and carried with a 4-0 vote to accept and place on file the employment application from Joshua Gleason. · INFORMATIONAL ITEMS Each of the Trustees received a copy of the following: - Village of Moravia Planning Board Minutes (05/15/17). - Village Planning Board “Comprehensive Plan” – Scope of Work. - Cayuga County Association of Villages Minutes (05/23/17). - Village insurance check (south well pump). - Letter from Village to NYSDOT (Route 38 & Route 38A repairs). - Letter from Village to Cayuga County Highway Department (flooding). Trustee Fickeisen reported that there were some blocks of sidewalks on the Red Apple property that needed repair on both the Main Street side and the East Cayuga Street side. Village Clerk Anne Riddell was directed to send them a letter requesting them to replace the areas that were deemed dangerous.
